円借款の供与に関する日本国政府とスリ・ランカ民主社会主義共和国政府との間の交換公文

Colombo, August 27, 1998
書簡をもって啓上いたします。本使は、スリ・ランカ民主社会主義共和国の経済の安定と開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とスリ・ランカ民主社会主義共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Sir, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Democratic Socialist Republic of Sri Lanka concerning Japanese loans to be extended with a view to promoting the economic stabilization and development efforts of the Democratic Socialist Republic of Sri Lanka:

I
1(1) 二百三十三億七千二百万円(二三、三七二、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款I」という。)が、この書簡に附属する表(以下「付表」という。)に掲げる事業計画の実施のため、各事業計画につき付表に定める配分に応じ、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、スリ・ランカ民主社会主義共和国政府に供与されることになる。
1.(1) A loan in Japanese yen up to the amount of twenty-three billion three hundred and seventy-two million yen (23,372,000,000) (hereinafter referred to as "the Loan I") will be extended to the Government of the Democratic Socialist Republic of Sri Lanka by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan for the implementation of the projects enumerated in the List attached hereto (hereinafter referred to as "the List"), according to the allocation for each project as specified in the List.
(2) 借款Iは、借款Iの一部が付表の1及び2に掲げる事業計画のコンサルタントに対して行う支払のために使用される場合を除いて、千九百九十三年六月二十五日に日本国政府により公表された開発途上国への資金協力計画の2(2)に沿って供与されることになる。
(2) The Loan I will be extended in line with sub-paragraph (2) of paragraph 2 of the "Funds for Development" Initiative announced by the Government of Japan on June 25, 1993, except where a part of the Loan I is made available to cover payments to consultants of the projects mentioned in 1 and 2 of the List.
2(1) 借款Iは、スリ・ランカ民主社会主義共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款Iの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan I will be made available by loan agreements to be concluded between the Government of the Democratic Socialist Republic of Sri Lanka and the Fund. The terms and conditions of the Loan I as well as the procedures for its utilization will be governed by the said loan agreements which will contain, inter alia, the following principles:
(a)(ⅰ) 償還期間は、十年の据置期間の後二十年とする。
(a)(i) the repayment period will be twenty (20) years after the grace period of ten (10) years ;
(ⅱ) 利子率は、年一・八パーセントとする。
(ii) the rate of interest will be one and eight-tenths per cent (1.8%) per annum;
(b) ただし、(a)にもかかわらず、借款Iの一部が付表の1及び2に掲げる事業計画のコンサルタントに対して行う支払のために使用される場合には、当該部分については、次のとおりとする。
(b) notwithstanding sub-paragraph (a) above, where a part of the Loan I is made available to cover payments to consultants of the projects mentioned in 1 and 2 of the List, then:
(ⅰ) 償還期間は、十年の据置期間の後三十年とする。
(i) the repayment period of the said part will be thirty (30) years after the grace period of ten (10) years;
(ⅱ) 利子率は、年〇・七五パーセントとする。
(ii) the rate of interest of the said part will be seventy-five-hundredths per cent (0.75%) per annum; and
(c) 支出期間は、関係借款契約の発効の日から五年とする。
(c) the disbursement period will be five (5) years from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約の各々は、基金が当該借款契約に係る事業計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) Each of the loan agreements mentioned in sub-paragraph (1) above will be. concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the project to which such loan agreement relates.
3(1) 借款Iは、スリ・ランカの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して行う支払で、付表に掲げる事業計画の実施に必要な生産物又は役務の購入のために両者の間で締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3.(1) The Loan I will be made available to cover payments to be made by the Sri Lankan executing agencies to suppliers, contractors and/or consultants of eligible source countries under such contracts as may be entered into between them for purchases of products and/or services required for the implementation of the projects enumerated in the List, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) (1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(2) The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
(3) 借款Iの一部は、付表に掲げる事業計画の実施のための適格な現地通貨の需要に充てるために使用することができる。
(3) A part of the Loan I may be used to cover eligible local currency requirements for the implementation of the projects enumerated in the List.
4 スリ・ランカ民主社会主義共和国政府は、3(1)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うへき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
4. The Government of the Democratic Socialist Republic of Sri Lanka will ensure that the products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
5 3(1)にいう生産物又は役務の供給に関連してスリ・ランカ民主社会主義共和国においてその役務が必要とされる日本国民は、作業の遂行のためスリ・ランカ民主社会主義共和国への入国及び同国における滞在に必要な便宜を与えられる。
5. Japanese nationals whose services may be required in the Democratic Socialist Republic of Sri Lanka in connection with the supply of the products and/or services mentioned in sub-paragraph (1) of paragraph 3 shall be accorded such facilities as may be necessary for their entry into the Democratic Socialist Republic of Sri Lanka and stay therein for the performance of their work.
