外交又は公用の旅券の所持者に対する査証の相互免除に関する日本国政府と大韓民国政府との間の交換公文

Tokyo, October 8, 1998
書簡をもって啓上いたします。本大臣は、査証の要件の免除に関し、日本国政府の代表者と大韓民国政府の代表者との間で行われた最近の協議に言及する光栄を有します。本大臣は、更に、次の取極を日本国政府に代わって提案する光栄を有します。
Excellency, I have the honour to refer to the recent consultation held between the representatives of the Government of Japan and of the Government of the Republic of Korea concerning waiver of visa requirements. I have further the honour to propose on behalf of the Government of Japan the following arrangements:
1(1) 日本国の国民又は大韓民国の国民であって、自国の権限ある当局が発給した有効な外交又は公用旅券を所持し、それぞれの国の政府の外交若しくは領事の任務又はその他の公用の用務の目的で相手国に入国することを希望するものは、その滞在期間にかかわらず、査証を取得することなく相手国に入国することができる。
1.(1) Nationals of Japan or of the Republic of Korea holding valid diplomatic or official passports issued by the competent authorities of the country of which they are nationals and seeking entry into the other country for the purpose of exercising diplomatic or consular functions or other official duties of their Government may enter the other country without obtaining visas irrespective of the duration of stay in such other country.
(2) (1)に規定する国民の所帯に属する家族であって、当該国民と同じ国籍を有し、自国の権限ある当局が発給した有効な外交又は公用旅券を所持し及び相手国に入国することを希望するものは、その滞在期間にかかわらず、査証を取得することなく相手国に入国することができる。
(2) Family members forming part of the households of such nationals as described in sub-paragraph (1) who are nationals of the same country, holding valid diplomatic or official passports issued by the competent authorities of the country of which they are nationals and seeking entry into the other country may also enter such other country without obtaining visas irrespective of the duration of stay in such other country.
2 日本国の国民又は大韓民国の国民であって、自国の権限ある当局が発給した有効な外交又は公用旅券を所持し、1に規定する目的以外の目的で継続して九十日を超えない期間滞在する意図をもって相手国に入国することを希望するものは、査証を取得することなく相手国に入国することができる。
2. Nationals of Japan or of the Republic of Korea holding valid diplomatic or official passports issued by the competent authorities of the country of which they are nationals may enter the other country without obtaining visas, if they seek entry into such other country for the purpose other than those referred to in paragraph 1 and with the intention of staying in such other country for a period not exceeding ninety consecutive days.
3 1及び2の査証の要件の免除は、日本国の国民又は大韓民国の国民であって、就職し又は自由職業若しくは他の生業(報酬を得ることを目的とする芸能及びスポーツを含む。)に従事する意図をもって相手国に入国することを希望するものには適用しない。
3. The waiver of visa requirements under paragraph 1 and paragraph 2 shall not apply to nationals of Japan or of the Republic of Korea who are seeking entry into the other country with the intention of seeking employment or of exercising a profession or other occupation (including public entertainment and sport for remunerative purposes).
4 1及び2の査証の要件の免除は、相手国に入国する日本国の国民又は大韓民国の国民に対し、入国、滞在、居住、出国及びその他の外国人の管理に関する相手国の法令の適用を免除するものではない。
4. The waiver of visa requirements under paragraphs 1 and 2 above does not exempt the nationals of Japan or of the Republic of Korea entering the other country from the application of the laws and regulations of such other country concerning entry, stay, residence, exit and other control over aliens.
5 いずれの一方の政府も、公安、秩序及び衛生を含む公の政策上の理由により前記の諸措置の全部又は一部の適用を一時的に停止する権利を留保する。このような適用の停止又はその解除は、外交上の経路を通じて直ちに他方の政府に通告される。
5. Either Government reserves the right to temporarily suspend the application of all or any part of the foregoing measures for reasons of public policy including those relating to public security, order and health. Any suspension or the lifting of the suspension shall be notified immediately to the other Government through the diplomatic channel.
6 いずれの一方の政府も、好ましくないと認める相手国の国民に対し、自国の領域への入域又は滞在を拒否する権利を留保する。
6. Either Government reserves the right to refuse entry into or stay in its territory to the nationals of the other country whom it considers undesirable.
7 この取極は、それぞれの国において施行されている法令に従って実施される。
7. The present arrangements shall be implemented in accordance with the laws and regulations in force in each country.
8 いずれの一方の政府も、他方の政府に対し、三十日前に文書による予告を与えることにより、この取極を終了することができる。
8. Either Government may terminate the present arrangements by giving thirty days' written notice to the other Government.
本大臣は、さらに、この書簡及び前記の取極を大韓民国政府に代わって確認される閣下の返簡が両政府問の合意を構成し、その合意が閣下の返簡の日付の日の後六十日目の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming the foregoing arrangements on behalf of the Government of the Republic of Korea shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the sixtieth day after the date of Your Excellency's Note in reply.

Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

本長官は、更に、閣下の書簡に述べられた取極が大韓民国政府にとつて受諾し得るものであることを大韓民国政府に代わつて通報するとともに、閣下の書簡及びこの書簡が両政府間の合意を構成するものとみなし、その合意がこの書簡の日付の日の後六十日目の日に効力を生ずるものとすることを確認する光栄を有します。
I have further the honour to inform Your Excellency, on behalf of the Government of Republic of Korea, that the arrangements set forth in Your Excellency's Note are acceptable to the Government of the Republic of Korea and to confirm that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the sixtieth day after the date of this Note.
本長官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
