繊維製品の輸出証明に関する日本国政府とアメリカ合衆国政府との間の取極の一部改正に関する交換公文

書簡をもって啓上いたします。本長官は、千九百八十七年二月六日付けの交換公文によって行われた繊維製品の輸出証明に関するアメリカ合衆国政府と日本国政府との間の取極(以下「取極」という。)に言及する光栄を有します。
Excellency, I have the honor to refer to the Vise Arrangement between the Government of the United States of America and the Government of Japan concerning Textiles and Textile Articles effected by the Exchange of Notes dated February 6,1987 (hereinafter referred to as "the Arrangement").
本長官は、更に、アメリカ合衆国による国際商品分類の統一システムの採用に伴う取極の改正に関し、アメリカ合衆国政府の代表者と日本国政府の代表者との間で行われた最近の討議に言及するとともに、取極を次のとおり改正することを、アメリカ合衆国政府に代わって提案する光栄を有します。
I have further the honor to refer to the recent discussions held between the representatives of the Government of the United States of America and the Government of Japan concerning the amendment of the Arrangement with the adoption of the Harmonized System by the United States and to propose, on behalf of the Government of the United States of America, that the Arrangement be amended as follows:
1 取極2Aを次のように改める。
1. Sub-paragraph A of paragraph 2 of the Arrangement shall be deleted and replaced by the following:
A 前記の繊維製品であって、合衆国商務省相互関連表(繊維及び衣料品の種目と合衆国国際統一関税分類上の相互関連表。その後同表に対して行われる技術的な修正を含む。)にいう第二百種目から第二百三十九種目まで、第三百種目から第三百六十九種目まで、第四百種目から第四百六十九種目まで、第六百種目から第六百七十種目まで及び第八百種目から第八百九十九種目までに該当し、かつ、この取極3AからDまで及び4の対象でないものを日本国から船積みする場合には、日本国政府が指定する機関の発行する輸出証明の取得が要請される。この輸出証明は、アメリカ合衆国の関税適用地域(五十州、コロンビア特別区及びプエルト・リコ)への輸入又は消費のための保税倉庫からの搬出の前に合衆国税関に提示されなければならない。
"A. Each shipment of textiles from Japan, as defined above, in categories 200-239, 300-369, 400-469, 600-670, and 800-899 which are specified in the United States Department of Commerce Correlation (Textile and Apparel Categories with Harmonized Tariff Schedule of the United States) and any subsequent technical modifications thereof, and not covered by paragraphs 3 A-D and 4 of this Arrangement, will be requested to be visaed by organizations designated to do so by the Government of Japan. This visa shall be presented to the U.S. Customs Service before entry, or withdrawal from warehouse for consumption, into the Customs Territory of the United States of America (the 50 States, the District of Columbia and Puerto Rico)."
2 取極2Bを次のように改める。
2. Sub-paragraph B of paragraph 2 of the Arrangement shall be deleted and replaced by the following:
B(1) 船積みの各々について、商業用送り状の原本の表に青色で円形の輸出証明の押印を受けなければならない。輸出証明の印は、商業用送り状の写しに押印されてはらない。貨物のアメリカ合衆国への輸入に当たっては、商業用送り状の原本に輸出証明の印が押印されていることが要求される。商業用送り状又は輸出証明の印の写しをこのために用いることはできない。
"B.(1) Each shipment shall be visaed by stamping the original circular visa in blue ink on the front of the original commercial invoice. The original visa shall not be stamped on duplicate copies of the invoice. The original of the invoice with the original visa stamp will be required to enter the shipment into the United States of America. Duplicates of the invoice and/or visa stamp may not be used for this purpose.
(2) 商業用送り状の原本が二以上のページから成る場合には、輸出証明の印は、最初又は最後のいずれかのページの表に押印されなければならない。
(2) If the original commercial invoice concerned consists of multiple pages, the visa shall be stamped on the front of either the first page or the last page thereof."
3 取極2c(2)の次に次のように加える。
3. The following will be inserted immediately after (2) of sub-paragraph C of paragraph 2 of the Arrangement.
