　書簡をもって啓上いたします。本使は、海外経済協力基金に対するザンビアの債務についての債務救済措置に関する千九百九十七年十二月十八日付けの日本国政府とザンビア共和国政府との間の交換公文に言及する光栄を有します。

　Honourable Minister,
  I have the honour to refer to the Exchange of Notes between the Government of Japan and the Government of the Republic of Zambia, dated December 18, 1997, concerning a debt relief measure with respect to Zambian debts owed to the Overseas Economic Cooperation Fund.

　本使は、更に、日本国政府の代表者とザンビア共和国政府の代表者との間で最近到達した次の了解を日本国政府に代わって確認する光栄を有します。

　I have further the honour to confirm, on behalf of the Government of Japan, the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Zambia.

1　前記の交換公文の2(1)(a)(ⅲ)を次のように改める。

1. (a)(iii) of sub-paragraph (1) of paragraph 2 of the said Exchange of Notes shall be deleted and replaced by the following:

(ⅲ)　千九百九十七年一月一日から千九百九十七年十二月三十一日までの間(両期日を含む。)に弁済期限の到来した未払の元本及び契約上の利子(それらの内訳は、この書簡の付表三に掲げられる。)。ただし、国際通貨基金(以下「IMF」という。)の理事会が、拡大構造調整措置(以下「ESAF」という。)に基づくザンビア共和国政府とIMFとの間の第二年次取極を千九百九十七年三月三十一日(以下「承認の期限I」という。)までに承認し、かつ、関係債権諸国が千九百九十六年二月二十八日にパリでザンビア共和国政府の代表者及び関係債権諸国政府の代表者によって署名された合意議事録(以下「合意議事録」という。)に定める条件をザンビア共和国政府が遵守したと認める場合に限る。

"(iii) The principal and contractual interest having fallen due between January 1, 1997 and December 31, 1997, both dates inclusive, and not paid, the breakdown of which is shown in the List 3 attached hereto, provided that the Executive Board of the International Monetary Fund (hereinafter referred to as "the IMF") has approved by March 31, 1997 (hereinafter referred to as "the date of approval I") a second annual arrangement between the Government of the Republic of Zambia and the IMF under the Enhanced Structural Adjustment Facility (hereinafter referred to as "the ESAF"), and that the creditor countries concerned determine that the Government of the Republic of Zambia has complied with the condition set out in the Agreed Minute signed by the representatives of the Government of the Republic of Zambia and of the Governments of the creditor countries concerned in Paris on February 28, 1996 (hereinafter referred to as "the Agreed Minute"); and"

2　前記の交換公文の2(1)(a)(ⅳ)を次のように改める。

2. (a)(iv) of sub-paragraph (1) of paragraph 2 of the said Exchange of Notes shall be deleted and replaced by the following:

(ⅳ)　千九百九十八年一月一日から千九百九十八年十二月三十一日までの間(両期日を含む。)に弁済期限の到来する未払の元本及び契約上の利子(それらの内訳は、この書簡の付表四に掲げられる。)。ただし、IMFの理事会が、ESAFに基づくザンビア共和国政府とIMFとの間の第三年次取極を千九百九十八年三月三十一日(以下「承認の期限Ⅱ」という。)までに承認し、かつ、合意議事録に定める条件をザンビア共和国政府が遵守したと認める場合に限る。

"(iv) The principal and contractual interest falling due between January 1, 1998 and December 31, 1998, both dates inclusive, and not paid, the breakdown of which is shown in the List 4 attached hereto, provided that the Executive Board of the IMF has approved by March 31, 1998 (hereinafter referred to as "the date of approval II") a third annual arrangement between the Government of the Republic of Zambia and the IMF under the ESAF, and that the creditor countries concerned determine that the Government of the Republic of Zambia has complied with the condition set out in the Agreed Minute."

3　前記の交換公文の2(1)(b)(ⅲ)を次のように改める。

3. (b)(iii) of sub-paragraph (1) of paragraph 2 of the said Exchange of Notes shall be deleted and replaced by the following:

(ⅲ)　千九百九十七年一月一日から千九百九十七年十二月三十一日までの間(両期日を含む。)に弁済期限の到来した未払の繰延利子(それらの内訳は、この書簡の付表七に掲げられる。)。ただし、(a)(ⅲ)に定める条件が満たされている場合に限る。

"(iii) The rescheduling interest having fallen due between January 1, 1997 and December 31, 1997, both dates inclusive, and not paid, the breakdown of which is shown in the List 7 attached hereto, provided that the conditions set out in (a)(iii) above are fulfilled; and"

4　前記の交換公文の2(1)(c)(ⅱ)を次のように改める。

4. (c)(ii) of sub-paragraph (1) of paragraph 2 of the said Exchange of Notes shall be deleted and replaced by the following:

(ⅱ)　千九百九十七年一月一日から千九百九十七年十二月三十一日までの間(両期日を含む。)に弁済期限の到来した未払の元本及び利子(それらの内訳は、この書簡の付表十に掲げられる。)。ただし、(a)(ⅲ)に定める条件が満たされている場合に限る。

"(ii) The principal and interest having fallen due between January 1, 1997 and December 31, 1997, both dates inclusive, and not paid, the breakdown of which is shown in the List 10 attached hereto, provided that the conditions set out in (a)(iii) above are fulfilled; and"

5　前記の交換公文の2(2)を次のように改める。

5. Sub-paragraph (2) of paragraph 2 of the said Exchange of Notes shall be deleted and replaced by the following:

　承認の期限I及び承認の期限Ⅱは、関係債権諸国政府の代表者が行う決定に従い日本国政府及びザンビア共和国政府の関係当局の同意を得て修正することができる。

"(2) The date of approval I and the date of approval II may be modified with the consent of the authorities concerned of the Government of Japan and of the Government of the Republic of Zambia in accordance with the decision to be made by the representatives of the Governments of the creditor countries concerned."

　本使は、閣下が前記の了解をザンビア共和国政府に代わって確認されれば幸いであります。

6　前記の交換公文の1(2)を次のように改める。

　承認の期限I及び承認の期限Ⅱは、関係債権諸国政府の代表者が行う決定に従い日本国政府及びザンビア共和国政府の関係当局の同意を得て修正することができる。

"(2) The date of approval I and the date of approval II may be modified with the consent of the authorities concerned of the Government of Japan and of the Government of the Republic of Zambia in accordance with the decision to be made by the representatives of the Governments of the creditor countries concerned."
