  　書簡をもって啓上いたします。本使は、インドネシア共和国の経済の安定及び開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とインドネシア共和国政府の代表者との間で最近行われた討議に言及するとともに、両政府の間で到達した次の了解を確認する光栄を有します。

							

						

						

							

								
Excellency,

	I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Republic of Indonesia concerning Japanese loans to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Indonesia, and to confirm the following understanding reached between the two Governments:

  １　四百五十二億円（四五、二〇〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款Ⅰ」という。）が、インドネシア共和国政府のソーシャル・セーフティ・ネット計画を支援するため、海外経済協力基金（以下「基金」という。）により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。

							

						

						

							

								
1.	A loan in Japanese yen up to the amount of forty-five billion two hundred million yen (45,200,000,000) (hereinafter referred to as "the Loan I") will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") to support Social Safety Net programs of the Government of the Republic of Indonesia.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２　借款Ⅰは、インドネシア共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款Ⅰの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。

							

						

						

							

								
2.	The Loan I will be made available by a loan agreement to be concluded between the Government of the Republic of Indonesia and the Fund.  The terms and conditions of the Loan I as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (a)　償還期間は、十年の据置期間の後二十年とする。

  ３(1)　借款Ｉは、インドネシア共和国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う支払で、生産物（両政府の関係当局間で相互に合意する表に掲げる生産物を除く。）の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。

							

						

						

							

								
3.	(1)	The Loan I will be made available to cover payments already made and/or to be made to suppliers of eligible source countries by importers in the Republic of Indonesia under such contracts as have been or may be entered into between them for purchases of products, except such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.

  ４(1)　インドネシア共和国政府は、インドネシア共和国政府の名義でインドネシア銀行に開設される見返資金勘定に借款Ⅰの円貨による支出額に等しい額をインドネシア通貨で振り替えるようにするための措置をとる。このようにして振り替えられたインドネシア通貨は、インドネシア共和国政府のソーシャル・セーフティ・ネット計画下の保健、教育、雇用創出等の事業に使用されなければならない。

							

						

						

							

								
4.	(1)	The Government of the Republic of Indonesia will take measures to have the equivalent in Indonesian currency of the amount of yen disbursements of the Loan I transferred into the counterpart fund account opened in the name of the Government of the Republic of Indonesia at the Bank Indonesia.  The amount of Indonesian currency thus transferred shall be used for health, education and employment creation and other related projects under Social Safety Net programs of the Government of the Republic of Indonesia.

  １　三百五十二億八千万円（三五、二八〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款Ⅱ」という。）が、「保健・栄養セクター開発計画」（以下「計画」という。）を支援するため、基金により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。

							

						

						

							

								
1.	A loan in Japanese yen up to the amount of thirty-five billion two hundred and eighty million yen (35,280,000,000) (hereinafter referred to as "the Loan II") will be extended, in accordance with relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by the Fund to support the Health and Nutrition Sector Development Program (hereinafter referred to as "the Program").

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２　借款Ⅱは、インドネシア共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款Ⅱの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。

							

						

						

							

								
2.	The Loan II will be made available by a loan agreement to be concluded between the Government of the Republic of Indonesia and the Fund. 3. 4.	(1)	The Government of the Republic of Indonesia will take measures to have the equivalent in Indonesian currency of the amount of yen disbursements of the Loan II transferred into the counterpart fund account opened in the name of the Government of the Republic of Indonesia at the  Bank Indonesia. 2.   ３　インドネシア共和国政府は、Ⅰ３(1)及びⅡ３(1)にいう生産物又は役務が基金の調達のためのガイドライン（国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。）に従って調達されることを確保する。

							

						

						

							

								
3.	The Government of the Republic of Indonesia will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 of Part I and sub-paragraph (1) of paragraph 3 of Part II are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　インドネシア共和国政府は、借款Ⅰ及び借款Ⅱに基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。

							

						

						

							

								
4.	With regard to the shipping and marine insurance of products purchased under the Loan I and the Loan II, the Government of the Republic of Indonesia will refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　インドネシア共和国政府は、基金について、借款Ⅰ及び借款Ⅱ並びにそれらから生ずる利子に対して又はそれらに関連して課されるインドネシアの財政課徴金及び租税を免除する。

							

						

						

							

								
5.	The Government of the Republic of Indonesia will exempt the Fund from Indonesian fiscal levies and taxes on and/or in connection with the Loan I and the Loan II as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　インドネシア共和国政府は、借款Ⅰ及び借款Ⅱが適正にかつ専らⅠ３(1)及びⅡ３(1)のそれぞれにいう生産物又は役務を購入するために使用されること並びにⅠ４(1)及びⅡ４(1)にいう見返資金が適正にかつ専らⅠ４(1)にいう事業及びⅡ４(1)にいう開発事業に使用されることを確保するために必要な措置をとる。

							

						

						

							

								
6.	The Government of the Republic of Indonesia will take necessary measures to ensure that the Loan I and the Loan II be used properly and exclusively for the purchases of products and/or services mentioned respectively in sub-paragraph (1) of paragraph 3 of Part I and sub-paragraph (1) of paragraph 3 of Part II, and that the counterpart fund mentioned in sub-paragraph (1) of paragraph 4 of Part I and sub-paragraph (1) of paragraph 4 of Part II be used properly and exclusively for the projects mentioned in sub-paragraph (1) of paragraph 4 of Part I and the development projects mentioned in sub-paragraph (1) of paragraph 4 of Part II.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　両政府は、共同して借款Ⅰ及び借款Ⅱの実施の進捗状況を随時検討し、借款Ⅰ及び借款Ⅱの円滑かつ効果的な使用を確保するために必要な措置をとり、また、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

							

						

						

							

								
7.	The two Governments will jointly review from time to time the progress of the implementation of the Loan I and the Loan II and take necessary measures to secure smooth and effective utilization of the Loan I and the Loan II and otherwise consult with each other in respect of any matter that may arise from or in connection with this understanding.
