ペルー石油公社等が負う債務についての債務救済措置に関する取極の修正に関する日本国政府とペルー共和国政府との間の交換公文

(Japanese Note)

　Lima, May 27, 1994

　書簡をもって啓上いたします。本使は、石油公団及び日本ペルー石油株式会社に対するペルーの債務についての債務救済措置に関する千九百九十三年四月二日付けの日本国政府とペルー共和国政府との間の交換公文に言及する光栄を有します。本使は、更に、日本国政府の代表者とペルー共和国政府の代表者との間で最近到達した次の了解を日本国政府に代わって確認する光栄を有します。

　Excellency,
I have the honour to refer to the Exchange of Notes between the Government of Japan and the Government of the Republic of Peru dated April 2, 1993, concerning a debt relief measure with respect to the Peruvian debts owed to Japan National Oil Corporation and Japan Peru Oil Co., Ltd. I have further the honour to confirm, on behalf of the Government of Japan, the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Peru:

1　前記の交換公文の2(1)中(a)から(c)までの部分以外の部分を次のように改める。

1. The introductory clause of sub-paragraph (1) of paragraph 2 of the said Exchange of Notes shall be deleted and replaced by the following:

　繰り延べられる債務(以下「繰延債務」という。)は、一方においてペルー共和国の政府企業であるペルー石油公社及びペルー開発金融公社と他方においてJNOC及びJAPECOとの間で千九百七十四年八月二十八日に締結された貸付け並びに原油及び石油製品の供給に関する契約(以下「契約」という。)に基づいて行われた資金供与から生じた債務の次の元本及び利子から成り、これらの元本及び利子は、ペルー共和国政府によって承継されることとなる。

　"The debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") consist of the following principal of and interest on the debts originating from the financing made under the Contracts concerning Loans and Crude Oil and Refined Products Supply concluded on August 28, 1974 (hereinafter referred to as "the Contracts") between Petroleos de Peru and Corporacion Financiera de Desarrollo S.A. which are governmental corporations of the Republic of Peru on the one hand and the JNOC and the JAPECO on the other, which are to be succeeded by the Government of the Republic of Peru:".

2　前記の交換公文の2(3)及び3を次のように改める。

2. Sub-paragraph (3) of paragraph 2 and paragraph 3 of the said Exchange of Notes shall be amended as follows:

　「債務者」を「ペルー共和国政府」に置き換える。

　The term "the Debtors" is deleted and replaced by the term "the Government of the Republic of Peru".

　本使は、閣下が前記の了解をペルー共和国政府に代わって確認されれば幸いであります。

　I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Peru.

　本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

　I avail myself of this opportunity to extend to Your Excellency the assurance of my highest consideration.
