円借款の供与に関する日本国政府とジョルダン・ハシェミット王国政府との間の交換公文

Amman, August 2, 1994
書簡をもって啓上いたします。本官は、ジョルダン･ハシェミット王国の経済の安定及び開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とジョルダン･ハシェミット王国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Hashemite Kingdom of Jordan concerning Japanese loans to be extended with a view to promoting the economic stabilization and the development efforts of the Hashemite Kingdom of Jordan:

I
1(1) 四十七億四千五百万円(四、七四五、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款I」という。)が、アカバ火力発電所増設事業計画(以下「事業計画」という。)の実施のため、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、ジョルダン･ハシェミット王国政府に供与されることになる。
1. (1) A loan in Japanese yen up to the amount of four billion seven hundred and forty-five million yen (4,745,000,000) (hereinafter referred to as "the Loan I") will be extended to the Government of the Hashemite Kingdom of Jordan by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan for the implementation of the Aqaba Thermal Power Station Stage II Project (hereinafter referred to as "the Project").
(2) 借款Iは、千九百九十三年六月二十五日に日本国政府により公表された開発途上国への資金協力計画の2(2)に沿って供与されることになる。
(2) The Loan I will be extended in line with sub-paragraph (2) of paragraph 2 of the "Funds for Development" Initiative announced by the Government of Japan on June 25, 1993.
2(1) 借款Iは、ジョルダン･ハシェミット王国政府と基金との間で締結される借款契約に基づいて使用に供される。借款Iの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. (1) The Loan I will be made available by a loan agreement to be concluded between the Government of the Hashemite Kingdom of Jordan and the Fund. The terms and conditions of the Loan I as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years;
(b) 利子率は、年三パーセントとする。
(b) The rate of interest will be three (3) per cent per annum; and
(c) 支出期間は、借款契約の発効の日から五年とする。
(c) The disbursement period will be five (5) years from the date of coming into force of the loan agreement.
(2) (1)にいう借款契約は、基金が事業計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) The loan agreement mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the Project.
3 借款Iは、ジョルダンの実施機関が調達適格国の供給者又は請負業者に対して行う支払で、事業計画の実施に必要な生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3. The loan I will be made available to cover payments to be made by Jordanian executing agency to suppliers and/or contractors of eligible source countries under such contracts as have been or may be entered into between them for purchases of products and/or services to be required for the implementation of the Project, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
4 3にいう生産物又は役務の供給に関連してジョルダン･ハシェミット王国においてその役務が必要とされる日本国民は、作業の遂行のためジョルダン･ハシェミット王国への入国及び同国における滞在に必要な便宜を与えられる。
4. Japanese nationals whose services may be required in the Hashemite Kingdom of Jordan in connection with the supply of products and/or services mentioned in paragraph 3 will be accorded such facilities as may be necessary for their entry into the Hashemite Kingdom of Jordan and stay therein for the performance of their work.
5 ジョルダン･ハシェミット王国政府は、次のものを免除する。
5. The Government of the Hashemite Kingdom of Jordan will exempt:
(a) 基金について、借款I及びそれから生ずる利子に対して又はそれらに関連してジョルダン･ハシェミット王国において課されるすべての財政課徴金又は租税
(a) The Fund from all fiscal levies or taxes imposed in the Hashemite Kingdom of Jordan on and/or in connection with the Loan I as well as interest accruing therefrom;
(b) 供給者又は請負業者として活動する日本国の会社について、借款Iに基づいて行われる生産物又は役務の供給から取得する所得に関してジョルダン･ハシェミット王国において課されるすべての財政課徴金又は租税
(b) Japanese companies operating as suppliers and/or contractors from all fiscal levies or taxes imposed in the Hashemite Kingdom of Jordan with respect to the income accruing from the supply of products and/or services to be provided under the loan I;
(c) 請負業者として活動する日本国の会社について、事業計画の実施に必要な自己の資材及び設備の輸入及び再輸出に関してジョルダン･ハシェミット王国において課されるすべての関税及び関連の財政課徴金
(c) Japanese companies operating as contractors from all duties and related fiscal charges imposed in the Hashemite Kingdom of Jordan with respect to the import and re-export of their own materials and equipment needed for the implementation of the Project; and
(d) 事業計画の実施に従事する日本国民である被用者について、供給者又は請負業者として活動する日本国の会社から取得する個人所得に対してジョルダン･ハシェミット王国において課されるすべての財政課徴金又は租税
(d) Japanese employees engaged in the implementation of the Project from all fiscal levies or taxes imposed in the Hashemite Kingdom of Jordan on their personal income derived from Japanese companies operating as suppliers and/or contractors.
6 ジョルダン･ハシェミット王国政府は、次のことを確保するために必要な措置をとる。
6. The Government of the Hashemite Kingdom of Jordan will take necessary measures to ensure that:
(a) 借款Iが適正にかつ専ら事業計画のために使用されること。
(a) The Loan I be used properly and exclusively for the Project; and
(b) 借款Iに基づいて建設される施設がこの了解に定める目的のために適正かつ効果的に維持され及び使用されること。
(b) The facilities constructed under the Loan I be maintained and used properly and effectively for the purpose prescribed in this understanding.

