書簡をもって啓上いたします。本使は、千九百九十四年六月一日にパリで開催されたアルジェリア民主人民共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とアルジェリア民主人民共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Democratic People's Republic of Algeria that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Democratic People's Republic of Algeria and of the Governments of the creditor countries concerned held in Paris on June l, 1994. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
1 債務繰延方式による債務救済措置が、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan.
2(1) 繰り延べられる債務(以下「繰延債務」という。)の総額は、七億千六百十八万五千四百三十九円(七一六、一八五、四三九円)になる。繰延債務は、アルジェリア民主人民共和国政府が基金に対して負う次の債務から成り、その内訳は、この書簡の付表（以下「付表」という。)に掲げられる。
2.(1) The total amount of the debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") will be seven hundred sixteen million one hundred eighty-five thousand four hundred and thirty-nine yen (716,185,439). The Rescheduled Debts consist of the following debts owed by the Government of the Democratic People's Republic of Algeria to the Fund. the breakdown of which is shown in the List attached hereto (hereinafter referred to as "the List"):
(a) 千九百九十四年五月三十一日以前に弁済期限の到来した未払の元本及び契約上の利子
(a) the principal and contractual interest having fallen due on or before May 31. 1994 and not paid;
(b) 千九百九十四年六月一日から千九百九十四年十月三十一日までの間(両期日を含む。)に弁済期限の到来した元本及び契約上の利子
(b) the principal and contractual interest having fallen due between June l, 1994 and October 31, 1994, both dates inclusive;
(c) 千九百九十四年十一月一日から千九百九十五年五月三十一日までの間(両期日を含む。)に弁済期限の到来したか又は到来する元本
(c) the principal having fallen or falling due between November l, 1994 and May 31, 1995. both dates inclusive.
(2) (1)にいう総額及び付表は、アルジェリア民主人民共和国政府の関係当局及び基金が行う最終的照合の後に日本国政府及びアルジェリア民主人民共和国政府の関係当局間の合意により修正されることがある。
(2) Modifications may be made to the total amount referred to in sub-paragraph (1) above and to the List by agreement between the authorities concerned of the Government of Japan and of the Government of the Democratic People's Republic of Algeria, after the final verification to be made by the authorities concerned of the Government of the Democratic People's Republic of Algeria and the Fund.
3 債務繰延べの条件は、アルジェリア民主人民共和国政府と基金との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in a rescheduling agreement to be concluded between the Government of the Democratic People's Republic of Algeria and the Fund, which will contain, inter alia, the following principles:
(1) 2(1)にいう総額は、この書簡の附属書に掲げる支払計画に従って千九百九十八年五月三十一日に始まる二十四回の半年賦払によって支払われる。
(1) The total amount referred to in sub-paragraph (1) of paragraph 2 above will be paid in twenty-four (24) semi-annual installments beginning on May 31, 1998 in accordance with the payment schedule shown in the Annex attached hereto.
(2) 繰延債務に対して付表に掲げる各々の当初の弁済期日から適用される利子率は、年三・七五パーセントとする。
(2) The rate of interest on the Rescheduled Debts applied from each original due date mentioned in the List will be three point seven five per cent (3.75%) per annum.
本使は、閣下が前記の了解をアルジェリア民主人民共和国政府に代わって確認されれば幸いであります。

I have further the honour to confirm the following understanding reached in the course of the said negotiations:
1 債務繰延方式による債務救済措置が、日本輸出入銀行及び日本国の関係民間金融機関(以下「銀行」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken by the Export-Import Bank of Japan together with the private financial institutions concerned of Japan (hereinafter referred to as "the Banks") in accordance with the relevant laws and regulations of Japan.
