(Japanese Note)

　Gaza, June 1, 1998

　書簡をもって啓上いたします。本使は、千九百九十五年九月二十八日にワシントンで署名された西岸及びガザ地域に関するイスラエルとパレスチナの暫定合意(以下「暫定合意」という。)、及びガザ地域小中学校建設計画(以下「計画」という。)の実施のための日本国の経済協力に関する日本国とパレスチナ解放機構(以下「PLO」という。)との間の千九百九十七年十月二十六日付けの交換公文に言及する光栄を有します。

　Excellency,
  I have the honour to refer to the Israeli-Palestinian Interim Agreement, on the West Bank and the Gaza Strip signed in Washington, on September 28, 1995 (hereinafter referred to as "the Interim Agreement") and to the Exchange of Notes dated October 26, 1997, between the Government of Japan and the Palestine Liberation Organization (hereinafter referred to as "the PLO") concerning Japanese economic cooperation for the execution of the Project for Construction of School Facilities for Basic Education in the Gaza Strip (hereinafter referred to as "the Project").

　本使は、更に、日本人とパレスチナ人との間の友好協力関係を一層強化することを目的として、計画に対し追加して行われる日本国の経済協力に関して、日本国政府の代表者と暫定合意に基づいて設立されたパレスチナ暫定自治政府のために暫定合意に従って行動するPLOの代表者との間で最近行われた討議に言及するとともに、前記の討議の結果、次の取極を日本国政府に代わって提案する光栄を有します。

　I have further the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the PLO, the latter acting for the benefit of the Palestinian Interim Self-Government Authority (Hereinafter referred to as "the Palestinian Authority") established in accordance with the Interim Agreement, pursuant to the Interim Agreement concerning additional Japanese economic cooperation to be extended with a view to further strengthening friendly and cooperative relations between the Japanese people and the Palestinians, and to propose, on behalf of the Government of Japan, the following arrangements as a result of the discussions above.

1　PLOは、パレスチナ暫定自治政府を通じてパレスチナ暫定自治政府行政機関がこの取極の規定に従うことを確保する。

1. The PLO shall ensure through the Palestinian Authority that the Executive Authority of the Palestinian Authority acts in compliance with the terms of the present arrangements.

2　日本国政府は、パレスチナ暫定自治政府行政機関が計画を実施することに寄与するため、日本国の関係法令に従い、パレスチナ暫定自治政府行政機関に対し、八億五千七百万円(八五七、〇〇〇、〇〇〇円)を限度とする額の贈与(以下「贈与」という。)を行う。

2. For the purpose of contributing to the execution of the Project by the Executive Authority of the Palestinian Authority, the Government of Japan will extend to the Executive Authority of the Palestinian Authority, in accordance with the relevant laws and regulations of Japan, a grant up to eight hundred and fifty-seven million yen (857,000,000) (hereinafter referred to as "the Grant").

3　贈与は、日本国政府とPLOの関係当局間の合意によって延長されない限り、この取極の効力発生の日から千九百九十九年三月三十一日までの期間に使用に供される。

3. The Grant will be made available during the period between the date of coming into force of the present arrangements and March 31, 1999, unless the period is extended by mutual agreement between the authorities concerned of the Government of Japan and the PLO.

4(1)　贈与は、パレスチナ暫定自治政府行政機関により、適正にかつ専ら次に掲げる日本国又は西岸及びガザ地域の生産物及び日本国民又はパレスチナ人の役務を購入するために使用される。(「日本国民」という語は、この取極の中で用いるときはいつでも、日本国の自然人又はその支配する日本国の法人を意味し、「パレスチナ人」という語は、この取極の中で用いるときはいつでも、西岸及びガザ地域におけるパレスチナの自然人又は法人を意味する。)

4.(1) The Grant will be used by the Executive Authority of the Palestinian Authority properly and exclusively for the purchase of the products of Japan or of the West Bank and the Gaza Strip, and the services of Japanese nationals or the Palestinians listed below: (The term "Japanese nationals" whenever used in the present arrangements means Japanese physical persons or Japanese juridical persons controlled by Japanese physical persons, and the term "the Palestinians" whenever used in the present arrangements means the Palestinian physical persons or juridical persons in the West Bank and the Gaza Strip.)