II
1(1) 八十三億九千三百万円(八、三九三、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款II」という。)が、エネルギー･セクター調整計画(以下「計画」という。)を支援するため、基金により、日本国の関係法令に従って、ジョルダン･ハシェミット王国政府に供与されることになる。
1. (1) A loan in Japanese yen up to the amount of eight billion three hundred and ninety-three million yen (8,393,000,000)(hereinafter referred to as "the Loan II") will be extended to the Government of the Hashemite Kingdom of Jordan by the Fund in accordance with the relevant laws and regulations of Japan to support the Energy Sector Adjustment Program (hereinafter referred to as "the Program").
(2) 借款IIは、千九百九十三年六月二十五日に日本国政府により公表された開発途上国への資金協力計画の2(2)に沿って供与されることになる。
(2) The Loan II will be extended in line with sub-paragraph (2) of paragraph 2 of the "Funds for Development" Initiative announced by the Government of Japan on June 25, 1993.
2 借款IIは、ジョルダン･ハシェミット王国政府と基金との間で締結される借款契約に基づいて使用に供される。借款IIの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. The Loan II will be made available by a loan agreement to be concluded between the Government of the Hashemite Kingdom of Jordan and the Fund. The terms and conditions of the Loan II as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years;
(b) 利子率は、年三パーセントとする。
(b) The rate of interest will be three (3) per cent per annum; and
(c) 支出期間は、借款契約の発効の日から二年とする。
(c) The disbursement period will be two (2) years from the date of coming into force of the loan agreement.
3 借款IIは、ジョルダン･ハシェミット王国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う支払で、計画の実施中に必要な生産物(両政府の関係当局間で合意される表に掲げる生産物を除く。)の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3. The Loan II will be made available to cover payments already made and/or to be made to suppliers of eligible source countries by importers in the Hashemite Kingdom of Jordan under such contracts as have been or may be entered into between them for purchases of products required during the implementation of the Program, except such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.
4(1) ジョルダン･ハシェミット王国政府は、ジョルダン･ハシェミット王国政府の名義でジョルダン中央銀行に開設される見返資金勘定に同銀行が借款IIの円貨による支出額に等しい額をジョルダン通貨で振り替えるようにするための措置をとる。このようにして振り替えられたジョルダン通貨は、ジョルダン･ハシェミット王国政府の経済社会開発事業計画のために使用されなければならない。
4. (1) The Government of the Hashemite Kingdom of Jordan will take measures to have the equivalent in Jordanian currency of the amount of yen disbursements of the Loan II transferred by the Central Bank of Jordan to the counterpart fund account opened in the name of the Government of the Hashemite Kingdom of Jordan in the Central Bank of Jordan. The amount of Jordanian currency thus transferred shall be used for the economic and social development projects of the Government of the Hashemite Kingdom of Jordan.
(2) ジョルダン･ハシェミット王国政府は、要請に応じ、日本国政府に対し、(1)にいう見返資金の使用についての報告を提出する。
(2) The Government of the Hashemite Kingdom of Jordan will, upon request, furnish the Government of Japan with reports on the use of the counterpart fund mentioned in sub-paragraph (1) above.
5 ジョルダン･ハシェミット王国政府は、基金について、借款II及びそれから生ずる利子に対して又はそれらに関連してジョルダン･ハシェミット王国において課されるすべての財政課徴金又は租税を免除する。
5. The Government of the Hashemite Kingdom of Jordan will exempt the Fund from all fiscal levies or taxes imposed in the Hashemite Kingdom of Jordan on and/or in connection with the Loan II as well as interest accruing therefrom.
6 ジョルダン･ハシェミット王国政府は、借款IIが適正にかつ専ら3にいう生産物又は役務を購入するために使用されることを確保するために必要な措置をとる。
6. The Government of the Hashemite Kingdom of Jordan will take necessary measures to ensure that the Loan II be used properly and exclusively for purchases of products and/or services mentioned in paragraph 3.

III
1 I2(1)(c)及びII2(c)にいうそれぞれの支出期間は、両政府の関係当局の同意を得て延長することができる。
1. The respective disbursement periods mentioned in sub-paragraph (1) (c) of paragraph 2 of part I and sub-paragraph (c) of paragraph 2 of part II may be extended with the consent of the authorities concerned of the two Governments.
2 I3及びII3にいう調達適格国のそれぞれの範囲は、両政府の関係当局間で合意される。
2. The respective scopes of eligible source countries mentioned in paragraph 3 of part I and paragraph 3 of part II will be agreed upon between the authorities concerned of the two Governments.
3 ジョルダン･ハシェミット王国政府は、I3及びII3にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
3. The Government of the Hashemite Kingdom of Jordan will ensure that products and/or services mentioned in paragraph 3 of part I and paragraph 3 of part II are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
4 ジョルダン･ハシェミット王国政府は、借款I及び借款IIに基づいて購入される生産物の海上輸送及び海上保険に関し、両国の海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
4. With regard to the shipping and marine insurance of products purchased under the Loan I and the Loan II, the Government of the Hashemite Kingdom of Jordan will refrain from imposing any restrictions that may hinder fair and free competition between the shipping and marine insurance companies of the two countries.
5 ジョルダン･ハシェミット王国政府は、要請に応じ、日本国政府及び基金に対し、事業計画及び計画の実施の進捗状況に関する情報及び資料を提供する。
5. The Government of the Hashemite Kingdom of Jordan will, upon request, furnish the Government of Japan and the Fund with information and data concerning the progress of the implementation of the Project and the Program.
6 両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
6. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本官は、閣下が前記の了解をジョルダン･ハシュミット王国政府に代わって確認されれば幸いであります。
I should be grateful if your Excellency would confirm the foregoing understanding on behalf of the Government of the Hashemite Kingdom of Jordan.
