AGREEMENT AMENDING THE AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA CONCERNING RECIPROCAL PROVISION OF LOGISTIC SUPPORT, SUPPLIES AND SERVICES BETWEEN THE SELF-DEFENSE FORCES OF JAPAN AND THE ARMED FORCES OF THE UNITED STATES OF AMERICA
日本国政府及びアメリカ合衆国政府は、
The Government of Japan and the Government of the United States of America,
千九百九十七年九月二十三日に公表された日米防衛協力のための指針が周辺事態に対応する活動のための協力に言及していることを想起し、
Recalling that the Guidelines for U.S.-Japan Defense Cooperation announced on September 23, 1997 refer to cooperation for operations in response to situations in areas surrounding Japan,
千九百九十六年四月十五日に東京で署名された日本国の自衛隊とアメリカ合衆国軍隊との間における後方支援、物品又は役務の相互の提供に関する日本国政府とアメリカ合衆国政府との間の協定（以下「協定」という。）を改正することを希望して、
Desiring to amend the Agreement between the Government of Japan and the Government of the United States of America concerning reciprocal provision of logistic support, supplies and services between the Self-Defense Forces of Japan and the Armed Forces of the United States of America signed at Tokyo on April 15, 1996 (hereinafter referred to as "the Agreement"),
次のとおり協定した。
Have agreed as follows:
第一条
Article I
協定前文中「日本国とアメリカ合衆国との間の相互協力及び安全保障条約」の次に「（以下「条約」という。）」を加える。
The preamble of the Agreement shall be amended by inserting the words "(hereinafter referred to as the "Treaty")" immediately after the words "the Treaty of Mutual Cooperation and Security between Japan and the United States of America."
第二条
Article II
協定第一条１を次のように改める。
Paragraph 1 of Article I of the Agreement shall be deleted and replaced by the following:
１ この協定において、
"1. As used in this Agreement:
ａ 「後方支援、物品又は役務」とは、後方支援において提供される物品又は役務をいう。
a. the term "logistic support, supplies and services" means supplies and services in the field of logistic support;
ｂ 「周辺事態」とは、日本国の周辺の地域における日本国の平和及び安全に重要な影響を与える事態をいう。
b. the term "situations in areas surrounding Japan" means situations in areas surrounding Japan that have an important influence on Japan's peace and security."
第三条
Article III
協定第一条２を次のように改める。
Paragraph 2 of Article I of the Agreement shall be deleted and replaced by the following:
２ この協定は、共同訓練、国際連合平和維持活動、人道的な国際救援活動又は周辺事態に対応する活動に必要な後方支援、物品又は役務の日本国の自衛隊とアメリカ合衆国軍隊との間における相互の提供に関する基本的な条件を定めることを目的とする。
"2. The purpose of this Agreement is to establish basic terms and conditions for the reciprocal provision of logistic support, supplies and services, between the Self-Defense Forces of Japan and the Armed Forces of the United States of America, necessary for bilateral exercises and training, United Nations Peacekeeping Operations, humanitarian international relief operations, or operations in response to situations in areas surrounding Japan."
第四条
Article IV
協定第二条３を次のように改める。
Paragraph 3 of Article II of the Agreement shall be deleted and replaced by the following:
３ ２の規定については、日本国の自衛隊による武器若しくは弾薬の提供又はアメリカ合衆国軍隊による武器システム若しくは弾薬の提供が含まれるものと解してはならない。
"3. Paragraph 2 of this Article shall not be interpreted as to include the provision of weapons or ammunition by the Self-Defense Forces of Japan, or the provision of weapons systems or ammunition by the Armed Forces of the United States of America."
第五条
Article V
協定第三条の次に次の新たな第四条を加える。
The following new Article shall be inserted immediately after Article III of the Agreement:
第四条
"Article IV
１ いずれか一方の当事国政府が、周辺事態に際して日本国の自衛隊又はアメリカ合衆国軍隊がそれぞれの国の法令に従って行う活動であって、条約の目的の達成に寄与するもののために必要な後方支援、物品又は役務の提供を他方の当事国政府に対してこの協定に基づいて要請する場合には、当該他方の当事国政府は、その権限の範囲内で、要請された後方支援、物品又は役務を提供することができる。
1. When either Party requests, under this Agreement, the other Party to provide logistic support, supplies and services necessary for operations which are conducted by the Self-Defense Forces of Japan or the Armed Forces of the United States of America, in situations in areas surrounding Japan, in accordance with the laws and regulations of the respective countries and which contribute to the achievement of the purposes of the Treaty, the other Party, within its competence, may provide the logistic support, supplies and services requested.
２ この条の規定に基づいて提供される後方支援、物品又は役務は、次に掲げる区分に係るものとする。 食料、水、宿泊、輸送（空輸を含む。）、燃料・油脂・潤滑油、被服、通信、衛生業務、基地支援、保管、施設の利用、部品・構成品、修理・整備及び空港・港湾業務
2. The logistic support, supplies and services related to the following categories may be provided under this Article: food; water; billeting; transportation (including airlift); petroleum, oils, and lubricants; clothing; communications; medical services; base support; storage; use of facilities; spare parts and components; repair and maintenance; and airport and seaport services.
それぞれの区分に係る後方支援、物品又は役務については、第二条にいう付表において定める。
The logistic support, supplies and services related to each category are specified in the Annex referred to in Article II.
３ 第二条３の規定は、この条の規定に基づく後方支援、物品又は役務の提供に適用する。
3. Paragraph 3 of Article II shall be applied to the provision of logistic support, supplies and services under this Article.
４ この条の適用上、日本国の自衛隊は、周辺事態に対処するための日本国の措置について定めた日本国の関連の法律に従って後方支援、物品又は役務を提供し、当該法律によって認められた日本国の自衛隊の活動に関し後方支援、物品又は役務を受領するものと了解される。
4. For the purposes of this Article, it is understood that the Self-Defense Forces of Japan will provide logistic support, supplies and services pursuant to the relevant laws of Japan concerning its actions to cope with situations in areas surrounding Japan, and receive logistic support, supplies and services with regard to their activities authorized by the said laws."
第六条
Article VI
協定第四条から第九条までを一条ずつ繰り下げる。新たな第六条中「第七条」を「第八条」に改める。
Remaining Articles IV, V, VI, VII, VIII, and IX of the Agreement shall be renumbered as Articles V, VI, VII, VIII, IX, and X, respectively. The references to "Article IV" and "Article VII" in renumbered Article VI shall be deleted and replaced by references to "Article V" and "Article VIII", respectively.
第七条
Article VII
この協定の付表をもって、協定付表に代える。
The Annex of the Agreement shall be replaced by the new Annex attached to this Agreement.
第八条
Article VIII
この協定は、アメリカ合衆国政府が日本国政府から日本国がこの協定を承認した旨の書面による通告を受領した日の後百二十日目の日に効力を生じ、協定が有効である限り効力を有する。
This Agreement shall enter into force on the 120th day after date of receipt by the Government of the United States of America of a written notice from the Government of Japan of approval of this Agreement by Japan and shall remain in effect as long as the Agreement remains in force.
以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Agreement.