2(1) 繰り延べられる債務(以下「繰延債務」という。)の総額は、二百七十七億四千六百九十万八千三百九十七円(二七、七四六、九〇八、三九七円)になる。繰延債務は、アルジェリア民主人民共和国政府によって承継されることとなるアルジェリア炭化水素公社、アルジェリア人民銀行、農業地域開発銀行、アルジェリア国民銀行及びアルジェリア外国貿易銀行が銀行に対して負う次の債務から成り、その内訳は、この書簡の付表(以下「付表」という。)に掲げられる。
2.(1) The total amount of the debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") will be twenty-seven billion seven hundred forty-six million nine hundred eight thousand three hundred and ninety-seven yen (27,746,908,397). The Rescheduled Debts consist of the following debts which are owed by Entreprise Nationale SONATRACH, Credit Populaire d'Algerie, Banque de l'Agriculture et du Developpement Rural, Banque Nationale d'Algerie and Banque Exterieure d'Algerie to be succeeded by the Government of the Democratic People's Republic of Algeria, to the Banks, the breakdown of which is shown in the List attached hereto (hereinafter referred to as "the List"):
(a) 千九百九十四年五月三十一日以前に弁済期限の到来した未払の元本及ぴ契約上の利子
(a) the principal and contractual interest having fallen due on or before May 31, 1994 and not paid;
(b) 千九百九十四年六月一日から千九百九十四年十月三十一日までの間(両期日を含む。)に弁済期限の到来した元本及び契約上の利子

(2) (1)にいう総額及び付表は、アルジェリア民主人民共和国政府の関係当局、アルジェリア炭化水素公社、アルジェリア人民銀行、農業地域開発銀行、アルジェリア国民銀行及びアルジェリア外国貿易銀行及び銀行が行う最終的照合の後に日本国政府及びアルジェリア民主人民共和国政府の関係当局間の合意により修正されることがある。
(2) Modifications may be made to the total amount referred to in sub-paragraph (1) above and to the List by agreement between the authorities concerned of the Government of Japan and of the Government of the Democratic People's Republic of Algeria, after the final verification to be made by the authorities concerned of the Government of the Democratic People's Republic of Algeria, Entreprise Nationale SONATRACH, Credit Populaire d'Algerie, Banque de l'Agriculture et du Developpement Rural, Banque Nationale d'Algerie and Banque Exterieure d'Algerie and the Banks.
3 アルジェリア民主人民共和国政府は、繰延債務の総額を４の規定に従って日本輸出入銀行を通じて銀行に支払う。
3. The Government of the Democratic People's Republic of Algeria will pay to the Banks through the Export-Import Bank of Japan the total amount of the Rescheduled Debts in accordance with the provisions of paragraph 4.
4 関係債務の支払義務の引受け及び債務繰延べの条件は、アルジェリア民主人民共和国政府と銀行との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。
4. The terms and conditions of the assumption of the obligation of the payment and the rescheduling of the debts concerned will be stipulated in a rescheduling agreement to be concluded between the Government of the Democratic People's Republic of Algeria and the Banks, which will contain, inter alia, the following principles:
(1) アルジェリア民主人民共和国政府は、繰延債務を構成する債務の支払義務を引き受ける。
(1) The Government of the Democratic People's Republic of Algeria will assume the obligation of payment of the debts composing the Rescheduled Debts .
(2) 2(1)にいう総額は、この書簡の附属書に掲げる支払計画に従って千九百九十八年五月三十一日に始まる二十四回の半年賦払によって支払われる。
(2) The total amount referred to in sub-paragraph (1) of Paragraph 2 above will be paid in twenty-four (24) semi-annual installments beginning on May 31, 1998 in accordance with the payment schedule shown in the Annex attached hereto.
(3) 繰延債務に対し付表に掲げる各々の当初の弁済期日から適用される利子率は、年五・四パーセントとする。
(3) The rate of interest on the Rescheduled Debts applied from each original due date mentioned in the List will be five point four per cent (5.4%) per annum.
