円借款の供与に関する日本国政府とスリ・ランカ民主社会主義共和国政府との間の交換公文

Colombo, June 23, 1994
書簡をもって啓上いたします。本使は、スリ･ランカ民主社会主義共和国の経済の開発のための努力に寄与することを目的として供与される日本国の借款に関して日本国政府の代表者とスリ･ランカ民主社会主義共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Sir, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Democratic Socialist Republic of Sri Lanka concerning a Japanese loan to be extended with a view to contributing to the efforts of the Democratic Socialist Republic of Sri Lanka for the economic development:
1(1) 三百六十四億千五百万円(三六、四一五、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款」という。)が、この書簡に附属する事業計画表(以下「事業計画表」という。)に掲げる計画の実施のため、各計画につき事業計画表に定める配分に応じ、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、スリ･ランカ民主社会主義共和国政府に供与されることになる。
1.(1) A loan in Japanese yen up to the amount of thirty-six billion four hundred and fifteen million yen (36,415,000,000) (hereinafter referred to as "the Loan") will be extended to the Government of the Democratic Socialist Republic of Sri Lanka by the overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan for the implementation of the projects enumerated in the Project List attached hereto (hereinafter referred to as "the Project List"), according to the allocation for each project as specified in the Project List.
(2) 借款は、千九百九十三年六月二十五日に日本国政府により公表された開発途上国への資金協力計画の2(2)に沿って供与されることになる。
(2) The Loan will be extended in line with sub-paragraph (2) of paragraph 2 of the "Funds for Development" Initiative announced by the Government of Japan on June 25, 1993.
2(1) 借款は、スリ･ランカ民主社会主義共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan will be made available by loan agreements to be concluded between the Government of the Democratic Socialist Republic of Sri Lanka and the Fund. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreements which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years;
(b) 利子率は、年二･六パーセントとする。
(b) The rate of interest will be two point six (2.6) per cent per annum; and
(c) 支出期間は、事業計画表の1に掲げる計画については、関係借款契約の発効の日から四年とし、事業計画表の2及び4に掲げる計画については、関係借款契約の発効の日から七年とし、事業計画表の3に掲げる計画については、関係借款契約の発効の日から三年とし、事業計画表の5及び6に掲げる計画については、関係借款契約の発効の日から六年とする。
(c) The disbursement period will be four (4) years with regard to the project mentioned in 1 of the Project List, seven (7) years with regard to the projects mentioned in 2 and 4 of the Project List, three (3) years with regard to the project mentioned in 3 of the Project List, and six (6) years with regard to the projects mentioned in 5 and 6 of the Project List from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約の各々は、基金が当該借款契約に係る計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) Each of the loan agreements mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the project to which such loan agreement relates.
(3) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The disbursement periods mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 借款は、スリ･ランカの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して行う支払で、事業計画表に掲げる計画の実施に必要な生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3.(1) The Loan will be made available to cover payments to be made by the Sri Lankan executing agencies to suppliers, contractors and/or consultants of eligible source countries under such contracts as have been or may be entered into between them for purchases of products and/or services required for the implementation of the projects enumerated in the Project List, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) (1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(2) The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
(3) 借款の一部は、事業計画表に掲げる計画の実施のための適格な現地通貨の需要に充てるために使用することができる。
(3) A part of the Loan may be used to cover eligible local currency requirements for the implementation of the projects enumerated in the Project List.
4 スリ･ランカ民主社会主義共和国政府は、3(1)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
4. The Government of the Democratic Socialist Republic of Sri Lanka will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
5 スリ･ランカ民主社会主義共和国政府は、要請に応じ、日本国政府及び基金に対し、事業計画表に掲げる計画の実施の進捗状況に関する情報及び資料を提出する。
5. The Government of the Democratic Socialist Republic of Sri Lanka will, upon request, furnish the Government of Japan and the Fund with information and data concerning the progress of the implementation of the projects enumerated in the Project List.
6 3(1)にいう生産物又は役務の供給に関連してスリ･ランカ民主社会主義共和国においてその役務が必要とされる日本国民は、作業の遂行のためスリ･ランカ民主社会主義共和国への入国及び同国における滞在に必要な便宜を与えられる。
6. Japanese nationals whose services may be required in the Democratic Socialist Republic of Sri Lanka in connection with the supply of products and/or services mentioned in sub-paragraph (1) of paragraph 3 shall be accorded such facilities as may be necessary for their entry into the Democratic Socialist Republic of Sri Lanka and stay therein for the performance of their work.
7 両政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、それぞれの国の関係法令の範囲内で、両国の海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる直接又は間接の制限を課すことも差し控える。
7. With regard to the shipping and marine insurance of products purchased under the Loan, the two Governments will refrain, within the scope of the relevant laws and regulations of their respective countries, from imposing, directly or indirectly, any restrictions that may hinder fair and free competition between the shipping and marine insurance companies of the two countries.
8 スリ･ランカ民主社会主義共和国政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連してスリ･ランカ民主社会主義共和国において課されるすべての財政課徴金又は租税を免除する。
8. The Government of the Democratic Socialist Republic of Sri Lanka will exempt the Fund from all fiscal levies or taxes imposed in the Democratic Socialist Republic of Sri Lanka on and/or in connection with the Loan as well as interest accruing therefrom.
9 スリ･ランカ民主社会主義共和国政府は、次のことを確保するために必要な措置をとる。
9. The Government of the Democratic Socialist Republic of Sri Lanka will take necessary measures to ensure that:
(a) 借款が適正にかつ専ら事業計画表に掲げる計画のために使用されること。
(a) the Loan be used properly and exclusively for the projects enumerated in the Project List; and
(b) 借款に基づいて建設される施設がこの了解に定める目的のために適正にかつ効果的に維持され及び使用されること。
(b) the facilities constructed under the Loan be maintained and used properly and effectively for the purposes prescribed in this understanding.
10 両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
10. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本使は、貴官が前記の了解をスリ･ランカ民主社会主義共和国政府に代わって確認されれば幸いであります。
I should be grateful if you would confirm the foregoing understanding on behalf of the Government of the Democratic Socialist Republic of Sri Lanka.
