Kuala Lumpur, March 30, 1989
書簡をもって啓上いたします。本大臣は、千九百七十年一月三十日にクアラ・ランプールで署名された所得に対する租税に関する二重課税の回避及び脱税の防止のためのマレイシア政府と日本国政府との間の協定(以下「協定」という。)及び同日付けの協定第十八条5の規定に関する両政府間の交換公文(以下「交換公文」という。)に言及する光栄を有します。
Excellency, I have the honour to refer to the Agreement between the Government of Malaysia and the Government of Japan for the Avoidance of Double Taxation and the Prevention of Fiscal Evasion with respect to Taxes on Income signed at Kuala Lumpur on the 30th day of January 1970 (hereinafter referred to as "the Agreement") and to the Exchange of Notes of the same date between the two Governments concerning paragraph 5 of Article XVIII of the Agreement (hereinafter referred to as "the Exchange of Notes").
本大臣は、更に、千九百六十八年のマレイシアの投資奨励法(法律第十三号)(以下「投資奨励法」という。)に代わるものとして、千九百八十六年のマレイシアの投資促進法(法律第三百二十七号)(千九百八十六年のマレイシアの投資促進(改正)法(法律第A六百五十六号)による改正を含む。)(以下「投資促進法」という。)が施行されている事実にかんがみ、マレイシア政府に代わって次の取極を提案する光栄を有します。
In view of the fact that the Promotion of Investments Act 1986 (Act 327) of Malaysia (as amended by the Promotion of Investments (Amendment) Act 1986 (Act A656) (hereinafter referred to as "the Promotion of Investments Act") has been enforced and has replaced the Investment Incentives Act, No. 13 of 1968 of Malaysia (hereinafter referred to as "the Investment Incentives Act"). I have further the honour to propose on behalf of the Government of Malaysia the following arrangement:
1 投資促進法の次の各条項に定める措置は、協定第十八条5の規定において言及された「マレイシアの経済開発を促進するための特別の奨励措置」である。
1. The measures set forth in the following Sections of the Promotion of Investments Act are "the special incentive measures designed to promote economic development in Malaysia" referred to in paragraph 5 of Article XVIII of the Agreement:
(1) 第二十二条及び第二十三条－創始産業法人の所得に対する所得税の免除及びその免税所得から支払われる配当に対する所得税の免除
(i) Section 22 and 23 -- relating to exemption from income tax of the income of a pioneer company and the dividends attributable to that exempt income:
(2) 第二十九条－法人の投資に係る所得控除による所得税の免除及びその免除所得から支払われる配当に対する所得税の免除
(ii) Section 29 -- relating to exemption from income tax of income equivalent to the investment tax allowance of a company and dividends attributable to such exempt income:
(3) 第四十五条(投資奨励法の規定で同条において言及されるもののうち交換公文において言及された第二十一条、第二十二条及び第二十六条に基づく所得税の免除に関するものである場合に限る。)－投資奨励法の規定に従って認められた所得税の免除に関する経過規定
(iii) Section 45 (only to the extent that the provisions of the Investment Incentives Act referred to therein are relevant to exemption from income tax under Section 21, Section 22, and Section 26 referred to in the Exchange of Notes) -- relating to the transitional measures concerning exemption from income tax granted in accordance with the provisions of the Investment Incentives Act.
2 この取極は、投資促進法に基づいて免除された又は免除される所得税に関して適用する。
2. The present arrangement shall be effective in respect of such income tax as has been or may be exempted under the Promotion of Investments Act.
3 この取極は、両政府の合意により延長されない限り、千九百九十六賦課年度(千九百九十六賦課年度を含む。)まで引き続き効力を有する。この取極の延長のための提案は、千九百九十六年十二月三十一日より六箇月以前に行われなければならない。
3. The present arrangement shall continue to be in force until and including the year of assessment 1996 unless extended by agreement of the two Governments. A proposal for extension of the present arrangement shall be made not less than six months before the 31st day of December 1996.
4 交換公文に基づく取極は、この取極が効力を生ずる日に効力を失う。
4. The arrangement effected by the Exchange of Notes shall terminate on the date of entry into force of the present arrangement.
本大臣は、更に、この書簡及び日本国政府による前記の提案の受諾を確認する閣下の返簡が協定第十八条5の規定に基づく両政府間の合意を構成し、その合意は閣下の返簡の日に効力を生ずるものとみなすことを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming the acceptance by the Government of Japan of the above proposal shall be regarded as constituting an agreement between the two Governments under paragraph 5 of Article XVIII of the Agreement which will enter into force on the date of Your Excellency's reply.

I have further the honour to confirm on behalf of the Government of Japan the foregoing arrangement and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments. which will enter into force on the date of this reply.
