円借款の供与に関する日本国政府とインドネシア共和国政府との間の交換公文

Jakarta, January 27, 1998
書簡をもって啓上いたします。本使は、インドネシア共和国の経済の安定及び開発努力を促進することを目的として供与される千九百九十七年の日本国の借款に関して日本国政府の代表者とインドネシア共和国政府の代表者との間で最近行われた討議に言及するとともに、両政府の間で到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Republic of Indonesia regarding a Japanese loan for 1997 to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Indonesia, and to confirm the following understanding reached between the two Governments:
1(1) 千九百五十二億四千八百万円(一九五、二四八、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款」という。)が、この書簡に附属する付表(以下「付表」という。)に掲げる事業計画を実施するため、各事業計画につき付表に定める配分に応じ、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。
1.(1) A loan in Japanese yen up to the amount of one hundred and ninety-five billion two hundred and forty-eight million yen (195,248,000,000) (hereinafter referred to as "the Loan") will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") to implement the projects enumerated in the List attached hereto (hereinafter referred to as "the List") according to the allocation for each project as specified in the List.
(2) 借款は、千九百九十三年六月二十五日に日本国政府により公表された開発途上国への資金協力計画の2(2)に沿って供与されることになる。
(2) The Loan will be extended in line with sub- paragraph (2) of paragraph 2 of the "Funds for Development" Initiative announced by the Government of Japan on June 25, 1993.
2(1) 借款は、インドネシア共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan will be made available by loan agreements to be concluded between the Government of the Republic of Indonesia and the Fund. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreements, which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years;
(b)(ⅰ) 利子率は、付表の1、3から11、15、16及び18に掲げる事業計画については、年二・七パーセントとし、付表の12から14に掲げる環境案件については、年二・五パーセントとし、付表の2、17及び19に掲げる事業計画については、年二・三パーセントとする。
(b)(i) The rate of interest will be two and seven- tenths per cent (2.7%) per annum with regard to the projects mentioned in 1, 3 to 11, 15, 16 and 18 of the List, two and five-tenths per cent (2.5%) per annum with regard to the environmental projects mentioned in 12 to 14 of the List, and two and three-tenths per cent (2.3%) per annum with regard to the projects mentioned in 2, 17 and 19 of the List;
(ⅱ) ただし、(ⅰ)にもかかわらず、借款の一部がコンサルタントに対して行う支払のために使用される場合には、当該部分に係る金利については、付表の1、3から11、15、16及び18に掲げる事業計画については、年二・三パーセントとし、付表の12から14に掲げる環境案件については、年二・一パーセントとする。
(ii) Notwithstanding sub-paragraph (b) (i) above, where a part of the Loan is made available to cover payments to consultants, then the rate of interest on the said part will be two and three-tenths per cent (2.3%) per annum with regard to the projects mentioned in 1, 3 to 11, 15, 16 and 18 of the List and two and one-tenth per cent (2.1%) per annum with regard to the environmental projects mentioned in 12 to 14 of the List; and
(c) 支出期間は、付表の18及び19に掲げる事業計画については、関係借款契約の発効の日から三年とし、付表の17に掲げる事業計画については、関係借款契約の発効の日から四年とし、付表の2、3及び9に掲げる事業計画については、関係借款契約の発効の日から五年とし、付表の16に掲げる事業計画については、関係借款契約の発効の日から六年とし、付表の1、4から6、8、12、14及び15に掲げる事業計画については、関係借款契約の発効の日から七年とし、付表の7及び10に掲げる事業計画については、関係借款契約の発効の日から八年とし、付表の11及び13に掲げる事業計画については、関係借款契約の発効の日から九年とする。
(c) The disbursement period will be three (3) years with regard to the projects mentioned in 18 and 19 of the List, four (4) years with regard to the project mentioned in 17 of the List, five (5) years with regard to the projects mentioned in 2, 3 and 9 of the List, six (6) years with regard to the project mentioned in 16 of the List, seven (7) years with regard to the projects mentioned in 1, 4 to 6, 8, 12, 14 and 15 of the List, eight (8) years with regard to the projects mentioned in 7 and 10 of the List, and nine (9) years with regard to the projects mentioned in 11 and 13 of the List from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約の各々は、基金が当該借款契約に係る事業計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) Each of the loan agreements mentioned in sub- paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the project to which such loan agreement relates.
