アフリカ難民等に対する食糧援助に関する日本国政府と世界食糧計画との間の交換公文

(Japanese Note)

　Rome, October 23, 1998

　書簡をもって啓上いたします。本使は、日本国政府(以下「政府」という。)の代表者と世界食糧計画(以下「計画」という。)の代表者との間で最近行われたソマリア、スーダン及びエティオピア難民、ソマリア民主共和国内被災民、リベリア難民及びリベリア共和国内被災民、ルワンダ及びブルンディ難民並びにギニア・ビサオ共和国内被災民に対する食糧援助計画に関する協議に言及するとともに、千九百九十五年の食糧援助規約に関連して政府が計画を通じて供与する意向を有する援助に関する次の取極を提案する光栄を有します。

　Madam,
  I have the honour to refer to the recent discussions held between the representatives of the Government of Japan (hereinafter referred to as "the Government") and of the World Food Programme (hereinafter referred to as "the Programme") in relation to the food aid programme for the Somali, Sudanese and Ethiopian refugees, the suffering people in the Somali Democratic Republic, the Liberian refugees and the suffering people in the Republic of Liberia, the Rwandese and Burundese refugees and the suffering people in the Republic of Guinea-Bissau, and have further the honour to propose the following arrangements concerning the assistance which the Government intends to extend through the Programme in connection with the Food Aid Convention, 1995:

1　政府は、日本国の関係法令に従い、二十九億円(二、九〇〇、〇〇〇、〇〇〇円)を贈与の形で計画の使用に供する。

1. The Government shall make available to the Programme, in accordance with the relevant laws and regulations of Japan, the amount of two billion nine hundred million yen (2,900,000,000) in the form of grant.

2　政府は、日本国の銀行の東京店に開設されている世界食糧計画の勘定に、1に定める額を日本円で払い込む。この額は、政府の関係当局と計画との間の合意によって延長されない限り、この取極が効力を生ずる日から千九百九十九年三月三十一日までの期間中に払い込まれる。

2. The Government shall make a payment of the amount referred to in paragraph 1 in Japanese yen to the World Food Programme Account opened in the Tokyo office of a bank of Japan. This amount shall be paid during the period between the date of coming into force of the present arrangements and March 31, 1999, unless the period is extended by mutual agreement between the authority concerned of the Government and the Programme.

3　政府は、2の規定に従って払込みを行うことにより、その払込みを行ったときにその払込みの金額までこの取極に基づく援助を実施したとみなされる。

3. By and upon making the payment under the preceding paragraph, the Government shall be deemed to have made the assistance under the present arrangements to the extent of the amount of such payment.

4(1)　1に定める総額は、ウガンダ共和国、タンザニア連合共和国、ルワンダ共和国、欧州連合の加盟国、カナダ、アメリカ合衆国、オーストラリア及び(又は)象牙海岸共和国において生産された豆、ケニア共和国、ウガンダ共和国、タンザニア連合共和国、南アフリカ共和国、アメリカ合衆国、欧州連合の加盟国、ルーマニア、ハンガリー共和国、ブルガリア共和国及び(又は)モザンビーク共和国において生産されたメイズ及び象牙海岸共和国、南アフリカ共和国及び(又は)欧州連合の加盟国において生産されたメイズミール、及び(又は)欧州連合の加盟国、ハンガリー共和国、トルコ共和国、オーストラリア、カナダ及び(又は)アメリカ合衆国において生産された小麦粉並びにこれらの購入に関連する費用(輸送費、保険料及び計画に対する手数料を含む。)に使用される。

4.(1) The total amount referred to in paragraph 1 above shall be used for the purchase of pulse produced in the Republic of Uganda, the United Republic of Tanzania, the Republic of Rwanda, the member States of the European Union, Canada, the United States of America, Australia and/or the Republic of Cote d'Ivoire, maize produced in the Republic of Kenya, the Republic of Uganda, the United Republic of Tanzania, the Republic of South Africa, the United States of America, the member States of the European Union, Romania, the Republic of Hungary, the Republic of Bulgaria and/or the Republic of Mozambique and maize meal produced in the Republic of Cote d'Ivoire, the Republic of South Africa and/or the member States of the European Union and/or wheat flour produced in the member States of the European Union, the Republic of Hungary, the Republic of Turkey, Australia, Canada and/or the United States of America and for the expenditures related to such purchases, including freight, insurance premium and the Programme's agency fees.

