　Tokyo, February 6, 1998


　書簡をもって啓上いたします。本大臣は、千九百八十三年十一月八日付けの日本国とアメリカ合衆国との間の相互防衛援助協定に基づくアメリカ合衆国に対する武器技術の供与に関する交換公文の附属書(その修正を含む。)に言及するとともに、日本国政府の代表者とアメリカ合衆国政府の代表者との間で最近行われた前記附属書の修正に関する討議において到達した了解に基づき、同附属書を次のとおり改めることを日本国政府に代わって提案する光栄を有します。

　Excellency,
  I have the honor to refer to the ANNEX attached to the Exchange of Notes concerning the Transfer of Military Technologies to the United States of America under the Mutual Defense Assistance Agreement between Japan and the United States of America dated November 8, 1983, as amended, and, on the basis of the understanding reached between the representatives of the Government of Japan and the Government of the United States of America in their recent discussions concerning the amendment to the above-mentioned ANNEX, to propose, on behalf of the Government of Japan, that the ANNEX be amended as follows:


(1)　「武器技術」とは、(2)に定義する「武器」の設計、製造又は使用に専ら係る技術をいう。

(1) The term "military technologies" means such technologies exclusively concerned with the design, production and use of "arms" as defined in (2).


(2)(a)　(1)にいう「武器」とは、(b)に掲げる日本国の輸出貿易管理令別表第一の関連部分に掲げる物品のうち軍隊が使用するものであって、直接戦闘の用に供されるものをいう。「武器」製造関連設備は「武器」に準じて取り扱う。

(2)(a) The term "arms" as referred to above is the goods which are listed in the relevant part of Annexed List 1 of the Export Trade Control Order of Japan listed in (b), and are to be used by military forces and directly employed in combat. Equipment related to "arms" production will be treated in the same manner as "arms".

　本大臣は、更に、前記の提案がアメリカ合衆国政府により受諾される場合には、この書簡及びアメリカ合衆国政府に代わって受諾する旨の閣下の返簡が両政府間の合意を構成するものとみなすこと、並びにその合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。


							

						

						

							

								
　I have further the honor to propose that, if the above-mentioned proposal is acceptable to the Government of the United States of America, the present Note and Your Excellency's reply of acceptance on behalf of the Government of the United States of America shall be regarded as constituting an agreement between the two Governments which shall enter into force on the date of Your Excellency's reply.
