  　書簡をもって啓上いたします。本使は、高速再突入実験機計画（以下「計画」という。）に係る日本国政府とモーリタニア・イスラム共和国政府（以下「モーリタニア政府」という。）との間の協力を行うための条件に関し日本国政府の代表者とモーリタニア政府の代表者との間で行われた最近の討議に言及するとともに、日本国政府に代わってこの協力のための次の取極を提案する光栄を有します。


							

						

						

							

								
Excellency,

	I have the honour to refer to the recent discussion between representatives of the Government of Japan and the Government of the Islamic Republic of Mauritania (hereinafter referred to as "the Government of Mauritania") on the terms and conditions whereby co-operation on the Demonstrator of Atmospheric Flight with Hyper Speed Programme (hereinafter referred to as "the Programme") will be undertaken between the two Governments and to propose, on behalf of the Government of Japan, the following arrangements for this co-operation:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　計画に係る協力は、日本国政府については文部省宇宙科学研究所（以下「宇宙研」という。）とモーリタニア政府については国民教育省ヌアクショット大学（以下「ヌアクショット大学」という。）との間で実施される。


							

						

						

							

								
1.	Co-operation on the Programme shall be executed for the Government of Japan by the Institute of Space and Astronautical Science, Ministry of Education (hereinafter referred to as "ISAS") and for the Government of Mauritania by the University of Nouakchott, Ministry of National Education (hereinafter referred to as "UON").


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２　計画に係る協力の詳細な条件を定めるため、宇宙研及びヌアクショット大学は、実施取決めを作成する。


							

						

						

							

								
2.	With a view to setting forth detailed terms and conditions for co-operation on the Programme, ISAS and UON will make implementing arrangements (hereinafter referred to as the "Implementing Arrangement").


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３　モーリタニア政府は、モーリタニアにおいて施行されている法令に従って、この取極及び実施取決めの下で行われる活動に必要な日本国政府の者及び物品の移動を認め、容易にする。


							

						

						

							

								
3.	The Government of Mauritania shall admit and facilitate, in accordance with the laws and regulations in force in Mauritania, the movement of persons and goods of the Government of Japan necessary for activities carried out under the present arrangements and the Implementing Arrangement.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　モーリタニア政府は、モーリタニアにおいて施行されている法令に従って、この取極及び実施取決めの下で行われる活動に必要な日本国政府の物品がモーリタニアに輸入され又はモーリタニアから輸出される場合には、当該物品に対する関税その他これに類似する課徴金を免除する。


							

						

						

							

								
4.	The Government of Mauritania shall accord, in accordance with the laws and regulations in force in Mauritania, entry into and exit from Mauritania free of customs duties and other similar charges to the goods of the Government of Japan necessary for activities carried out under the present arrangements and the Implementing Arrangement.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　宇宙研及びヌアクショット大学は、計画に係る協力から又はそれに関連して生ずるいかなる問題についても協議を行う。問題が当該協議を通じて解決できない場合には、両政府は、相互に受け入れることのできる解決を図るために外交上の経路を通じて協議を行う。


							

						

						

							

								
5.	ISAS and UON shall consult with each other regarding any matter that may arise from or in connection with the co-operation on the Programme.  If the matter cannot be resolved through the consultations, the two Governments shall discuss the matter through the diplomatic channel to find a mutually acceptable solution.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　この取極及び実施取決めは、それぞれの国において施行されている法令に従って実施される。この取極及び実施取決めの下で行われる活動は、利用可能な予算に従うことを条件とする。


							

						

						

							

								
6.	The provisions of the present arrangements and the Implementing Arrangement shall be implemented in accordance with the laws and regulations in force in each country.  Activities under the present arrangements and the Implementing Arrangement shall be subject to the availability of the appropriated funds.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　この取極は、一方の政府が他方の政府に対しこの取極を終了させる意思を六箇月前に外交上の経路を通じて書面で通告することにより終了させない限り、三年間効力を有する。この取極は、両政府間の相互の書面による合意により延長又は改正することができる。


							

						

						

							

								
7.	The present arrangements shall remain in force for three years, unless terminated by either Government upon six months' written notice of its intention to terminate them to the other Government through the diplomatic channel.  The present arrangements may be extended or amended by written agreement between the two Governments.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　本使は、前記の取極がモーリタニア政府にとって受諾し得るものであるときは、この書簡及び閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。


							

						

						

							

								
	I have further the honour to propose that, if the foregoing arrangements are acceptable to the Government of Mauritania, this Note and Your Excellency's Note in reply shall constitute an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.
