円借款の供与に関する日本国政府とインドネシア共和国政府との間の交換公文

Jakarta, December 24, 1998
書簡をもって啓上いたします。本使は、インドネシア共和国の経済の安定及び開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とインドネシア共和国政府の代表者との間で最近行われた討議に言及するとともに、両政府の間で到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Republic of Indonesia concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Indonesia, and to confirm the following understanding reached between the two Governments:
1 千億円 (一〇〇、〇〇〇、〇〇〇、〇〇〇円) の額までの円貨による借款(以下「借款」という。)が、この書簡に附属する付表(以下「付表」という。)に掲げるセクターの開発のため、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of one hundred billion yen (100,000,000,000) (hereinafter referred to as "the Loan") will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") for the development of the sectors enumerated in the List attached hereto (hereinafter referred to as "the List").
2(1) 借款は、インドネシア共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan will be made available by a loan agreement to be concluded between the Government of the Republic of Indonesia and the Fund. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement, which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years;
(b) 利子率は、年一・〇パーセントとする。
(b) The rate of interest will be one per cent (1.0%) per annum; and
(c) 支出期間は、前記の借款契約の発効の日から三年とする。
(c) The disbursement period will be three (3) years from the date of coming into force of the said loan agreement.
(2) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(2) The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 借款は、次の支払を対象として使用に供される。
3.(1) The Loan will be made available to cover the following payments:
(a) インドネシア共和国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う九百七十億円(九七、〇〇〇、〇〇〇、〇〇〇円)の額までの支払で、生産物(両政府の関係当局間で相互に合意する表に掲げる生産物を除く。)の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるもの。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。
(a) payments, up to the amount of ninety-seven billion yen (?97,000,000,000), already made and/or to be made to suppliers of eligible source countries by importers in the Republic of Indonesia under such contracts as have been or may be entered into between them for purchases of products, except such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries; and
(b) インドネシア共和国政府がコンサルタントに対して行う三十億円(三、〇〇〇、〇〇〇、〇〇〇円)の額までの支払で、借款及び4(1)にいう見返資金の使用が迅速に行われるようにすること及び当該使用を監視することを目的とする役務の購入のために両者の間で締結されることのある契約に基づいて行われるもの。
(b) payments, up to the amount of three billion yen (3,000,000,000), to be made to consultants by the Government of the Republic of Indonesia under such contracts as may be entered into between them for purchases of services aiming at expediting and monitoring the utilization of the Loan and the counterpart fund mentioned in sub-paragraph (1) of paragraph 4.
(2) (1)(a)にいう表には、両政府の関係当局間の合意によって修正を加えることができる。
(2) The list mentioned in sub-paragraph (1)(a) above may be modified by agreement between the authorities concerned of the two Governments.
(3) (1)(a)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(3) The scope of eligible source countries mentioned in sub-paragraph (1)(a) above will be agreed upon between the authorities concerned of the two Governments.
(4) (1)にいう借款の配分には、両政府の関係当局間の合意によって修正を加えることができる。
(4) The allocation of the Loan as mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.
4(1) インドネシア共和国政府は、インドネシア共和国政府の名義でインドネシア銀行に開設される見返資金特別勘定(以下「特別勘定」という。)に借款の円貨による支出額(3(1)(b)にいう支払に充てるために使用される額を除く。)に等しい額をインドネシア通貨で振り替えるようにするための措置をとる。1にいう各々のセクターについて、副勘定が特別勘定の中に設置される。
4.(1) The Government of the Republic of Indonesia will take measures to have the equivalent in Indonesian currency of the amount of yen disbursements of the Loan, excluding the amount which will be used to cover those payments mentioned in sub-paragraph (1)(b) of paragraph 3 above, transferred into the counterpart fund special account (hereinafter referred to as "the Special Account") opened in the name of the Government of the Republic of Indonesia at the Bank Indonesia. A sub-account will be set up in the Special Account for each sector mentioned in paragraph 1 respectively.
(2) このようにして振り替えられた見返資金は、インドネシア共和国政府により、付表に掲げる配分に従い円貨の額に等しい額までのインドネシア通貨により、当該セクターの各々の副勘定に配分される。インドネシア共和国政府は、日本国政府に対し、見返資金の配分の進捗状況を遅滞なく報告する。
(2) The counterpart fund thus transferred will be allocated by the Government of the Republic of Indonesia to each sub-account of the corresponding sector in Indonesian currency up to the amount equivalent to the amount of yen according to the allocation as mentioned in the List. The Government of the Republic of Indonesia shall duly inform the Government of Japan on the progress of the allocation of the counterpart fund.
(3) 配分された見返資金は、各々のセクターの現地通貨の需要に充てるために使用される。インドネシア共和国政府は、基金に対し、見返資金の使用についての通知を提出する。
(3) The allocated counterpart fund will be used to cover local currency requirements of the corresponding sectors. The Government of the Republic of Indonesia will submit to the Fund the notice of the counterpart fund financing.
(4) 付表に掲げる配分には、両政府の関係当局間の合意によって修正を加えることができる。
(4) The allocation as mentioned in the List may be modified by agreement between the authorities concerned of the two Governments.
5 インドネシア共和国政府は、3(1)にいう生産物及び役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
5. The Government of the Republic of Indonesia will ensure that the products and services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
6 インドネシア共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
6. With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of the Republic of Indonesia will refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.
7 インドネシア共和国政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連して課されるインドネシアの財政課徴金及び租税を免除する。
7. The Government of the Republic of Indonesia will exempt the Fund from Indonesian fiscal levies and taxes on and/or in connection with the Loan as well as interest accruing therefrom.
8 インドネシア共和国政府は、借款が適正にかつ専ら3(1)にいう生産物及び役務を購入するために使用されること並びに4(1)にいう見返資金が適正にかつ専ら付表に掲げる各々のセクターの開発のための現地通貨の需要に充てるために使用されることを確保するために必要な措置をとる。
8. The Government of the Republic of Indonesia will take necessary measures to ensure that the Loan be used properly and exclusively to purchase the products and services mentioned in sub-paragraph (1) of paragraph 3, and that the counterpart fund mentioned in sub-paragraph (1) of paragraph 4 be used properly and exclusively to cover local currency requirements for the development of the corresponding sectors enumerated in the List.
9 両政府は、共同して借款の実施の進捗状況を随時検討し、借款の円滑かつ効果的な使用を確保するために必要な措置をとり、また、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
9. The two Governments will jointly review from time to time the progress of the implementation of the Loan and take necessary measures to secure smooth and effective utilization of the Loan and otherwise consult with each other in respect of any matter that may arise from or in connection with this understanding.
本使は、閣下が前記の了解をインドネシア共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Indonesia.