(2)　ウガンダ共和国、タンザニア連合共和国、ルワンダ共和国、欧州連合の加盟国、カナダ、アメリカ合衆国、オーストラリア及び(又は)象牙海岸共和国において生産された豆、ケニア共和国、ウガンダ共和国、タンザニア連合共和国、南アフリカ共和国、アメリカ合衆国、欧州連合の加盟国、ルーマニア、ハンガリー共和国、ブルガリア共和国及び(又は)モザンビーク共和国において生産されたメイズ及び象牙海岸共和国、南アフリカ共和国及び(又は)欧州連合の加盟国において生産されたメイズミール及び(又は)欧州連合の加盟国、ハンガリー共和国、トルコ共和国、オーストラリア、カナダ及び(又は)アメリカ合衆国において生産された小麦粉の現在の価格、輸送費及び保険料を考慮して、次のことが期待される。

(2) Taking into account the current price of pulse produced in the Republic of Uganda, the United Republic of Tanzania, the Republic of Rwanda, the member States of the European Union, Canada, the United States of America, Australia and/or the Republic of Cote d'Ivoire, maize produced in the Republic of Kenya, the Republic of Uganda, the United Republic of Tanzania, the Republic of South Africa, the United States of America, the member States of the European Union, Romania, the Republic of Hungary, the Republic of Bulgaria and/or the Republic of Mozambique and maize meal produced in the Republic of Cote d'Ivoire, the Republic of South Africa and/or the member States of the European Union and/or wheat flour produced in the member States of the European Union, the Republic of Hungary, the Republic of Turkey, Australia, Canada and/or the United States of America, freight and insurance premium, it is anticipated that:

(a)　最小限一億九千四百万円(一九四、〇〇〇、〇〇〇円)相当の欧州連合の加盟国、ハンガリー共和国、トルコ共和国及び(又は)オーストラリアにおいて生産された小麦粉、及び(又は)ケニア共和国、タンザニア連合共和国、ウガンダ共和国、モザンビーク共和国及び(又は)南アフリカ共和国において生産されたメイズが購入され、船積みされ、ケニア共和国内のソマリア、スーダン及びエティオピア難民に引き渡されること。

(a) a minimum of one hundred and ninety-four million yen (194,000,000) of wheat flour produced in the member States of the European Union, the Republic of Hungary, the Republic of Turkey and/or Australia and/or maize produced in the Republic of Kenya, the United Republic of Tanzania, the Republic of Uganda, the Republic of Mozambique and/or the Republic of South Africa will be purchased, shipped and delivered to the Somali, Sudanese and Ethiopian refugees in the Republic of Kenya;

(b)　最小限一億千百万円(一一一、〇〇〇、〇〇〇円)相当のケニア共和国、ウガンダ共和国、タンザニア連合共和国、南アフリカ共和国、アメリカ合衆国、欧州連合の加盟国、ルーマニア、ハンガリー共和国及び(又は)ブルガリア共和国において生産されたメイズが購入され、船積みされ、ソマリア民主共和国内被災民に引き渡されること。

(b) a minimum of one hundred and eleven million yen (111,000,000) of maize produced in the Republic of Kenya, the Republic of Uganda, the United Republic of Tanzania, the Republic of South Africa, the United States of America, the member States of the European Union, Romania, the Republic of Hungary and/or the Republic of Bulgaria will be purchased, shipped and delivered to the suffering people in the Somali Democratic Republic;

