書簡をもって啓上いたします。本使は、インドネシア共和国が最近の干ばつ並びに金融上及び経済上の危機によって悪化したインドネシア共和国の食糧不足を緩和するための日本国政府所有米穀の貸付けに関して日本国政府の代表者とインドネシア共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Indonesia concerning a loan of Japanese Government's rice to relieve the shortage of food supply in the Republic of Indonesia, which has become serious with the recent drought and the financial and economic crisis.
1 日本国産うるち玄米正味十二万トン及び外国産のうるち玄米、うるち精米等玄米換算で正味八万トンの計正味二十万トンの量の米穀の貸付け(以下「貸付け」という。)が、社団法人国際農業交流・食糧支援基金(以下「基金」という。)により、日本国の関係法令に従って、インドネシア共和国食糧調達庁(以下「食糧調達庁」という。)に対し行われることになる。
1. A loan of a total of two hundred thousand (200,000) metric tons net of rice which consists of one hundred and twenty thousand (120,000) metric tons net of Japanese non-glutinous brown rice and eighty thousand (80,000) metric tons net of brown rice worth of imported non-glutinous brown rice, milled rice and others (hereinafter referred to as "the Loan") will be extended to the National Logistics Agency of the Republic of Indonesia (hereinafter referred to as "the Agency") by the Japan International Agricultural Council (hereinafter referred to as "the Council") in accordance with the relevant laws and regulations of Japan.
2 貸付けは、食糧調達庁と基金との間で締結される貸付契約(以下「契約」という。)に基づいて使用に供される。貸付けの条件及び使用に関する手続は、なかんずく次の原則を含むことになる契約によって規律される。
2. The Loan will be made available by a loan contract to be concluded between the Agency and the Council (hereinafter referred to as "the Contract"). The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the Contract, which will contain, inter alia, the following principles:
(a) 食糧調達庁は、インドネシア共和国産うるち玄米を二千九年から二千二十八年までの間において、各年正味一万トンずつ基金に返還する。
(a) The Agency will return to the Council each year during the period from 2009 to 2028 ten thousand (10,000) metric tons net of Indonesian non-glutinous brown rice;
(b) 食糧調達庁は、基金に対し、貸付料として、
(b) By way of charges, the Agency will:
(ⅰ) 千九百九十九年から二千八年までの間において、インドネシア共和国産うるち玄米を各年正味四千トンずつ引き渡し、かつ、
(i) supply to the Council four thousand (4,000) metric tons net of Indonesian non-glutinous brown rice each year during the period from 1999 to 2008; and
(ⅱ) 二千九年から二千二十八年までの間において、各年、その前年の十二月三十一日現在における借り入れた米穀の残量の三パーセントに相当するインドネシア共和国産うるち玄米を引き渡す。
(ii) supply to the Council each year during the period from 2009 to 2028 a quantity of Indonesian non-glutinous brown rice corresponding to three (3) per cent of the balance of the rice for return carried forward as of December 31 of the year prior the respective year; and
(c) 貸付けられる米穀の受渡しは、日本国の港における倉庫渡しとし、返還される米穀の受渡しは、基金が各年ごとに指定する日本国の港における運賃保険料込み渡しとする。
(c) Rice to be loaned will be transferred at warehouses at Japanese ports, while rice to be returned will be delivered on the basis of C.I.F. at the Japanese ports that will be designated by the Council each year.
3 両政府は、それぞれの国で施行されている法令の範囲内で、契約の円滑な及び適時の実施を容易にするものとし、このため必要な措置をとる。
3. The two Governments will, within the scope of the laws and regulations in force in their respective countries, facilitate smooth and timely implementation of the Contract and take necessary measures to this end.
4 インドネシア共和国政府は、貸し付けられた米穀が輸出されず、適正にかつ専らインドネシア共和国における国内民生用消費のために使用されることを確保する。
4. The Government of the Republic of Indonesia will ensure that the loaned rice will not be exported, and will be used properly and exclusively for domestic civil consumption in the Republic of Indonesia.
5 両政府は、生産及び商業的な国際貿易の通常の態様に有害な影響を及ぼすことを回避するという原則が、貸付けを規律すべきであることを認める。したがって、インドネシア共和国政府は、日本国政府と必要な協議を行いつつ、貸付けとの関連でこの原則を遵守するためのすべての妥当な措置をとる。
5. The two Governments recognize that the principle to avoid harmful interference with normal patterns of production and international commercial trade should govern the Loan. The Government of the Republic of Indonesia will, therefore, in due consultation with the Government of Japan, take all appropriate measures for the observance of the said principle in connection with the Loan.
6 日本国の国民及びインドネシア共和国の国民は、契約に基づく米穀の輸出及び輸入に関する業務のための相手国への入国及び相手国における滞在につき、当該相手国で施行されている法令の範囲内で必要な便宜を与えられる。
6. Nationals of Japan and of the Republic of Indonesia will be granted, within the scope of the laws and regulations in force in the other country, facilities necessary for entry into and stay in such other country for the purpose of activities related to the export and import of rice under the Contract.
7 インドネシア共和国政府は、日本国政府に対し、貸し付けられた米穀の配布計画、保管場所及び保管状況並びに実際の使途(その販売価格及び販売場所を含む。)について定期的に及び要請により報告する。
7. The Government of the Republic of Indonesia will, regularly and upon request, furnish the Government of Japan with reports on the distribution plans, the sites and conditions of the storage, and the actual use of the loaned rice including the prices and places of its sale.
8 両政府は、この了解から又はそれと関連して生ずることのあるいかなる問題についても、相互に協議する。
8. The two Governments will consult with each other on any problems that may arise out of this understanding or in connection therewith.
本使は、前記のことがインドネシア共和国政府の了解でもあることをインドネシア共和国政府に代わって閣下が確認されれば幸いであります。
I should be grateful if Your Excellency would confirm on behalf of the Government of the Republic of Indonesia that this is also the understanding of the Government of the Republic of Indonesia.
