円借款の供与に関する日本国政府とインド政府との間の交換公文

New Delhi, December 21, 1994
書簡をもって啓上いたします。本使は、インド政府の経済開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とインド政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of India concerning Japanese loans to be extended with a view to promoting the economic development efforts of the Government of India:

1(1) 千二百二十七億六千五百万円(一二二、七六五、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款I」という。)が、この書簡に附属する表(以下「付表」という。)に掲げる事業計画の実施のため、各事業計画につき付表に定める配分に応じ、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、インド政府に供与されることになる。
1. (1) A loan in Japanese yen up to the amount of one hundred twenty-two billion seven hundred and sixty-five million yen (122,765,000,000) (hereinafter referred to as "the Loan I") will be extended to the Government of India by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund"), in accordance with the relevant laws and regulations of Japan, for the implementation of the projects enumerated in the list attached hereto (hereinafter referred to as "the List"), according to the allocation for each project as specified in the List.
(2) 付表に掲げる事業計画(ただし、付表の1に掲げる事業計画の一部であって、3(2)にいう契約が既に締結されている部分を除く。)のための借款Iは、千九百九十三年六月二十五日に日本国政府により公表された開発途上国への資金協力計画の2(2)に沿って供与されることになる。
(2) The Loan I for the projects mentioned in the List, except for a part of the project mentioned in 1 of the List, on which the contracts mentioned in sub-paragraph (2) of paragraph 3 below have already been entered into, will be extended in line with sub-paragraph (2) of paragraph 2 of the "Funds for Development" Initiative announced by the Government of Japan on June 25, 1993.
2(1) 借款Iは、インド政府と基金との間で締結される借款契約に基づいて使用に供される。借款Iの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. (1) The Loan I will be made available by loan agreements to be concluded between the Government of India and the Fund. The terms and conditions of the Loan I as well as the procedures for its utilization will be governed by the said loan agreements which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years;
(b) 利子率は、年二･六パーセントとする。
(b) The rate of interest will be two point six (2.6) per cent per annum; and
(c) 支出期間は、付表の3に掲げる事業計画については、関係借款契約の発効の日から五年とし、付表の1、2、4、9及び11に掲げる事業計画については、関係借款契約の発効の日から六年とし、付表の6、7、8、10及び12に掲げる事業計画については、関係借款契約の発効の日から七年とし、付表の5に掲げる事業計画については、関係借款契約の発効の日から八年とする。
(c) The disbursement period will be five (5) years with regard to the project mentioned in 3 of the List, six (6) years with regard to the projects mentioned in 1, 2, 4, 9 and 11 of the List, seven (7) years with regard to the projects mentioned in 6, 7, 8, 10 and 12 of the List, and eight (8) years with regard to the project mentioned in 5 of the List from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約の各々は、基金が当該借款契約に係る計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) Each of the loan agreements mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the project to which such loan agreement relates.
3(1) 付表の3及び5に掲げる事業計画に係る借款Iは、インドの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して既に行ったか又は行う支払で、当該事業計画の実施に必要な生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3. (1) The Loan I for the projects mentioned in 3 and 5 of the List will be made available to cover payments already made and/or to be made by Indian executing agencies to suppliers, contractors and/or consultants of eligible source countries under such contracts as have been and/or may be entered into between them for purchases of products and/or services required for the implementation of the said projects, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) 付表の1、2、4、6、7、8、9、10、11及び12に掲げる事業計画に係る借款Iは、インドの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して行う支払で、当該事業計画の実施に必要な生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
(2) The Loan I for the projects mentioned in 1, 2, 4, 6, 7, 8, 9, 10, 11 and 12 of the List will be made available to cover payments to be made by Indian executing agencies to suppliers, contractors and/or consultants of eligible source countries under such contracts as have been or may be entered into between them for purchases of products and/or services required for the implementation of the said projects, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(3) (1)及び(2)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(3) The scope of eligible source countries mentioned in sub-paragraphs (1) and (2) above will be agreed upon between the authorities concerned of the two Governments.
(4) 借款Iの一部は、付表に掲げる事業計画の実施のための適格な現地通貨の需要に充てるために使用することができる。
(4) A part of the Loan I may be used to cover eligible local currency requirements for the implementation of the projects enumerated in the List.
4 インド政府は、3(1)及び(2)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
4. The Government of India will ensure that products and/or services mentioned in sub-paragraphs (1) and (2) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
5 3(1)及び(2)にいう生産物又は役務の供給に関連してインドにおいてその役務が必要とされる日本国民は、作業の遂行のためインドヘの入国及び同国における滞在に必要な便宜を与えられる。
5. Japanese nationals whose services may be required in India in connection with the supply of products and/or services mentioned in sub-paragraphs (1) and (2) of paragraph 3 shall be accorded such facilities as may be necessary for their entry into India and stay therein for the performance of their work.
6 両政府は、借款Iに基づいて購入される生産物の海上輸送及び海上保険に関し、それぞれの国の関係法令の範囲内で、両国の海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる直接又は間接の制限も課さない。
6. With regard to the shipping and marine insurance of products purchased under the Loan I, the two Governments will refrain, within the scope of the relevant laws and regulations of their respective countries, from imposing, directly or indirectly, any restrictions that may hinder fair and free competition between the shipping and marine insurance companies of the two countries.

