書簡をもって啓上いたします。本使は、千九百九十九年十月十四日から二千年一月十八日までの間に行われたアルバニア共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とアルバニア共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。


							

						

						

							

								
Excellency,

I have the honour to refer to the recent　negotiations between the representatives of the Government of Japan and of the Government of the Republic of Albania that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Albania and of the Governments of the creditor countries concerned held between October 14, 1999 and January 18, 2000.  I have further the honour to confirm the following understanding reached in the course of the said negotiations:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
１　債務支払猶予方式による債務救済措置が、国際協力銀行（以下「銀行」という。)により、日本国の関係法令に従ってとられることになる。


							

						

						

							

								
1.	A debt relief measure in the form of deferral will be taken by Japan Bank for International Cooperation (hereinafter referred to as "the Bank") in accordance with the relevant laws and regulations of Japan.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２(1)　支払を猶予される債務（以下「支払猶予債務」という。)は、アルバニア共和国政府又はアルバニア電力公社が銀行に対して負う次の債務から成る。


							

						

						

							

								
2.(1)	The debts to be deferred (hereinafter referred to as "the Deferred Debts") consist of the following debts which the Government of the Republic of Albania or the Albanian Electroenergetic Corporation owes to the Bank:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　(a)　千九百九十九年四月一日から二千年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の契約上の利子（その内訳は、この書簡の付表に掲げられる。)。


							

						

						

							

								
(a)the contractual interest having fallen due between April 1, 1999 and June 30, 2000, both dates inclusive, and not paid, the breakdown of which is shown in the List attached hereto; and


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  (b)　(a)にいう債務に対する利子であって、この書簡の付表にいう各々の弁済期日から二千年六月三十日までの間（両期日を含む。)に生じたもの。当該利子は、年一・七パーセントの率によって算定される。


							

						

						

							

								
(b)the interest on the debts mentioned in (a) above having accrued between each due date mentioned in the List attached hereto and June 30, 2000, both dates inclusive.  Such interest will be calculated at the rate of one point seven per cent (1.7%) per annum.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  (2)　支払猶予債務の総額は、二千六百九十四万二千三百八十五円（二六、九四二、三八五円）になる。


							

						

						

							

								
(2)The total amount of the Deferred Debts will be twenty-six million nine hundred forty-two thousand three hundred and eighty-five yen (26,942,385).


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  (3)　(2)にいう総額及びこの書簡の付表は、一方においてアルバニア共和国政府の関係当局又はアルバニア電力公社と他方において銀行が行う最終的照合の後に、日本国政府とアルバニア共和国政府の関係当局間の合意により修正されることがある。


							

						

						

							

								
(3)Modifications may be made to the total amount referred to in sub-paragraph (2) above and to the List attached hereto by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Albania, after the final verification to be made by the authorities concerned of the Government of the Republic of Albania or the Albanian Electroenergetic Corporation on the one hand and the Bank on the other.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
３　債務支払猶予の条件（２(1)(b)に定める利子の算定方法を含む。)は、アルバニア共和国政府と銀行との間及びアルバニア電力公社と銀行との間で締結される債務支払猶予契約であって、なかんずく、次の原則を含むものにおいて規定される。


							

						

						

							

								
3.The terms and conditions of the deferral (including the method of calculation of the interest set out in (b) of sub-paragraph (1) of paragraph 2 above) will be stipulated in deferral agreements to be concluded between the Government of the Republic of Albania and the Bank and between the Albanian Electroenergetic Corporation and the Bank, which will contain, inter alia, the following principles:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
 (1)　支払猶予債務を構成する債務の各々は、二千一年六月三十日に始まる十回の均等半年賦払によって支払われる。


							

						

						

							

								
(1)Each of the debts composing the Deferred Debts will be paid in ten (10) equal semi-annual installments beginning on June 30, 2001.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
 (2)　支払猶予債務に対して二千年七月一日から適用される利子率は、年一・七パーセントとする。

  ４　アルバニアの債務（この取極が対象とする債務を含む。)の再編に関連してアルバニア共和国政府の代表者及び関係債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府とアルバニア共和国政府との間でこの取極の継続又は修正について討議するために協議が行われる。

							

						

						

							

								
4.	If the representative of the Government of the Republic of Albania and the representatives of the Governments of the creditor countries concerned come to a new conclusion in connection with reorganization of the
Albanian debts including the debts covered by the present arrangements, consultations will be held between the Government of Japan and the Government of the Republic of Albania in order to discuss the matter of continuation or modification of the present arrangements.
