Warsaw, December 16, 1998
書簡をもって啓上いたします。本使は、日本国とポーランド共和国との間の旅行並びに文化及び通商に関する関係を促進するため、査証の要件及び査証料の免除に関し、日本国政府の代表者とポーランド共和国政府の代表者との間で行われた最近の協議に言及する光栄を有します。本使は、更に、次の取極を日本国政府に代わって提案する光栄を有します。
Excellency, I have the honour to refer to the recent consultations held between the representatives of the Government of Japan and of the Government of the Republic of Poland concerning waiver of visa requirements and visa fees for nationals of Japan or of the Republic of Poland with a view to facilitating travel as well as cultural and commercial relations between Japan and the Republic of Poland. I have further the honour to propose on behalf of the Government of Japan the following arrangements:
1 日本国の国民又はポーランド共和国の国民であって、自国の権限のある当局が発給した有効な旅券を所持し、継続する九十日を超えない期間滞在する意図をもって相手国に入国することを希望するものは、査証を取得することなく相手国に入国することができる。
1. Nationals of Japan or of the Republic of Poland holding valid passports issued by the competent authorities of the country of which they are nationals and seeking entry into the other country with the intention of staying in such other country for a period not exceeding ninety consecutive days may enter such other country without obtaining visas.
2 1の査証の要件の免除は、日本国の国民又はポーランド共和国の国民であって、就職し又は自由職業若しくは他の生業(報酬を得ることを目的とする芸能及びスポーツを含む。)に従事する意図をもって相手国に入国することを希望するものには適用しない。
2. The waiver of visa requirements under paragraph 1 shall not apply to nationals of Japan or of the Republic of Poland who are seeking entry into the other country with the intention of seeking employment or of exercising a profession or other occupation (including public entertainment and sport for remunerative purposes).
3 日本国の権限のある当局又はポーランド共和国の権限ある当局は、相手国の国民が申請する査証についていかなる手数料も徴収しない。
3. The competent authorities of Japan or of the Republic of Poland shall not charge any fees for visas applied for by the nationals of the other country.
4 1の査証の要件の免除は、相手国に入国する日本国の国民又はポーランド共和国の国民に対し、入国、滞在、居住、出国その他の外国人の管理に関する相手国の法令の適用を免除するものではない。
4. The waiver of visa requirements under paragraph 1 does not exempt the nationals of Japan or of the Republic of Poland entering the other country from the laws and regulations of such other country concerning entry, stay, residence, exit and other control over aliens.
5 いずれの一方の政府も、公安、秩序及び衛生を含む公の政策上の理由により前記の諸措置の全部又は一部の適用を一時的に停止する権利を留保する。このような適用の停止又はその解除は、外交上の経路を通じて直ちに他方の政府に通告される。
5. Either Government reserves the right to temporarily suspend the application of all or any part of the foregoing measures for reasons of public policy including those relating to public security, order and health. Any suspension or the lifting of the suspension shall be notified immediately to the other Government through the diplomatic channel.
6 いずれの一方の政府も、好ましくないと認める相手国の国民に対し、自国の領域への入域又は滞在を拒否する権利を留保する。
6. Either Government reserves the right to refuse entry into or stay in its territory to the nationals of the other country whom it considers undesirable.
7 この取極は、それぞれの国において施行されている法令に従って実施される。
7. The present arrangements shall be implemented in accordance with the laws and regulations in force in each country.
8 いずれの一方の政府も、他方の政府に対し、三十日前に文書による予告を与えることにより、この取極を終了させることができる。
8. Either Government may terminate the present arrangements by giving thirty days' written notice to the other Government.
本使は、更に、この書簡及び前記の取極をポーランド共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日の後六十日目の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming the foregoing arrangements on behalf of the Government of the Republic of Poland shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the sixtieth day after the date of Your Excellency's Note in reply.

書簡をもって啓上いたします。本大臣は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

本大臣は、ポーランド共和国政府が前記の取極を受諾することをポーランド共和国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日の後六十日目の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to inform Your Excellency, on behalf of the Government of the Republic of Poland, that the Government of the Republic of Poland accepts the arrangements set forth in Your Excellency's Note and to confirm that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the sixtieth day after the date of this Note.