本使は、閣下が、前記の了解をアルジェリア民主人民共和国政府に代わって確認されれば幸いであります。

I have further the honour to confirm the following understanding reached in the course of the said negotiations:
1(1) この取極は、一方においてアルジェリア民主人民共和国の政府及び公共部門若しくはアルジェリアの他の関係債務者と他方において日本国の居住者である関係債権者(以下｢債権者｣という。)との間で千九百九十三年九月三十日より前に締結された契約に基づきアルジェリア民主人民共和国の政府及び公共部門が負っているか又は保一証した商業上の債務であって、日本国政府が保険を引き受けた弁済期間が一年を超えるものの元本及ぴ契約上の利子(以下｢繰延商業債務｣という。)の総額に適用される。
1.(1) The present arrangements will apply to the total amount of the following principal of and contractual interest on the commercial debts with a repayment period of more than one year, owed or guaranteed by the Government of the Democratic People's Republic of Algeria or its public sectors under the contracts concluded before September 30, 1993 between the Government of the Democratic People's Republic of Algeria or its public sectors or other Algerian debtors concerned on the one hand and the creditors concerned resident in Japan (hereinafter referred to as "the Creditors") on the other, and insured by the Government of Japan (hereinafter referred to as "the Rescheduled Commercial Debts"):
(a) 千九百九十四年五月三十一日以前に弁済期限の到来した未払の元本及び契約上の利子
(a) the principal and contractual interest having fallen due on or before May 31, 1994 and not paid;
(b) 千九百九十四年六月一日から千九百九十四年十月三十一日までの間(両期日を含む。)に弁済期限の到来した元本及び契約上の利子
(b) the principal and contractual interest having fallen due between June 1, 1994 and October 31, 1994, both dates inclusive;
(c) 千九百九十四年十一月一日から千九百九十五年五月三十一日までの間(両期日を含む。)に弁済期限の到来したか又は到来する元本
(c) the principal having fallen or falling due between November 1, 1994 and May 31, 1995, both dates inclusive.
(2)(a) (1)(a)にいう債務の総額は、二十六億九千百二十九万八千四十二円(二、六九一、二九八、〇四二円)と見積もられる。
(2)(a) The total amount of the debts referred to in (a) of sub-paragraph (1) above is estimated at two billion six hundred ninety-one million two hundred ninety-eight thousand and forty-two yen (2,691,298,042).
(b) (1)(b)にいう債務の総額は、四十七億七千五百三十四万四千五百八十一円(四、七七五、三四四、五八一円一と見積もられる。
(b) The total amount of the debts referred to in (b) of sub-paragraph (1) above is estimated at four billion seven hundred seventy-five million three hundred forty-four thousand five hundred and eighty-one yen (4,775,344,581).
(c) (1)(c)にいう債務の総額は、六十三億五千五百三十一万五千八百五十九円(六、三五五、三一五、八五九円)と見積もられる。
(c) The total amount of the debts referred to in (c) of sub-paragraph (1) above is estimated at six billion three hundred fifty-five million three hundred fifteen thousand eight hundred and fifty-nine yen (6,355,315,859).
(3) (2)(a)、(b)及び(c)にいう総額は、日本国政府及びアルジェリア民主人民共和国政府の関係当局が行う最終的照合の後に両国政府の関係当局間の合意により修正されることがある。
(3) Modifications may be made to the total amount referred to in (a), (b) and (c) of sub-paragraph (2) above by agreement between the authorities concerned of the Government of Japan and of the Government of the Democratic People's Republic of Algeria, after the final verification to be made by the authorities concerned of the two Governments.
2(1) アルジェリア民主人民共和国政府は、アルジェリア民主人民共和国中央銀行を通じて、繰延商業債務を決済するため(4)に定める支払計画一以下｢支払計画｣という。)に従って行われる支払の額及び日付を日本国政府に通告する。
2.(1) The Government of the Democratic People's Republic of Algeria will notify the Government of Japan, through the Central Bank of the Democratic People's Republic of Algeria, of the amount and dates of payments which will be made in order to settle the Rescheduled Commercial Debts in accordance with the payment scheme as set out in sub-paragraph (4) below (hereinafter referred to as "the Payment Scheme").
