  　書簡をもって啓上いたします。本使は、タイ王国の経済の安定及び開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とタイ王国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。

							

						

						

							

								
Excellency,

	I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Kingdom of Thailand concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Kingdom of Thailand:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　三百億円（三〇、〇〇〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、この書簡に附属する付表（以下「付表」という。）に掲げるプログラムの実施のため、海外経済協力基金（以下「基金」という。）により、日本国の関係法令に従って、タイ王国政府に供与されることになる。

							

						

						

							

								
1.	A loan in Japanese yen up to the amount of thirty billion yen (30,000,000,000) (hereinafter referred to as "the Loan") will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Kingdom of Thailand by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") for the implementation of the programs enumerated in the List attached hereto (hereinafter referred to as "the List").

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２(1)　借款は、タイ王国政府と基金との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。

							

						

						

							

								
2.	(1)	The Loan will be made available by a loan agreement to be concluded between the Government of the Kingdom of Thailand and the Fund.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (a)　償還期間は、七年の据置期間の後十八年とする。

							

						

						

							

								
(a) The repayment period will be eighteen (18) years after the grace period of seven (7) years.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　利子率は、年一・〇パーセントとする。

      (c)　支出期間は、前記の借款契約の発効の日から四年とする。

    (2)　(1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。

  ３(1)　借款は、次の支払を対象として使用に供される。

      (a)　タイ王国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う二百九十六億二千七百万円（二九、六二七、〇〇〇、〇〇〇円）の額までの支払で、生産物（両政府の関係当局間で相互に合意する表に掲げる生産物を除く。）の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるもの。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。

							

						

						

							

								
(a) payments, up to the amount of twenty-nine billion six hundred and twenty-seven million yen (29,627,000,000), already made and/or to be made to suppliers of eligible source countries by importers in the Kingdom of Thailand under such contracts as have been or may be entered into between them for purchases of products, except such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries; and

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　タイ王国政府がコンサルタントに対して行う三億七千三百万円（三七三、〇〇〇、〇〇〇円）の額までの支払で、４(1)にいう見返資金の使用を監視することを目的とする役務の購入のために両者の間で締結されることのある契約に基づいて行われるもの。

							

						

						

							

								
(b) payments, up to the amount of three hundred and seventy-three million yen (373,000,000), to be made to consultants by the Government of the Kingdom of Thailand under such contracts as may be entered into between them for purchases of services aiming at monitoring the utilization of the counterpart fund mentioned in sub-paragraph (1) of paragraph 4.

  ４(1)　タイ王国政府は、タイ王国政府の名義でクルンタイ銀行に開設される見返資金勘定に借款の円貨による支出額（３(1)(b)にいう支払に充てるために使用される額を除く。）に等しい額をタイ通貨で振り替えるようにするための措置をとる。１にいう各々のプログラムについて、副勘定が見返資金勘定の中に設置される。

							

						

						

							

								
4.	(1)	The Government of the Kingdom of Thailand will take measures to have the equivalent in Thai currency of the amount of yen disbursements of the Loan, excluding the amount which will be used to cover those payments mentioned in sub-paragraph (1)(b) of paragraph 3 above, transferred into the counterpart fund account opened in the name of the Government of the Kingdom of Thailand at Krung Thai Bank Public Company Limited.  A sub-account will be set up in the counterpart fund account for each program mentioned in paragraph 1 respectively.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　このようにして振り替えられた見返資金は、タイ王国政府により、付表に掲げる配分に従い円貨の額に等しい額までのタイ通貨により、当該プログラムの各々の副勘定に配分される。タイ王国政府は、日本国政府に対し、見返資金の配分の進捗状況を遅滞なく報告する。

							

						

						

							

								
	(2)	The counterpart fund thus transferred will be allocated by the Government of the Kingdom of Thailand to each sub-account of the corresponding program in Thai currency up to the amount equivalent to the amount of yen according to the allocation as mentioned in the List.  The Government of the Kingdom of Thailand shall duly inform the Government of Japan on the progress of the allocation of the counterpart fund.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (3)　配分された見返資金は、各々のプログラムの現地通貨の需要に充てるために使用される。タイ王国政府は、基金に対し、見返資金の使用についての通知を提出する。

							

						

						

							

								
	(3)	The allocated counterpart fund will be used to cover local currency requirements of the corresponding programs.   ５　タイ王国政府は、３(1)にいう生産物及び役務が基金の調達のためのガイドライン（競争入札の手続が適用できないか又は適当でない場合を除くほか従うべき競争入札の手続をなかんずく定める。）に従って調達されることを確保する。

							

						

						

							

								
5.	The Government of the Kingdom of Thailand will ensure that the products and services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of competitive tendering to be followed except where such procedures are inapplicable or inappropriate.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　タイ王国政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連してタイ王国の法律に基づいて課されるすべての財政課徴金及び租税を免除する。

							

						

						

							

								
6.	The Government of the Kingdom of Thailand will exempt the Fund from all fiscal levies and taxes imposed under the laws of the Kingdom of Thailand on and/or in connection with the Loan as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　３(1)にいう生産物又は役務の供給に関連してタイ王国においてその役務が必要とされる日本国民は、タイ王国の関係法令に従って、作業の遂行のためタイ王国への入国及び同国における滞在に必要な便宜を与えられる。

							

						

						

							

								
7.	Japanese nationals whose services may be required in the Kingdom of Thailand in connection with the supply of the products and/or services mentioned in sub-paragraph (1) of paragraph 3 will be accorded, in accordance with the relevant laws and regulations of the Kingdom of Thailand, such facilities as may be necessary for their entry into the Kingdom of Thailand and stay therein for the performance of their work.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　タイ王国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。

							

						

						

							

								
8.	With regard to the shipping and marine insurance of products purchased under the Loan, the Government of the Kingdom of Thailand will refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ９　タイ王国政府は、借款が適正にかつ専ら３(1)にいう生産物及び役務を購入するために使用されること並びに４(1)にいう見返資金が適正にかつ専ら付表に掲げる各々のプログラムの実行のための現地通貨の需要に充てるために使用されることを確保するために必要な措置をとる。

							

						

						

							

								
9.	The Government of the Kingdom of Thailand will take necessary measures to ensure that the Loan be used properly and exclusively for the purchases of the products and services mentioned in sub-paragraph (1) of paragraph 3, and that the counterpart fund mentioned in sub-paragraph (1) of paragraph 4 be used properly and exclusively to cover local currency requirements for the execution of the corresponding programs enumerated in the List.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  10(1)　タイ王国政府は、要請に応じ、日本国政府及び基金に対し、借款の実施の進捗状況に関する情報及び資料を提出する。

							

						

						

							

								
10.	(1)	The Government of the Kingdom of Thailand will, upon request, furnish the Government of Japan and the Fund with information and data concerning the progress of the implementation of the Loan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　両政府は、共同して借款の実施の進捗状況を毎年及び必要に応じ随時検討し、それらの円滑かつ効果的な使用を確保するため必要に応じ適当な措置をとる。基金は、その検討に参加するよう招かれる。

							

						

						

							

								
	(2)	The two Governments will jointly review annually, and from time to time, if necessary, the progress of the implementation of the Loan and take appropriate measures, if necessary, to secure their smooth and effective utilization.   11　両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