(a)　校舎及び関連施設(以下「施設」と総称する。)の建設のために必要な生産物及び役務

(a) products and services necessary for the construction of school buildings and their related facilities (hereinafter referred to as "the Facilities");

(b)　計画を実施するために必要な機材及びその調達のために必要な役務

(b) equipment necessary for the execution of the Project and services necessary for the procurement thereof; and

(c)　(a)及び(b)にいう生産物のイスラエルの港までの輸送及びその西岸及びガザ地域までの輸送のために必要な役務

(c) services necessary for the transportation of the products referred to in (a) and (b) above to the ports in Israel and those for transportation thereof to the West Bank and the Gaza Strip.

(2)　(1)の規定にかかわらず、贈与は、日本国政府及びパレスチナ暫定自治政府行政機関が必要と認める場合は、(1)(a)及び(b)にいう生産物で日本国又は西岸及びガザ地域のいずれの生産物でないもの並びに(1)(a)、(b)及び(c)にいう役務で、日本国民又はパレスチナ人のいずれの役務でないものの購入のために使用することができる。

(2) Notwithstanding the provisions of sub-paragraph (1) above, when the Government of Japan and the Executive Authority of the Palestinian Authority deem it necessary, the Grant may be used for the purchase of the products of the kind mentioned in (a) and (b) of sub-paragraph (1) above, which are neither the products of Japan nor the products of the West Bank and the Gaza Strip and the services of the kind mentioned in (a), (b) and (c) of sub-paragraph (1) above, which are services provided for neither by Japanese nationals nor by the Palestinians.

5　パレスチナ暫定自治政府行政機関又はその指定する当局は、4にいう役務を購入するため、日本国民と円貨建ての契約を締結する。この契約は、贈与の対象として適格であることが日本国政府により認証されなければならない。

5. The Executive Authority of the Palestinian Authority or its designated authority will enter into contracts in Japanese yen with Japanese nationals for the purchase of the products and services referred to in paragraph 4. Such contracts shall be verified by the Government of Japan to be eligible for the Grant.

6(1)　日本国政府は、5の規定に従って認証された契約(以下「認証された契約」という。)に基づいてパレスチナ暫定自治政府行政機関又はその指定する当局が負う債務の弁済に充てるための資金を、パレスチナ暫定自治政府行政機関又はその指定する当局によって指定される日本国の銀行(以下「銀行」という。)に開設されるパレスチナ暫定自治政府行政機関名義の勘定に日本円で払い込むことにより、贈与を実施する。

6.(1) The Government of Japan will execute the Grant by making payments in Japanese yen to cover the obligations incurred by the Executive Authority of the Palestinian Authority or its designated authority under the contracts verified in accordance with the provisions of paragraph 5 (hereinafter referred to as "the Verified Contracts") to an account to be opened in the name of the Executive Authority of the Palestinian Authority in a bank of Japan designated by the Executive Authority of the Palestinian Authority or its designated authority (hereinafter referred to as "the Bank").

(2)　(1)にいう払込みは、パレスチナ暫定自治政府行政機関又はその指定する当局が発行する支払授権書に基づいて銀行が支払請求書を日本国政府に提出した時に行われる。

(2) The payments referred to in sub-paragraph (1) above will be made when payment requests are presented by the Bank to the Government of Japan under an authorization to pay issued by the Executive Authority of the Palestinian Authority or its designated authority.

(3)　(1)にいう勘定の目的は、日本国政府が払い込む日本円を受領すること及び認証された契約の当事者たる日本国民に対する支払を行うことに限られる。勘定の貸記及び借記に関する手続細目は、銀行とパレスチナ暫定自治政府行政機関又はその指定する当局との間の協議により合意される。

(3) The sole purpose of the account referred to in sub-paragraph (1) above is to receive the payments in Japanese yen by the Government of Japan and to pay to the Japanese nationals who are parties to the Verified Contracts. The procedural details concerning the credit to and debit from the account will be agreed upon through consultation between the Bank and the Executive Authority of the Palestinian Authority or its designated authority.