(3) 合衆国商務省相互関連表と合衆国国際統一関税分類に規定されている貨物の正確な種目(適当な場合には、混合種目又はパート種目を指す。)、数量及び単位を輸出証明の印の所定の場所に記載しなければならない(例 第三百四十種目－十ダース)。また、数量は整数で表示されなければならず、小数又は分数での表示は認められない。混合種目枠が設定されている品目については、適当な混合種目を表示した輸出証明又は実際の貨物に対応する正確な種目を表示した輸出証明のいずれかを添付することができる。例えば、第六百四十五／六百四十六混合種目枠の場合、第六百四十五／六百四十六種目(又は第六百四十五／六種目)としてであっても、又は当該貨物が第六百四十五種目の品目のみから成る場合には「第六百四十五種目」(ただし、「第六百四十六種目」と表示してはならない。)としてであっても輸出証明を受けることができる。
"(3) The correct categories (if appropriate, merged categories and part categories), quantities, and units of quantity in the shipment provided for in the United States Department of Commerce Correlation and in the Harmonized Tariff Schedule of the United States shall be reported in the spaces provided within the visa stamp (for example, Cat. 340-10 dz). In addition, quantities must be stated in whole numbers. Decimals or fractions will not be accepted. Merged category quota merchandise may be accompanied by either the appropriate merged category visa or the correct category visa corresponding to the actual shipment. For example, quota category 645/646 may be visaed as 645/646 (or 645/6) or if the shipment consists solely of category 645 merchandise, the shipment may be visaed as 'Cat. 645', but not as 'Cot. 646'."
4 取極2Dを次のように改める。
4. Sub-paragraph D of paragraph 2 of the Arrangement shall be deleted and replaced by the following:
D 船積みに輸出証明が添付されていない場合又は輸出証明番号、日付、署名、種目番号若しくは数量が欠如、不正確若しくは判読困難である場合若しくはそれらが抹消若しくは改ざんされている場合は、輸出証明は受理されず、かつ、輸入は認められない。輸出証明に表示された数量が船積みの数量を下回る場合には、その輸入は認められない。輸出証明に表示された数量が船積みの数量を上回る場合には、その輸入は認められ、当該船積みの実際の数量のみが規制枠に算入される。
"D. The visa will not be accepted and entry will not be permitted if the shipment does not have a visa, or if the visa number, date, signature, category number, or quantity is missing, incorrect, or illegible, or has been crossed out or altered in any way. If the quantity indicated on the visa is less than that of the shipment, entry shall not be permitted. If the quantity indicated on the visa is more than that of the shipment, entry shall be permitted and only the actual amount of the shipment shall be charged."
5 取極5Eを次のように改める。
5. Sub-paragraph E of paragraph 5 of the Arrangement shall be deleted and replaced by the following:
正確な種目及び正確な数量に係る表示要件は、千九百八十九年八月一日以後日本国から合衆国に輸出される繊維製品について効力を有する。
"E. The correct category and correct quantity requirement shall be effective for textile products exported from Japan to the United States on or after August 1,1989."
本長官は、更に、前記の提案が日本国政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡が、アメリカ合衆国政府と日本国政府との間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honor to propose that if the foregoing proposal is acceptable to the Government of Japan, the present Note and Your Excellency's reply of acceptance shall be regarded as constituting an agreement between the Government of the United States of America and the Government of Japan, which shall enter into force on the date of Your Excellency's reply.
本長官は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

Excellency,I have the honor to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

本使は、更に、前記の提案が日本国政府にとって受諾し得るものであることを、日本国政府に代わって確認するとともに、閣下の書簡及びこの返簡が、両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honor to confirm on behalf of the Government of Japan that the foregoing proposal is acceptable to the Government of Japan and to agree that Your Excellency's Note and this Note of reply shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the date of this Note.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
