  　書簡をもって啓上いたします。本大臣は、千九百五十四年三月八日に東京で署名された日本国とアメリカ合衆国との間の相互防衛援助協定（以下「ＭＤＡ協定」という。）に言及するとともに、後記のアメリカ合衆国政府の許可に基づき商業輸出される品目に対しＭＤＡ協定が適用されることに言及する光栄を有します。同協定は、各政府が、他方の政府に対し、援助を供与する政府が承認することがある装備、資材、役務その他の援助を、両政府の間で行うべき細目取極に従って、使用に供するものとすることを特に規定しています。

							

						

						

							

								
Excellency,

	I have the honor to refer to the Mutual Defense Assistance Agreement between Japan and the United States of America, signed at Tokyo on March 8, 1954 (hereinafter referred to as "the MDA Agreement"), which provides, inter alia, that each Government will make available to the other such equipment, materials, services, or other assistance as the Government furnishing such assistance may authorize, in accordance with such detailed arrangements as may be made between them, and refer to the application of the terms of the MDA Agreement to the items to be commercially exported pursuant to the licenses of the Government of the United States of America as referred to below.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　前記の規定に従い、日本国政府及びアメリカ合衆国政府の代表者は、政府間の販売又は商業輸出がアメリカ合衆国政府によりその法令に基づき管理されるリモート・センシングの部品及び構成品並びにそれらの関連情報（以下「管理品目」という。）であって日本国政府が情報収集衛星システム（以下「システム」という。）を自主的に開発する計画のために用いられるものを日本国政府及びその委託を受けた者が取得することについて、最近、前記の細目取極を作成するため討議を行いました。この討議の結果に関する日本国政府の了解は、次のとおりであります。

							

						

						

							

								
	In pursuance of this provision, the representatives of the Government of Japan and the Government of the United States of America have recently held discussions for the purpose of making such detailed arrangements as mentioned above concerning the acquisition by the Government of Japan and its agents of the remote sensing parts and components and information related thereto, the government-to-government sale or commercial export of which is controlled by the Government of the United States of America based upon its laws and regulations (hereinafter referred to as "the controlled items"), to be used for a program in which the Government of Japan indigenously develops an Information Gathering Satellite System (hereinafter referred to as "the System").  The following is the understanding of the Government of Japan regarding the results of the above-mentioned discussions:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　６の規定に基づき締結される実施細目取極に従い、日本国政府は、同政府がシステムを自主的に開発する計画のために用いられる管理品目をその委託を受けた者がこの了解に合致した方法でアメリカ合衆国の企業から取得することを確保する。

							

						

						

							

								
1.	In accordance with the detailed implementing arrangements to be concluded under paragraph 6. below, the Government of Japan will ensure that its agents will acquire the controlled items to be used for a program in which the Government of Japan indigenously develops the System from the industries in the United States of America, in a manner consistent with the present understanding.

  ３　アメリカ合衆国政府は、日本国政府の委託を受けた者が取得する管理品目の商業輸出に係る許可の申請に関し迅速に行動するため可能なあらゆる措置をとる。

							

						

						

							

								
3.	The Government of the United States of America will take all available measures to act expeditiously on license applications for the commercial export of the controlled items to be acquired by the agents of the Government of Japan.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　この了解は、特に次のことを規定するＭＤＡ協定及び同協定に基づく取極（千九百五十六年三月二十二日に東京で署名された防衛目的のためにする特許権及び技術上の知識の交流を容易にするための日本国政府とアメリカ合衆国政府との間の協定を含む。）に従って実施される。

							

						

						

							

								
4.	The present understanding will be implemented in accordance with the terms of the MDA Agreement which provide, inter alia:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (a)　各政府は、ＭＤＡ協定に従って受ける援助を両政府が満足するような方法で平和及び安全保障を促進するため効果的に使用するものとし、いずれの一方の政府も、他方の政府の事前の同意を得ないでその援助を他の目的のため転用してはならない。

							

						

						

							

								
(a)	that each Government will make effective use of assistance received pursuant to the MDA Agreement for the purposes of promoting peace and security in a manner that is satisfactory to both Governments, and neither Government, without the prior consent of the other, will devote such assistance to any other purpose;

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (b)　各政府は、ＭＤＡ協定に従って受ける装備、資材又は役務の所有権又は占有権を、これらの援助を供与する政府の事前の同意を得ないで、自国政府の職員若しくは委託を受けた者以外の者又は他の政府に移転しないことを約束する。

							

						

						

							

								
(b)	that each Government undertakes not to transfer to any person not an officer or agent of such Government, or to any other government, title to or possession of any equipment, materials, or services received pursuant to the MDA Agreement, without the prior consent of the Government which furnished such assistance; and

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (c)　各政府は、ＭＤＡ協定に従って他方の政府が供与する秘密の物件、役務又は情報についてその秘密の漏せつ又はその危険を防止するため、両政府の間で合意する秘密保持の措置を執るものとする。

							

						

						

							

								
(c)	that each Government will take such security measures as may be agreed upon between the two Governments in order to prevent the disclosure or compromise of classified articles, services or information furnished by the other Government pursuant to the MDA Agreement;and arrangements concluded thereunder, including the Agreement between the Government of Japan and the Government of the United States of America to Facilitate Interchange of Patent Rights and Technical Information for Purposes of Defense signed at Tokyo on March 22, 1956.

  ７　日本国政府及びアメリカ合衆国政府は、いずれか一方の政府の要請があったときは、システムに対するアメリカ合衆国政府の支援に関する事項について協議する。

							

						

						

							

								
7.	The Government of Japan and the Government of the United States of America will, upon request of either of them, consult on matters regarding support by the Government of the United States of America for the System.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　この了解及びこれに基づき締結されるすべての取極に基づき日本国政府が行う財政上の債務の負担及び支出は、日本国の憲法上の規定に従った予算の承認を得たところにより行う。

							

						

						

							

								
8.	The financial obligations and expenditures incurred by the Government of Japan under the present understanding and all arrangements to be concluded hereunder will be subject to budget authorization pursuant to the constitutional provisions of Japan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　本大臣は、前記の了解がアメリカ合衆国政府により受諾される場合には、この書簡及び受諾する旨の閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生じ、かつ、いずれか一方の政府による終了の通告の受領の日の後六箇月が経過する時まで効力を有するものとすることを提案するとともに、日本国政府及びその委託を受けた者が取得した管理品目については、そのような終了にかかわらず、ＭＤＡ協定の関連規定が引き続き効力を有することを閣下に対し確認する光栄を有します。

							

						

						

							

								
	I have the honor to propose that, if the above understanding is acceptable to the Government of the United States of America, the present Note and Your Excellency's reply of acceptance shall be regarded as constituting an agreement between the two Governments which shall enter into force on the date of Your Excellency's reply, and shall remain in force until six months after the date of receipt of notice of termination by either Government.  I have further the honor to confirm to Your Excellency that notwithstanding such termination, relevant provisions of the MDA Agreement will continue in effect with respect to the controlled items acquired by the Government of Japan and its agents.