7(1)　パレスチナ暫定自治政府行政機関は、次のことのために必要な措置をとる。

7.(1) The Executive Authority of the Palestinian Authority will take necessary measures:

(a)　施設の建設のために必要な土地を確保し、かつ、用地の整地を行うこと。

(a) to secure lots of land necessary for the construction of the Facilities and to clear the sites;

(b)　用地の外における配電、給水、排水その他の付随的な施設を提供すること。

(b) to provide facilities for distribution of electricity, water supply, drainage and other incidental facilities outside the sites;

(c)　贈与に基づいて購入される生産物の西岸及びガザ地域における通関及びそこにおける内陸輸送が速やかに行われることを確保すること。

(c) to ensure prompt customs clearance and transportation therein of the products purchased under the Grant in the West Bank and the Gaza Strip;

(d)　日本国民につき、認証された契約に基づく生産物及び役務の供与に関して、西岸及びガザ地域における関税、域内税その他の財政課徴金を賦課しないことを確保すること。

(d) to exempt Japanese nationals from customs duties, internal taxes and other fiscal levies which may be imposed in the West Bank and the Gaza Strip with respect to the supply of the products and services under the Verified Contracts;

(e)　認証された契約に基づく生産物及び役務の供与に関連してその役務を必要とされる日本国民に対し、その作業の遂行のための西岸及びガザ地域への入域及びそこにおける滞在に必要な便宜を与えること。

(e) to accord Japanese nationals whose services may be required in connection with the supply of the products and services under the Verified Contracts such facilities as may be necessary for their entry into the West Bank and the Gaza Strip and stay therein for the performance of their work;

(f)　贈与に基づいて建設される施設及び購入される生産物が計画の実施のために適正にかつ効果的に維持され及び使用されることを確保すること。

(f) to ensure that the Facilities constructed and the products purchased under the Grant be maintained and used properly and effectively for the execution of the Project; and

(g)　計画の実施のために必要なすへての経費(贈与によって負担されるものを除く。)を負担すること。

(g) to bear all the expenses, other than those covered by the Grant, necessary for the execution of the Project.

(2)　パレスチナ暫定自治政府行政機関は、贈与に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。

(2) With regard to the shipping and marine insurance of the products purchased under the Grant, the Executive Authority of the Palestinian Authority will refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

(3)　贈与に基づいて購入される生産物は、西岸及びガザ地域より再輸出されてはならない。

(3) The products purchased under the Grant shall not be re-exported from the West Bank and the Gaza Strip.

8　日本国政府及びパレスチナ暫定自治政府行政機関は、この取極から又はこれに関連して生ずるいかなる問題についても相互に協議する。

8. The Government of Japan and the Executive Authority of the Palestinian Authority will consult with each other in respect of any matter that may arise from or in connection with the present arrangements.

9　この取極の実施は、パレスチナ暫定自治政府行政機関が暫定合意に従って行使する権限及び遂行する責任の範囲内で、暫定合意に沿って行われるものとする。

9. The implementation of the present arrangements shall be accomplished consistent with the Interim Agreement to the full extent of the powers and responsibilities which the Executive Authority of the Palestinian Authority exercises pursuant to the Interim Agreement.

　本使は、更に、この書簡及びPLOに代わって前記の取極を確認される閣下の返簡が日本国政府とPLOとの間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。

　I have further the honour to propose that this Note and Your Excellency's Note in reply confirming, on behalf of the PLO, the foregoing arrangements shall be regarded as constituting an agreement between the Government of Japan and the PLO, Which will enter into force on the date of Your Excellency's reply.

　I have further the honour to confirm, on behalf of the PLO, the foregoing arrangements and agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the PLO and the Government of Japan, Which will enter into force on the date of this reply.
