ワーキング・ホリデー査証に関する日本国政府と大韓民国政府との間の協定
日本国政府及び大韓民国政府は、
The Government of Japan and the Government of the Republic of Korea,
両国の間の一層緊密な協力関係を促進するとの精神の下に、
In a spirit of promoting closer co-operative relationship between the two countries, and
両国の間の相互理解を促進することを目的としてそれぞれの国民、特に青少年に対し、他方の国の文化及び一般的な生活様式を正当に評価するための一層広範な機会を提供することを希望して、
Desirous of providing wider opportunities for their nationals, particularly the youth, to appreciate the culture and general way of life of the other country for the purpose of promoting mutual understanding between the two countries,
次のとおり協定した。
Have agreed as follows:
第一条
Article 1
いずれの政府も、他方の国に居住する当該他方の国の国民に対し、当該国民が次の要件をすべて満たし、かつ、適当と認めるときは、発給の日から一年間有効なワーキング・ホリデー一次入国査証を無償で発給する。
Either Government will issue, free of charge, to the nationals of the other country residing in the other country single entry working holiday visas that are valid for one (1) year from the date of issuance when such nationals meet all of the following requirements and such Government deems appropriate:
(a) 主として休暇を過ごすために入国する意図を有すること。
(a) intend to enter the country primarily for the purpose of spending holidays;
(b) 査証申請時の年齢が十八歳以上二十五歳以下であること。（当該政府の権限のある当局が年齢の制限を三十歳まで延長することを決定する場合を除く。)
(b) are between eighteen (18) and twenty-five (25) years of age, both inclusive, at the time of application for the working holiday visas, except in those cases where the competent authorities of the Government decide to extend the limitation of age up to thirty (30) years;
(c) 子を同伴しないこと。
(c) are not accompanied by children;
(d) 有効な旅券及び帰国のための切符又はそのような切符を購入するための十分な資金を所持すること。
(d) possess valid passports and return travel tickets or sufficient funds with which to purchase such tickets;
(e) 他方の国における滞在の当初の期間に生計を維持するための相当な資金を所持すること。
(e) possess reasonable funds for their maintenance during the initial period of stay in the other country; and
(f) 健康であること。
(f) are in good health.
第二条
Article 2
いずれの国の国民も、当該国にある他方の国の大使館又は領事館においてワーキング・ホリデー査証の申請を行うことができる。
Nationals of either country may apply for the working holiday visas at the Embassy or consulates of the other country located in their country.
第三条
Article 3
いずれの政府も、有効なワーキング・ホリデー査証を所持する他方の国の国民に対し、入国の日から一年間の滞在を許可し、また、休暇の付随的な活動として旅行資金を補うための就労を認める。
Either Government shall permit the nationals of the other country who possess valid working holiday visas to stay in its country for one year from the date of entry and allow them to engage in employment as an incidental activity of their holidays for the purpose of supplementing their travel funds.
第四条
Article 4
ワーキング・ホリデー査証により他方の国に入国する一方の国の国民は、当該他方の国に滞在する間、当該他方の国において効力を有する法令に従う。
Nationals of either country who have entered the other country with the working holiday visas shall comply with the laws and regulations in force in the other country during their stay in such country.
第五条
Article 5
両政府は、それぞれの国の青少年団体、文化団体及び社会団体がワーキング・ホリデー査証を持って入国した他方の国の国民のために適切な相談の便宜を提供することを奨励するよう努める。
Both Governments shall endeavor to encourage youth, cultural and community organizations in their respective countries to provide appropriate counselling facilities for the nationals of the other country who have entered the other country with the working holiday visas.
第六条
Article 6
この協定の規定は、それぞれの国において施行されている法令に従って実施される。
The provisions of this Agreement shall be implemented in accordance with the laws and regulations in force in each country.
第七条
Article 7
１ この協定は、千九百九十九年四月一日に効力を生ずる。
1. This Agreement shall enter into force on the first day of April 1999.
２ いずれの一方の政府も、前記の規定の全部又は一部の実施を公の政策上の理由により一時的に停止することができる。このような停止は、外交上の経路を通じて他方の政府に直ちに通告される。
2. Either Government may suspend the implementation of the foregoing provisions, in whole or in part, temporarily for reasons of public policy. Any such suspension shall be notified immediately to the other Government through the diplomatic channel.
３ いずれの政府も、三箇月前までに他方の政府に書面によって通告することにより、この協定を終了させることができる。
3. Either Government may terminate this Agreement by giving three (3) months written notice to the other Government.
４ この協定の終了又はこの協定のいかなる規定の実施の停止の後においても、両政府により別段合意される場合を除くほか、その終了又は停止の日に有効なワーキング・ホリデー査証を既に所持する者は、当該査証が効力を失うまでの間、それに従って入国し又は滞在すること及び就労することが許可される。
4. Notwithstanding termination of this Agreement or suspension of the implementation of any provisions of this Agreement, unless otherwise agreed by both Governments, any person who at the date of such termination or suspension already holds a valid working holiday visa shall be permitted to enter and/or remain in such country and to work in accordance with such visa until it expires.
以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Agreement.