(c)　最小限二億九千六百万円(二九六、〇〇〇、〇〇〇円)相当の象牙海岸共和国、南アフリカ共和国及び(又は)欧州連合の加盟国において生産されたメイズミール、欧州連合の加盟国、ハンガリー共和国、トルコ共和国、カナダ、アメリカ合衆国及び(又は)オーストラリアにおいて生産された小麦粉、及び(又は)象牙海岸共和国、欧州連合の加盟国、カナダ、アメリカ合衆国及び(又は)オーストラリアで生産された豆が購入され、船積みされ、シエラ・レオーネ共和国、ギニア共和国、象牙海岸共和国及びガーナ共和国内のリベリア難民並びにリベリア共和国内被災民に引き渡されること。

(c) a minimum of two hundred and ninety-six million yen (296,000,000) of maize meal produced in the Republic of Cote d'Ivoire, the Republic of South Africa and/or the member States of the European Union, wheat flour produced in the member States of the European Union, the Republic of Hungary, the Republic of Turkey, Canada, the United States of America and/or Australia and/or pulse produced in the Republic of Cote d'Ivoire, the member States of the European Union, Canada, the United States of America and/or Australia will be purchased, shipped and delivered to the Liberian refugees in the Republic of Sierra Leone, the Republic of Guinea, the Republic of Cote d'Ivoire and the Republic of Ghana and the suffering people in the Republic of Liberia;

(d)　最小限三億千五百万円(三一五、〇〇〇、〇〇〇円)相当のウガンダ共和国、タンザニア連合共和国、ルワンダ共和国、欧州連合の加盟国、カナダ、アメリカ合衆国及び(又は)オーストラリアにおいて生産された豆が購入され、船積みされ、ルワンダ共和国、タンザニア連合共和国、ウガンダ共和国及びコンゴー民主共和国内のルワンダ及びブルンディ難民に引き渡されること。

(d) a minimum of three hundred and fifteen million yen (315,000,000) of pulse produced in the Republic of Uganda, the United Republic of Tanzania, the Republic of Rwanda, the member States of the European Union, Canada, the United States of America and/or Australia will be purchased, shipped and delivered to the Rwandese and Burundese refugees in the Republic of Rwanda, the United Republic of Tanzania, the Republic of Uganda and the Democratic Republic of the Congo; and

(e)　最小限一億二千三百万円(一二三、〇〇〇、〇〇〇円)相当の象牙海岸共和国、南アフリカ共和国及び(又は)欧州連合の加盟国において生産されたメイズミールが購入され、船積みされ、ギニア・ビサオ共和国内被災民に引き渡されること。

(e) a minimum of one hundred and twenty-three million yen (123,000,000) of maize meal produced in the Republic of Cote d'Ivoire, the Republic of South Africa and/or the member States of the European Union will be purchased, shipped and delivered to the suffering people in the Republic of Guinea-Bissau.

(3)　計画は、(2)にいう豆、メイズ及びメイズミール、及び(又は)小麦粉の購入並びに輸送及び保険のため、計画の財務規則に従い供給者と契約を締結する。

(3) The Programme shall enter into contracts with suppliers for the purchase of the pulse, the maize and the maize meal and/or the wheat flour referred to in sub-paragraph (2) and for the shipping and insurance in accordance with the Programme's financial rules.

5　計画は、4の規定に従って購入した豆、メイズ及びメイズミール、及び(又は)小麦粉をできる限り速やかにソマリア、スーダン及びエティオピア難民、ソマリア民主共和国内被災民、リベリア難民及びリベリア共和国内被災民、ルワンダ及びブルンディ難民並びにギニア・ビサオ共和国内被災民に引き渡すために必要なすべての措置をとる。

5. The Programme shall take all the necessary measures to deliver as soon as possible the pulse, the maize and the maize meal and/or the wheat flour purchased under the preceding paragraph to the Somali, Sudanese and Ethiopian refugees, the suffering people in the Somali Democratic Republic, the Liberian refugees and the suffering people in the Republic of Liberia, the Rwandese and Burundese refugees and the suffering people in the Republic of Guinea-Bissau.

