航空業務に関する日本国とニュー・ジーランドとの間の協定の付表の修正に関する交換公文

(New Zealand Note)

　Wellington, May 22, 1998

　書簡をもって啓上いたします。本大臣は、千九百八十年一月十八日にオークランドで署名された航空業務に関するニュー・ジーランドと日本国との間の協定(以下「協定」という。)に関し、千九百九十八年一月二十八日及び二十九日にウェリントンにおいてニュー・ジーランド及び日本国の航空当局の間で行われた協議に言及する光栄を有します。

　Excellency,
  I have the honour to refer to the consultations held in Wellington on 28 and 29 January 1998 between the aeronautical authorities of New Zealand and Japan concerning the Agreement between New Zealand and Japan for Air Services signed at Auckland on 18 January 1980 (hereinafter referred to as the "Agreement").

　本大臣は、前記の協議において到達した了解及び協定第十六条3の規定に従い、協定の現行の付表が次のように代わるべき旨をニュー・ジーランド政府に代わつて提案する光栄を有します。

　Pursuant to the understanding reached at the said consultations and paragraph 3 of Article 16 of the Agreement, I now have the honour to propose, on behalf of the Government of New Zealand, that the existing Schedule to the Agreement be replaced by the following:

"Schedule

1　ニュー・ジーランドの一又は二以上の指定航空企業が両方向に運営する路線

1. Routes to be operated in both directions by the designated airline or airlines of New Zealand:

(1)　ニュー・ジーランド内の地点-ナンディ、香港並びに後に特定される東南アジア及び(又は)南太平洋(オーストラリアを含む。)内の他の二地点-東京及び(又は)名古屋及び(又は)大阪

(1) Points in New Zealand - Nadi, Hong Kong and two other points in Southeast Asia and/or in the South Pacific including Australia to be specified later - Tokyo and/or Nagoya and/or Osaka.

(2)　ニュー・ジーランド内の地点-名古屋及び(又は)福岡

(2) Points in New Zealand - Nagoya and/or Fukuoka.

注1　東南アジア内の地点は、別段の合意がない限り、マニラ、バンコック、クアラ・ランプール、シンガポール及びジャカルタに限られる。

Notes:1. Points in Southeast Asia shall be limited to Manila, Bangkok, Kuala Lumpur, Singapore and Jakarta unless otherwise agreed.

注2　ニュー・ジーランドの一又は二以上の指定航空企業は、前記の路線において名古屋及び福岡をコターミナル地点として使用することができる。

Notes:2. The designated airline or airlines of New Zealand shall be entitled to use Nagoya and Fukuoka on the above Routes as co-terminal points.

注3　ニュー・ジーランドの一又は二以上の指定航空企業は、前記の路線において自己が運送する途中降機の旅客について名古屋と福岡との間において運輸権を行使することを認められる。

Notes:3. The designated airline or airlines of New Zealand shall be allowed to exercise traffic rights with respect to its or their own stopover passengers between Nagoya and Fukuoka on the above Routes.

注4　東京又は名古屋に寄港する便で大阪に寄港することはできない。

Notes:4. Osaka may not be served on the same flight with either Tokyo or Nagoya.

2　日本国の一又は二以上の指定航空企業が両方向に運営する路線

2. Routes to be operated in both directions by the designated airline or airlines of Japan:

　日本国内の地点-ナンディ、シドニー、後に特定されるオーストラリア内の他の一地点並びに後に特定される東南アジア及び(又は)南太平洋内の他の二地点-オークランド及び(又は)クライストチャーチ及び(又は)後に特定されるニュー・ジーランド内の一地点

　Points in Japan - Nadi, Sydney, one other point in Australia to be specified later and two other points in Southeast Asia and/or in the South Pacific to be specified later - Auckland and/or Christchurch and/or a point in New Zealand to be specified later.

注1　東南アジア内の地点は、別段の合意がない限り、香港、マニラ、バンコック、クアラ・ランプール、シンガポール及びジャカルタに限られる。

Notes:1. Points in Southeast Asia shall be  limited to Hong Kong, Manila, Bangkok, Kuala Lumpur, Singapore and Jakarta unless otherwise agreed.

注2　日本国の一又は二以上の指定航空企業は、前記の路線においてニュー・ジーランド内のいずれの地点もコターミナル地点として使用することができる。

Notes:2. The designated airline or airlines of Japan shall be entitled to use any of the points in New Zealand on the above Routes as co-terminal points.

注3　日本国の一又は二以上の指定航空企業は、前記の路線において国際航空業務に係る途中降機の旅客についてニュー・ジーランド内の地点の間において運輸権を行使することを認められる。

Notes:3. The designated airline or airlines of Japan shall be allowed to exercise traffic rights with respect to stopover passengers for international air services between the points in New Zealand on the above Routes.

3　いずれの締約国の一又は二以上の指定航空企業が提供する協定業務も、当該締約国の領域内の一地点をその起点としなければならないが、当該路線上の他の地点は、いずれかの又はすべての飛行に当たり当該指定航空企業の選択によって省略することができる。

3. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of the Contracting Party, but other points on the route may at the option of the designated airline be omitted on any or all flights."

　本大臣は、更に、前記の提案が日本国政府にとって受諾し得るものであるときは、この書簡及び受諾を表明する閣下の返簡が両国政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　If the above proposal is acceptable to the Government of Japan, I have further the honour to propose that this Note together with Your Excellency's Note in reply indicating such acceptance shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency's reply.

　本大臣は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

　書簡をもって啓上いたします。本使は、本日付けの閣下の次の書簡に言及する光栄を有します。

　Excellency,
  I have the honour to refer to Your Excellency's Note of today's date, which reads as follows:

　本使は、更に、日本国政府がニュー・ジーランド政府の前記の提案を受諾する旨を日本国政府に代わつて閣下に通報するとともに、閣下の書簡及びこの返簡が両国政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずることを確認する光栄を有します。

　I have further the honour to inform Your Excellency, on behalf of the Government of Japan, that the Government of Japan accepts the above proposal of the Government of New Zealand and to confirm that Your Excellency's Note and this Note shall constitute an agreement between the two Governments, which shall enter into force on the date of this reply.

　本使は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。

　I avail myself of this opportunity to extend to Your Excellency the assurances of my highest consideration.
