青年海外協力隊の派遣に関する日本国政府とヴィエトナム社会主義共和国政府との間の交換公文

書簡をもって啓上いたします。本使は、日本国とヴィエトナム社会主義共和国との間の技術協力を促進するため青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をヴィエトナム社会主義共和国に派遣することに関し、日本国政府の代表者とヴィエトナム社会主義共和国政府の代表者との間でハノイにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Socialist Republic of Viet Nam concerning the dispatch of volunteers to the Socialist Republic of Viet Nam under the Japan Overseas Cooperation Volunteers Programme (hereinafter referred to as "the Programme" ) with a view to promoting technical cooperation between the two countries, and to confirm on behalf of the Government of Japan the following understandings reached between them:
1 日本国政府は、ヴィエトナム社会主義共和国政府の要請に基づき、日本国の現行法令に従い、ヴィエトナム社会主義共和国の社会的及び経済的開発に寄与するため、両政府の関係当局間で別個に合意される計画に従い協力隊員をヴィエトナム社会主義共和国に派遣するために必要な措置をとる。
1. At the request of the Government of the Socialist Republic of Viet Nam, the Government of Japan will, in accordance with the laws and regulations in force in Japan, take necessary measures to dispatch the volunteers to the Socialist Republic of Viet Nam for the purpose of contributing to the social and economic development of the Socialist Republic of Viet Nam, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とヴィエトナム社会主義共和国との間の渡航費及びヴィエトナム社会主義共和国における生活手当を負担し、また、協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost of international travel between Japan and the Socialist Republic of Viet Nam and living allowances in the Socialist Republic of Viet Nam for the volunteers, and to make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their functions.
3 ヴィエトナム社会主義共和国政府は、協力隊員に対し、次の特権、免除及び便宜を与える。
3. The Government of the Socialist Republic of Viet Nam will grant the volunteers the following privileges, exemptions and benefits:
(1) 2にいう装備、機械、材料及び医薬品の輸入に関して、関税、租税その他の課徴金の免除
(1) Exemption from customs duties, taxes and charges of any kind in respect of the importation of the equipment, machinery, materials and medical supplies mentioned in paragraph 2 above.
(2) 私用に供される協力隊員の身回品及び家財の合理的な輸入に関して、関税、租税その他の課徴金(ただし、保管、運送及び類似の役務に関するものを除く。)の免除
(2) Exemption from customs duties, taxes and charges of any kind other than those for storage, cartage and similar services in respect of the importation of a reasonable amount of their personal and household effects for personal use only.
(3) 2にいう生活手当等協力隊員に対して海外から送付される手当に関して、所得税その他の課徴金の免除
(3) Exemption from income taxes and charges of any kind on any allowances to be remitted to them from overseas such as the living allowances mentioned in paragraph 2 above.
(4) 協力隊員のヴィエトナム社会主義共和国における任期中の疾病及び傷害に対する無料診療
(4) Free medical care in case of illness or injury suffered during the term of their assignment in the Socialist Republic of Viet Nam.
(5) 協力隊員がヴィエトナム社会主義共和国政府より与えられる任務を遂行する場所における無家賃の家具付住居施設(これらの施設は、協力隊員の受入機関が直接確保する。)
(5) Rent-free housing accommodations with basic furnishings at places where they are to perform their functions to be assigned to them by the Government of the Socialist Republic of Viet Nam, provided that such accommodations are directly secured by the institutions requesting and receiving a volunteer.
(6) 協力隊員の受入政府機関又は非政府機関が受入機関の場合は右を監督する政府機関による協力隊員の任務の遂行を容易にするための協力隊員に対する身分証明書の交付
(6) Issuance of identification cards from the volunteer-receiving governmental institution or from the governmental institution overseeing the volunteer-receiving non-governmental organization to the volunteers to facilitate the performance of their functions.
4(1) ヴィエトナム社会主義共和国政府は、ヴィエトナム社会主義共和国における計画の活動に関連して日本国政府による技術及び経済協力の実施機関である国際協力事業団が与える任務をヴィエトナム社会主義共和国政府関係当局と緊密に協力して遂行する駐在員一名及び調整員を受け入れる。
4. (1) The Government of the Socialist Republic of Viet Nam will accept a Representative and Co-ordinators who will discharge in close cooperation with Vietnamese authority concerned the functions to be assigned to them by the Japan International Cooperation Agency, the executing agency for technical cooperation by the Government of Japan, relative to the activities of the Programme in the Socialist Republic of Viet Nam.