1(1) 三十億円(三、〇〇〇、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款II」という。)が、付表の11に掲げる環境保全推進計画に関連して実施される公害防止設備設置計画(以下「計画」という。)の実施のため、基金により、日本国の関係法令に従って、インド産業信用投資公社(以下「ICICI」という。)に供与されることになる。
1. (1) A loan in Japanese yen up to the amount of three billion yen (3,000,000,000) (hereinafter referred to as "the Loan II") will be extended to the Industrial Credit and Investment Corporation of India Limited (hereinafter referred to as "the ICICI") by the Fund, in accordance with the relevant laws and regulations of Japan, for the implementation of the Pollution Prevention Equipment Installation Program which is to be executed in connection with the Industrial Pollution Control Project mentioned in 11 of the List (hereinafter referred to as "the Program").
(2) 借款IIは、千九百九十三年六月二十五日に日本国政府により公表された開発途上国への資金協力計画の2(2)に沿って供与されることになる。
(2) The Loan II will be extended in line with sub-paragraph (2) of paragraph 2 of the "Funds for Development" Initiative announced by the Government of Japan on June 25, 1993.
2(1) 借款IIは、ICICIと基金との間で締結される借款契約に基づいて使用に供される。借款IIの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. (1) The Loan II will be made available by a loan agreement to be concluded between the ICICI and the Fund. The terms and conditions of the Loan II as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 借款期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years;
(b) 利子率は、年二･六パーセントとする。
(b) The rate of interest will be two point six (2.6) per cent per annum; and
(c) 支出期間は、前記の借款契約の発効の日から五年とする。
(c) The disbursement period will be five (5) years from the date of coming into force of the said loan agreement.
(2) (1)にいう借款契約は、基金が計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) The loan agreement mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the Program.
3 借款IIの元本の償還及び利子の支払は、インド政府によって保証される。
3. The repayment of principal of the Loan II and the payment of interest thereon, shall be guaranteed by the Government of India.
4 借款IIは、計画に基づきICICIが借入人に対して行う融資に充てるために使用に供される。
4. The Loan II will be made available to cover credits to be extended by the ICICI to sub-borrowers under the Program.

1 I2(1)(c)及びII2(1)(c)にいうそれぞれの支出期間は、両政府の関係当局の同意を得て延長することができる。
1. The respective disbursement periods mentioned in sub-paragraph (1)(c), paragraph 2 of part I and sub-paragraph (1)(c), paragraph 2 of part II may be extended with the consent of the authorities concerned of the two Governments.
2 インド政府は、基金について、借款I及び借款II並びにそれらから生ずる利子に対して又はそれらに関連してインドにおいて課されるすべての財政課徴金又は租税を免除する。
2. The Government of India will exempt the Fund from all fiscal levies or taxes imposed in India on and/or in connection with the Loan I and the Loan II as well as interest accruing therefrom.
3 インド政府は、次のことを確保するために必要な措置をとる。
3. The Government of India will take necessary measures to ensure that:
(a) 借款I及び借款IIが適正にかつ専ら付表に掲げる事業計画及び計画のために使用されること。
(a) the Loan I and the Loan II be used properly and exclusively for the projects enumerated in the List and for the Program; and
(b) 借款Iに基づいて建設される施設がこの了解に定める目的のために適正にかつ効果的に維持され及び使用されること。
(b) the facilities constructed under the Loan I be maintained and used properly and effectively for the purposes prescribed in this understanding.
4 インド政府は、要請に応じ、日本国政府及び基金に対し、付表に掲げる事業計画及び計画の実施の進捗状況に関する情報及び資料を提出する。
4. The Government of India will, upon request, furnish the Government of Japan and the Fund with information and data concerning the progress of the implementation of the projects enumerated in the List and of the Program.
5 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
5. The two Governments will consult with each other in respect of any matter that may arise from or in connection with this understanding.
本使は、閣下が前記の了解をインド政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of India.