6　政府及び計画は、いずれか一方の要請により、この取極から又はこれに関連して生ずるいかなる事項についても、相互に協議する。

6. The Government and the Programme shall consult with each other, at the request of either of them, on any matter that may arise from or in connection with the present arrangements.

7(1)　計画は、供給者と契約を締結した後、遅滞なく次の事項を政府に通報する。

7.(1) When the Programme has entered into contracts with suppliers, it shall inform the Government, without delay, of the following:

(a)　計画が契約に従って支払う総額

(a) Total amount of payments to be made by the Programme under the contract;

(b)　購入した豆、メイズ及びメイズミール、及び(又は)小麦粉の総額

(b) Total value of the pulse, the maize and the maize meal and/or the wheat flour purchased;

(c)　豆、メイズ及びメイズミール、及び(又は)小麦粉の数量及び品質

(c) Quantity and quality of the pulse, the maize and the maize meal and/or the wheat flour;

(d)　豆、メイズ及びメイズミール、及び(又は)小麦粉のFOB単価

(d) Unit F.O.B. price of the pulse, the maize and the maize meal and/or the wheat flour;

(e)　輸送費

(e) Freight;

(f)　保険料

(f) Insurance premium;

(g)　供給者の名称

(g) Names of the suppliers; and

(h)　船積みの予定日及び配布地への到着の予定日

(h) Expected dates of shipment to and arrival at distribution sites.

(2)　船積み、荷揚げ及び配布地への到着のたびに、計画は、これらの日付並びに豆、メイズ及びメイズミール、及び(又は)小麦粉の数量及び品質を政府に通報する。

(2) Each time a shipment is loaded aboard a ship or unloaded therefrom or arrives at the distribution sites, the Programme shall inform the Government of the date and the quantity and condition of the pulse, the maize and the maize meal and/or the wheat flour.

(3)　計画は、最初の積荷が配布地に到着した後、三箇月ごとに豆、メイズ及びメイズミール、及び(又は)小麦粉の配布に関する報告書を政府に提出するよう努める。

(3) After the arrival of the first shipment at the distribution sites, the Programme shall endeavour to submit to the Government a report on the distribution of the pulse, the maize and the maize meal and/or the wheat flour every three months.

(4)　計画は、この取極に従って購入した豆、メイズ及びメイズミール、及び(又は)小麦粉の配布が完了した後、配布に関する最終報告書を、できる限り配布地における写真を付して、政府に提出する。

(4) Upon the completion of the distribution of the pulse, the maize and the maize meal and/or the wheat flour purchased under the present arrangements, the Programme shall provide for the Government a final report on the distribution, if possible together with photographs taken at the distribution sites.

(5)　計画は、豆、メイズ及びメイズミール、及び(又は)小麦粉が日本国により贈与された旨の標示を豆、メイズ及びメイズミール、及び(又は)小麦粉の袋に付すことを確保する。

(5) The Programme shall ensure that markings the pulse bags, the maize bags and the maize meal bags and/or the wheat flour bags bear indicate the pulse, the maize and the maize meal and/or the wheat flour have been donated by Japan.

　本使は、更に、この書簡及び前記の取極を確認される貴官の返簡が政府と計画との間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　I have further the honour to propose that the present Note and your reply confirming the foregoing, arrangements shall be regarded as constituting an agreement between the Government and the Programme, which shall enter into force on the date of your reply.

  I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

　本官は、更に、世界食糧計画に代わって前記の取極を確認するとともに、閣下の書簡及びこの返簡が計画と日本国政府との間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。

　I have further the honour to confirm the foregoing arrangements on behalf of the World Food Programme, and to agree that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the Programme and the Government of Japan, which shall enter into force on the date of this reply.