(3) (1)(c)にいうそれぞれの支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The respective disbursement periods mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 借款は、インドネシアの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して行う支払で、付表に掲げる事業計画の実施に必要な生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3.(1) The Loan will be made available to cover payments to be made by Indonesian executing agencies to suppliers, contractors and/or consultants of eligible source countries under such contracts as have been or may be entered into between them for purchases of products and/or services required for the implementation of the projects enumerated in the List, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) (1)にいう調達適格国のそれぞれの範囲は、両政府の関係当局間で合意される。
(2) The respective scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
(3) 借款の一部は、付表に掲げる事業計画の実施のための適格な現地通貨の需要に充てるために使用することができる。
(3) A part of the Loan may be used to cover eligible local currency requirements for the implementation of the projects enumerated in the List.
4 インドネシア共和国政府は、3(1)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
4. The Government of the Republic of Indonesia will ensure that products and/or services mentioned in sub- paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
5 インドネシア共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
5. With regard to the shipping and marine insurance of products purchased under the Loan, the Government of the Republic of Indonesia will refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.
6(1) インドネシア共和国政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連して課されるインドネシアの財政課徴金及び租税を免除する。
6.(1) The Government of the Republic of Indonesia will exempt the Fund from Indonesian fiscal levies and taxes on and/or in connection with the Loan as well as interest accruing therefrom.
(2) インドネシア共和国政府は、供給者、請負業者又はコンサルタントとして活動する日本国の会社が借款に基づいて既に行ったか又は行うことのある生産物又は役務の供給から取得する所得に関するすへてのインドネシアの財政課徴金及び租税を負担する。
(2) The Government of the Republic of Indonesia shall assume all Indonesian fiscal levies and taxes with respect to the income of Japanese companies operating as suppliers, contractors and/or consultants accruing from the supply of products and/or services already provided and/or to be provided under the Loan.
(3) インドネシア共和国政府は、請負業者又はコンサルタントとして活動する日本国の会社が借款の対象として取り上げられる事業計画の実施のために必要な自己の資材及び設備の輸入及び再輸出に関するすへてのインドネシアの関税及び関連の財政課徴金を負担する。
(3) The Government of the Republic of Indonesia shall assume all Indonesian duties and related fiscal charges with respect to the import and re-export of own materials and equipment of Japanese companies operating as contractors and/or consultants needed for the implementation of the projects taken up for the Loan.
7 インドネシア共和国政府は、次のことを確保するために必要な措置をとる。
7. The Government of the Republic of Indonesia will take necessary measures to ensure that:
(a) 借款が適正にかつ専ら3(1)にいう生産物又は役務を購入するために使用されること。
(a) the Loan be used properly and exclusively for purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3; and
(b) 借款に基づいて建設される施設がこの了解に定める目的のために適正にかつ効果的に維持され及び使用されること。
(b) the facilities constructed under the Loan be maintained and used properly and effectively for the purposes prescribed in this understanding.
8 インドネシア共和国政府は、要請に応じ、日本国政府に対し、付表に掲げる事業計画の進捗状況についての報告を提出する。
8. The Government of the Republic of Indonesia will, upon request, furnish the Government of Japan with reports on the progress of the projects enumerated in the List.
9 両政府は、共同して借款の実施の進捗状況を随時検討し、借款の円滑かつ効果的な使用を確保するために必要な措置をとり、また、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
9. The two Governments will jointly review from time to time the progress of the implementation of the Loan and take necessary measures to secure smooth and effective utilization of the Loan and otherwise consult with each other in respect of any matter that may arise from or in connection with this understanding.
本使は、閣下が前記の了解をインドネシア共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Indonesia.