(2) ヴィエトナム社会主義共和国政府は、駐在員及び調整員に対し、次の特権、免除及び便宜を与える。
(2) The Government of the Socialist Republic of Viet Nam will grant the Representative and the Co-ordinators the following privileges, exemptions and benefits:
(i) 駐在員及び調整員の任務の遂行に必要な装備、機械、材料及び医薬品の輸入に関して、関税、租税その他の課徴金の免除
(i) Exemption from customs duties, taxes and charges of any kind in respect of the importation of the equipment, machinery, materials and medical supplies, necessary for the performance of their functions.
(ii) 私用に供される駐在員及び調整員の身回品及び家財の合理的な輸入に関して、関税、租税その他の課徴金(ただし、保管、運送及び類似の役務に関するものを除く。)の免除
(ii) Exemption from customs duties, taxes and charges of any kind other than those for storage, cartage and similar services in respect of the importation of a reasonable amount of their personal and household effects for personal use only.
(iii) 駐在員及び調整員に対して海外から送付される報酬又は手当に関して、所得税その他の課徴金の免除
(iii) Exemption from income taxes and charges of any kind on any emoluments or allowances to be remitted to them from overseas.
(iv) 駐在員及び調整員各一名につき一台の自動車の無税輸入又はヴィエトナム社会主義共和国における保税倉庫からの購入許可。
(iv) Importation free of duties (or purchase from bond in the Socialist Republic of Viet Nam) of one motorcar for each of the Representative and the Co-ordinators.
5(1) 3(1)及び(2)並びに4(2)(i)、(ii)及び(iv)の規定に従って関税、租税その他の課徴金を課されることなく物品の輸入を行う協力隊員、駐在員及び調整員は、ヴィエトナム社会主義共和国政府の関係当局に対し、それらの物品の明細書を提出する。
5. (1) The volunteers, the Representative and the Co-ordinators importing goods free of customs duties, taxes and charges of any kind in accordance with the provisions of sub-paragraphs (1) and (2) of paragraph 3 and sub-paragraphs (2) (i), (ii) and (iv) of paragraph 4 will present specification of such goods to the authority concerned of the Government of the Socialist Republic of Viet Nam.
(2) 関税、租税その他の課徴金を課されることなく物品の輸入される耐久財は、一時的搬入の許可に関するヴィエトナム社会主義共和国の規則に従い、次の場合を除くほか、再輸出される。
(2) In compliance with the regulations of the Socialist Republic of Viet Nam concerning temporary admission, all durable goods imported free of customs duties, taxes and charges of any kind will be re-exported unless:
(a) それらの物品が、関税、租税その他の課徴金が支払われた上でヴィエトナム社会主義共和国の領域内で売却又はヴィエトナム社会主義共和国政府に対しその承認を得て贈与される場合
(a) they are sold within the territory of the Socialist Republic of Viet Nam with the payment of customs duties, taxes and charges of any kind, or donated to the Government of the Socialist Republic of Viet Nam on its approval; or
(b) 再輸出が不可能又は不適当である場合
(b) such re-exportation is impossible or inappropriate.
6 ヴィエトナム社会主義共和国政府は、ヴィエトナム社会主義共和国における協力隊員の公務の範囲内で生じた損害に関する責任を負う。ただし、それらの責任が協力隊員の重大な過失又は故意から生じた場合には、この限りでない。
6. The Government of the Socialist Republic of Viet Nam will bear responsibility for damage caused within the scope of their official duties in the Socialist Republic of Viet Nam, except when such responsibility arises from gross negligence or wilful misconduct on the part of the volunteers.
7 両政府は、ヴィエトナム社会主義共和国における計画の実施を成功させるため随時協議する。
7. The two Governments will hold consultations from time to time for the successful implementation of the Programme in the Socialist Republic of Viet Nam.
8 この了解は、両政府間の書簡の交換によって修正することができ、かつ、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によって通告することにより終了させることができる。
8. The understandings set out above may be amended by an exchange of notes between the two Governments and terminated by either Government by giving the other six months' prior written notice of its intention to terminate them.
本使は、更に、この書簡及び前記の了解をヴィエトナム社会主義共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Socialist Republic of Viet Nam the foregoing understandings shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

Excellency, I have the honour to acknowldge receipt of Your Excellency's Note of today's date, which reads as follows:

本大臣は、更に、前記の了解をヴィエトナム社会主義共和国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Socialist Republic of Viet Nam the foregoing understandings and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.
本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