6 スリ・ランカ民主社会主義共和国政府は、借款Iに基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる直接又は間接の制限を課さない。
6. With regard to the shipping and marine insurance of the products purchased under the Loan I, the Government of the Democratic Socialist Republic of Sri Lanka will refrain from imposing, directly or indirectly, any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.
Ⅱ
II
1(1) 二十七億三千万円(二、七三〇、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款Ⅱ」という。)が、企業環境対策支援計画(以下「計画」という。)の実施のため、基金により、日本国の関係法令に従って、スリ・ランカ民主社会主義共和国政府に供与されることになる。
1.(1) A loan in Japanese yen up to the amount of two billion seven hundred and thirty million yen (2,730,000,000) (hereinafter referred to as "the Loan II") will be extended to the Government of the Democratic Socialist Republic of Sri Lanka by the Fund, in accordance with the relevant laws and regulations of Japan, for the implementation of the Environmentally Friendly Solutions Fund Program (hereinafter referred to as "the Program").
(2) 借款Ⅱは、千九百九十三年六月二十五日に日本国政府により公表された開発途上国への資金協力計画の2(2)に沿って供与されることになる。
(2) The Loan II will be extended in line with sub-paragraph (2) of paragraph 2 of the "Funds for Development" Initiative announced by the Government of Japan on June 25,1993.
2(1) 借款Ⅱは、スリ・ランカ民主社会主義共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款Ⅱの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan II will be made available by a loan agreement to be concluded between the Government of the Democratic Socialist Republic of Sri Lanka and the Fund. The terms and conditions of the Loan II as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後三十年とする。
(a) The repayment period will be thirty (30) years after the grace period of ten (10) years;
(b) 利子率は、年〇・七五パーセントとする。
(b) The rate of interest will be seventy-five-hundredths per cent (0.75%) per annum; and
(c) 支出期間は、前記の借款契約の発効の日から五年とする。
(c) The disbursement period will be five (5) years from the date of coming into force of the said loan agreement.
(2) (1)にいう借款契約は、基金が計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) The loan agreement mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the Program.
3 借款Ⅱは、計画に基づき国立開発銀行か借入人に対して行う融資に充てるために使用に供される。
3. The Loan II will be made available to cover credits to be extended by the National Development Bank to the sub-borrowers under the Program.
Ⅲ
III
1 I2(1)(c)は及びⅡ2(1)(c)にいうそれぞれの支出期間は、両政府の関係当局の同意を得て延長することができる。
1. The respective disbursement periods mentioned in sub-paragraph (1) (c) of paragraph 2 of part I and sub-paragraph(1) (c) of paragraph 2 of part II may be extended respectively with the consent of the authorities concerned of the two Governments.
2 スリ・ランカ民主社会主義共和国政府は、基金について、借款I及び借款Ⅱ並びにそれらから生ずる利子に対して又はそれらに関連してスリ・ランカ民主社会主義共和国において課されるすべての財政課徴金及び租税を免除する。
2. The Government of the Democratic Socialist Republic of Sri Lanka will exempt the Fund from all fiscal levies and taxes imposed in the Democratic Socialist Republic of Sri Lanka on and/or in connection with the Loan I and the Loan II as well as interest accruing therefrom.
3 スリ・ランカ民主社会主義共和国政府は、次のことを確保するために必要な措置をとる。
3. The Government of the Democratic Socialist Republic of Sri Lanka will take necessary measures to ensure that:
(a) 借款I及び借款Ⅱが適正にかつ専ら付表に掲げる事業計画及び計画のために使用されること。
(a) the Loan I and the Loan II be used properly and exclusively for the projects enumerated in the List and for the Program; and
(b) 借款Iに基づいて建設される施設がこの了解に定める目的のために適正にかつ効果的に維持され及び使用されること。
(b) the facilities constructed under the Loan I be maintained and used properly and effectively for the purposes prescribed in this understanding.
4 スリ・ランカ民主社会主義共和国政府は、要請に応じ、日本国政府及び基金に対し、付表に掲げる事業計画及び計画の実施の進捗状況に関する情報及び資料を提供する。
4. The Government of the Democratic Socialist Republic of Sri Lanka will, upon request, furnish the Government of Japan and the Fund with information and data concerning the progress of the implementation of the projects enumerated in the List and of the Program.
5 両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
5. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本使は、貴官が前記の了解をスリ・ランカ民主社会主義共和国政府に代わって確認されれば幸いであります。
I should be grateful if you would confirm the foregoing understanding on behalf of the Government of the Democratic Socialist Republic of Sri Lanka.
