  　書簡をもって啓上いたします。本使は、トルコ共和国の地震災害救済及び経済再建に寄与することを目的として供与される日本国の借款に関して日本国政府の代表者とトルコ共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。

							

						

						

							

								
Excellency,

	I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Turkey concerning a Japanese loan to be extended with a view to contributing to the earthquake disaster relief and economic reconstruction of the Republic of Turkey:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　二百三十六億円（二三、六〇〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従って、トルコ共和国政府に供与されることになる。

							

						

						

							

								
1.	A loan in Japanese yen up to the amount of twenty-three billion six hundred million yen (23,600,000,000) (hereinafter referred to as "the Loan") will be extended to the Government of the Republic of Turkey by the Japan Bank for International Cooperation (hereinafter referred to as "the Bank") in accordance with the relevant laws and regulations of Japan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２(1)　借款は、トルコ共和国政府と銀行との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。

							

						

						

							

								
2.	(1)	The Loan will be made available by a loan agreement to be concluded between the Government of the Republic of Turkey and the Bank.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (a)　償還期間は、七年の据置期間の後十八年とする。

							

						

						

							

								
(a)	The repayment period will be eighteen (18) years after the grace period of seven (7) years.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　利子率は、年二・二パーセントとする。

							

						

						

							

								
(b)	The rate of interest will be two and two-tenths per cent (2.2%) per annum.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (c)　支出期間は、借款契約の発効の日から二年とする。

							

						

						

							

								
(c)	The disbursement period will be two (2) years from the date of coming into force of the loan agreement.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。

							

						

						

							

								
	(2)	The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３(1)　借款は、トルコ共和国内の輸入者が調達適格国の供給者に対して既に行ったか又は行われる支払で、両政府の関係当局間で相互に合意する表に掲げる生産物の購入、当該生産物の購入に付随する役務の購入及び日本国からトルコ共和国への仮設住宅の輸送に必要な役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。

							

						

						

							

								
3.	(1)	The Loan will be made available to cover payments already made and/or to be made to suppliers of eligible source countries by importers in the Republic of Turkey under such contracts as have been or may be entered into between them for purchases of such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, purchases of services incidental to the purchases of those products, and purchases of services required for the transportation of prefabricated buildings from Japan to the Republic of Turkey, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)にいう表は、両政府の関係当局間の合意によって修正することができる。

							

						

						

							

								
	(2)	The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (3)　(1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。

							

						

						

							

								
	(3)	The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４(1)　トルコ共和国政府は、トルコ共和国政府の名義でトルコ共和国中央銀行に開設される見返資金勘定に借款の円貨による支出額（トルコ共和国政府により使用される額を除く。）に等しい額をトルコ通貨で振り替えるようにするための措置をとる。このようにして振り替えられた通貨は、トルコ共和国政府の復旧、再建及び開発計画に基づく事業計画の現地通貨の需要に充てるために使用されなければならない。

							

						

						

							

								
4.	(1)	The Government of the Republic of Turkey will take measures to have the equivalent in Turkish currency of the amount of yen disbursements of the Loan, excluding the amount which will be used by the Government of the Republic of Turkey, transferred into the counterpart fund account opened in the name of the Government of the Republic of Turkey at the Central Bank of the Republic of Turkey.  The amount of Turkish currency thus transferred shall be used to cover local currency requirements of the projects under the Program of the Government of the Republic of Turkey for Rehabilitation, Reconstruction and Development.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　トルコ共和国政府は、銀行に対し、(1)にいう見返資金の使用についての報告を提出する。

  ５　トルコ共和国政府は、３(1)にいう生産物又は役務が銀行の調達のためのガイドライン（国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。）に従って調達されることを確保する。

							

						

						

							

								
5.	The Government of the Republic of Turkey will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Bank, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　トルコ共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。

							

						

						

							

								
6.	With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of the Republic of Turkey will refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　トルコ共和国政府は、銀行について、借款及びそれから生ずる利子に対して又はそれらに関連してトルコ共和国において課されるすべての財政課徴金又は租税を免除する。

							

						

						

							

								
7.	The Government of the Republic of Turkey will exempt the Bank from all fiscal levies or taxes imposed in the Republic of Turkey on and/or in connection with the Loan as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　トルコ共和国政府は、借款が、適正にかつ専ら３(1)にいう生産物又は役務を購入するために使用されることを確保するために必要な措置をとる。

							

						

						

							

								
8.	The Government of the Republic of Turkey will take necessary measures to ensure that the Loan be used properly and exclusively for purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ９　両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
