  　書簡をもって啓上いたします。本官は、ガーナ共和国の経済の安定及び開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とガーナ共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。


							

						

						

							

								
Excellency,

	I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Ghana concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Ghana:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １  五十九億九千百万円（五、九九一、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、経済改革支援計画（以下「計画」という。）を支援するため、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従って、ガーナ共和国政府に供与されることになる。


							

						

						

							

								
1.	A loan in Japanese yen up to the amount of five billion nine hundred and ninety-one million yen (5,991,000,000) (hereinafter referred to as "the Loan") will be extended to the Government of the Republic of Ghana by the Japan Bank for International Cooperation (hereinafter referred to as "the Bank") in accordance with the relevant laws and regulations of Japan to support the Economic Reform Support Operation (hereinafter referred to as "the Operation").


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２(1)　借款は、ガーナ共和国政府と銀行との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。


							

						

						

							

								
2.	(1)	The Loan will be made available by a loan agreement to be concluded between the Government of the Republic of Ghana and the Bank.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (a)　償還期間は、十年の据置期間の後二十年とする。


							

						

						

							

								
(a)	The repayment period will be twenty (20) years after the grace period of ten (10) years;


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　利子率は、年一・八パーセントとする。


							

						

						

							

								
(b)	The rate of interest will be one and eight-tenths per cent (1.8%) per annum; and


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (c)　支出期間は、前記の借款契約の発効の日から二年とする。


							

						

						

							

								
(c)	The disbursement period will be two (2) years from the date of coming into force of the said loan agreement.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。


							

						

						

							

								
	(2)	The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３(1)　借款は、ガーナ共和国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う支払で、計画の実施中に必要な生産物（両政府の関係当局間で合意される表に掲げる生産物を除く。）の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。


							

						

						

							

								
3.	(1)	The Loan will be made available to cover payments already made and/or to be made to suppliers of eligible source countries by importers in the Republic of Ghana under such contracts as have been or may be entered into between them for purchases of products required during the implementation of the Operation, except such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)にいう表には、両政府の関係当局間の合意によって修正を加えることができる。


							

						

						

							

								
	(2)	The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (3)　(1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。


							

						

						

							

								
	(3)	The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４(1)　ガーナ共和国政府は、ガーナ共和国政府の名義でガーナ銀行に開設される見返資金勘定に借款の円貨による支出額に等しい額をガーナ通貨で振り替えるようにするための措置をとる。このようにして振り替えられたガーナ通貨は、ガーナ共和国政府の経済社会開発事業計画のために使用されなければならない。


							

						

						

							

								
4.	(1)	The Government of the Republic of Ghana will take measures to have the equivalent in Ghanaian currency of the amount of yen disbursements of the Loan transferred into the counterpart fund account opened in the name of the Government of the Republic of Ghana in the Bank of Ghana.  The amount of Ghanaian currency thus transferred shall be used for economic and social development projects of the Government of the Republic of Ghana.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　ガーナ共和国政府は、要請に応じ、銀行に対し、(1)にいう見返資金の使用についての報告を提出する。


							

						

						

							

								
	(2)	The Government of the Republic of Ghana will, upon request, furnish the Bank with reports on the use of the counterpart fund mentioned in sub-paragraph (1) above.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　ガーナ共和国政府は、３(1)にいう生産物又は役務が銀行の調達のためのガイドライン（国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。）に従って調達されることを確保する。


							

						

						

							

								
5.	The Government of the Republic of Ghana will ensure that the products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Bank, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　ガーナ共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。


							

						

						

							

								
6.	With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of the Republic of Ghana will refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　ガーナ共和国政府は、銀行について、借款及びそれから生ずる利子に対して又はそれらに関連してガーナ共和国において課されるすべての財政課徴金及び租税を免除する。


							

						

						

							

								
7.	The Government of the Republic of Ghana will exempt the Bank from all fiscal levies and taxes imposed in the Republic of Ghana on and/or in connection with the Loan as well as interest accruing therefrom.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　ガーナ共和国政府は、借款が適正にかつ専ら３(1)にいう生産物又は役務を購入するために使用されることを確保するために必要な措置をとる。


							

						

						

							

								
8.	The Government of the Republic of Ghana will take necessary measures to ensure that the Loan be used properly and exclusively for purchases of the products and/or services mentioned in sub-paragraph (1) of paragraph 3.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ９　ガーナ共和国政府は、要請に応じ、日本国政府及び銀行に対し、計画の実施の進捗状況に関する情報及び資料を提供する。


							

						

						

							

								
9.	The Government of the Republic of Ghana will, upon request, furnish the Government of Japan and the Bank with information and data concerning the progress of the implementation of the Operation.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  10　両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
