航空業務に関する日本国政府とマレイシア政府との間の協定の付表の修正に関する交換公文

書簡をもって啓上いたします。本使は、千九百六十五年二月十一日にクアラ・ランプールで署名された航空業務に関する日本国政府とマレイシア政府との間の協定(以下「協定」という。)に関し千九百九十五年四月十日から十二日までの間東京において及び千九百九十七年三月十七日から十八日までの間クアラ・ランプールにおいて行われた協議に言及する光栄を有します。
Excellency, I have the honour to refer to the consultations held in Tokyo from 10 to 12 April 1995 and in Kuala Lumpur from 17 to 18 March 1997 concerning the Agreement between the Government of Japan and the Government of Malaysia for Air Services signed at Kuala Lumpur on 11 February 1965 (hereinafter referred to as "the Agreement").
本使は、更に、前記の協議において到達した合意及び協定第十二条(1)に従い、協定の現行付表が次のとおり修正されるべきことを日本国政府に代わって提案する光栄を有します。
Pursuant to the agreement reached at the said consultations and paragraph 1 of Article 12 of the Agreement, I now have further the honour to propose, on behalf of the Government of Japan, that the existing Schedule to the Agreement be replaced by the following:

I 日本国の一又は二以上の指定航空企業が両方向に運営する路線
I. Routes to be operated in both directions by the designated airline or airlines of Japan:
A 日本国内の地点－台北－香港－マニラ－ホーチミン・シティ－バンコック－シンガポール－クアラ・ランプール及び（又は）ペナン（注）－シンガポール－バンコック－ジャカルタ－東南アジア内の二地点－香港
A. Points in Japan - Taipei - Hong Kong - Manila - Ho Chi Minh City - Bangkok - Singapore - Kuala Lumpur and/or Penang (Note) - Singapore - Bangkok - Jakarta - Two points in South East Asia - Hong Kong.
B 日本国内の地点－クアラ・ランプール及び以遠の一地点
B. Points in Japan - Kuala Lumpur and one point beyond.
C 日本国内の地点－クアラ・ランプール及びペナン以外のマレイシア内の二地点
C. Points in Japan - Two points in Malaysia other than Kuala Lumpur and Penang.
注 日本国の一又は二以上の指定航空企業は、ペナン及びクアラ・ランプールをコターミナルとして、クアラ・ランプールの直前及び（又は）直後にペナンを経由する協定業務を行うことができる。
Note: The designated airline or airlines of Japan may operate the agreed services through Penang immediately before and/or after Kuala Lumpur, by using Penang and Kuala Lumpur as co-terminals.
Ⅱ マレイシアの一又は二以上の指定航空企業が両方向に運営する路線
II. Routes to be operated in both directions by the designated airline or airlines of Malaysia:
A マレイシア内の地点－バンコック－ホーチミン・シティ（注1）－香港－マニラ－台北－ソウル－東京－ソウル
A. Points in Malaysia - Bangkok - Ho Chi Minh City (Note 1) - Hong Kong - Manila - Taipei - Seoul - Tokyo - Seoul.
B マレイシア内の地点－東京－ホノルル（注1及び注2）－サン・フランシスコ又はロス・アンジェルス（注3）
B. Points in Malaysia - Tokyo - Honolulu (Notes 1 and 2) - San Francisco or Los Angeles (Note 3).
C マレイシア内の地点－福岡
C. Points in Malaysia - Fukuoka.
D マレイシア内の地点－名古屋
D. Points in Malaysia - Nagoya.
E マレイシア内の地点－大阪
E. Points in Malaysia - Osaka.
F マレイシア内の地点－後に特定する東京、福岡、名古屋及び大阪以外の日本国内の二地点（注4）
F. Points in Malaysia - Two points in Japan other than Tokyo, Fukuoka, Nagoya and Osaka, to be specified later (Note 4).
注1 マレイシアの一又は二以上の指定航空企業は、ホノルルへの運航を行う間、ホーチミン・シティヘは技術上の着陸のための地点としてのみ運航を行うことができる。
Note 1: For so long as the designated airline or airlines of Malaysia is or are operating into Honolulu, it or they may only operate into Ho Chi Minh City as a point for technical landing.
注2 マレイシアの一又は二以上の指定航空企業は、東京とホノルルとの間において第五の自由の運輸権を行使しない。
Note 2: The designated airline or airlines of Malaysia shall not exercise fifth freedom traffic rights between Tokyo and Honolulu.
注3 マレイシアの一又は二以上の指定航空企業は、いずれかの地点を選択することができるものとし、日本国の航空当局に対し九十日前に通告を行うことにより、業務を行っていない他の地点へその選択を変更することができる。
Note 3: The designated airline or airlines of Malaysia may select either point and, upon a 90 day notice to the aeronautical authorities of Japan, may change such selection to the point not being served.
注4 マレイシアの一又は二以上の指定航空企業は、これら二地点をコターミナルとして、これら二地点の内の一地点の直前及び（又は）直後に他方の地点を経由する協定業務を行うことができる。
Note 4: The designated airline or airlines of Malaysia may operate the agreed services through one of these two points immediately before and/or after the other point, by using these two points as co-terminals.
Ⅲ いずれか一方の締約国の一又は二以上の指定航空企業が行う協定業務は、その締約国の領域内の一地点を起点とするものでなければならない。ただし、特定路線上の他の地点は、いずれかの又はすべての飛行に当たって、その一又は二以上の指定航空企業の選択により省略することができる。
III. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the specified routes may, at the option of the designated airline or airlines concerned, be omitted on any or all flights.
本使は、更に、前記の提案がマレイシア政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡を両国政府間の合意を構成するものとし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
If the above proposal is acceptable to the Government of Malaysia, I have further the honour to propose that this Note together with Your Excellency's Note in reply indicating such acceptance shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency's reply.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

書簡をもって啓上いたします。本官は、本日付けの閣下の次の書簡に言及する光栄を有します。
Excellency, I have the honour to refer to Your Excellency's Note of today's date, which reads as follows:

本官は、更に、マレイシア政府が日本国政府の前記の提案を受諾する旨を閣下に通報するとともに閣下の書簡及びこの返簡が両国政府間の合意を構成するものとし、その合意がこの返簡の日付の日に効力を生ずることをマレイシア政府に代わって確認する光栄を有します。
I have further the honour to inform Your Excellency, on behalf of the Government of Malaysia, that the Government of Malaysia accepts the above proposal of the Government of Japan and to confirm that Your Excellency's Note and this reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this reply.
本官は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