(2) アルジェリア民主人民共和国政府は、繰延商業債務の総額を支払計画に従いアルジェリア民主人民共和国中央銀行を通じ日本円により債権者に支払う。
(2) The Government of the Democratic People's Republic of Algeria will pay the total amount of the Rescheduled Commercial Debts to the Creditors in Japanese yen through the Central Bank of the Democratic People's Republic of Algeria in accordance with the Payment Scheme.
(3) 日本国政府は、商業上の関係債務が支払計画に従って行われる支払により決済されることを容易にするため、日本国において施行されている関係法令の範囲内で可能な措置をとる。
(3) The Government of Japan will take possible measures, within the scope of the relevant laws and regulations in force in Japan, to facilitate the settlement of the commercial debts concerned by the payment to be made in accordance with the Payment Scheme.
(4) 繰延商業債務を構成する債務の各々は、この書簡の附属書に掲げる支払計画に従って千九百九十八年五月三十一日に始まる二十四回の半年賦払によって支払われる。
(4) Each of the debts composing the Rescheduled Commercial Debts will be paid in twenty-four (24) semi-annual installments beginning on May 31, 1998 in accordance with the payment schedule shown in the Annex attached hereto.
3(1) アルジェリア民主人民共和国政府は、繰延商業債務を構成する債務の各々について、当該債務が決済されていない限り、(2)に定めるところにより算定される利子を次の計画に従って債権者に支払う。
3.(1) The Government of the Democratic People's Republic of Algeria will pay to the Creditors, interest to be calculated as described in sub-paragraph (2) below on each of the debts composing the Rescheduled Commercial Debts to the extent that they have not been settled, in accordance with the following schedule:
(a) 最初の利子の支払は、千九百九十五年三月三十一日に行われる。
(a) The first payment of the interest will be made on March 31, 1995.
(b) 最初の支払の後に引き続き行われる利子の支払は、毎年五月三十一日及び十一月三十日に行われる。
(b) The consecutive payments of interest after the first payment will be 1tade on May 31 and November 30 each year.
(2)(a)(i) 繰延商業債務に対して各々の当初の弁済期日から千九百九十四年五月三十一日までの間(両期日を含む。)に適用される利子率は、適用可能な日本円長期最優遇貸出金利(以下｢最優遇金利｣という。)に年〇・八七五パーセントを加えたものとする。
(2)(a)(i) The rate of interest on the Rescheduled Commercial Debts applied for the period between each original due date and May 31, 1994, both dates inclusive, will be nought point eight seven five per cent (0.875%) per annum above the applicable Japanese yen long-term prime lending rate (hereinafter referred to as "the prime rate ").
(ii) 繰延商業債務に対して各々の当初の弁済期日又は千九百九十四年六月一日のいずれか遅い時点から適用される利子率は、最優遇金利に年〇・三七五パーセントを加えたものとする。
(ii) The rate of interest on the Rescheduled Commercial Debts applied from each original due date or June l, 1994, whichever is the later, will be nought point three seven five per cent (0.375%) per annum above the prime rate.
(b)(i) 毎年五月三十一日及び十一月三十日を以下｢基準日｣という。基準日と次の基準日の前日までの間(両期日を含む。)を以下｢金利特定期間｣という。
(b)(i) The dates May 31 and November 30 each year are hereinafter referred to as "the base dates" . The period between a base date and the day immediately preceding the next base date (both dates inclusive) is hereinafter referred to as "the rate fixation period".
(ii) 金利特定期間の一についての適用可能な最優遇金利とは、この書簡の中で用いるときはいつでも、金利特定期間の最初の取引日に日本国の銀行により適用される率を意味する。
(ii) The applicable prime rate with respect to a particular rate fixation period means, whenever used in this Note, the rate applied as such by banks of Japan on the first business day in the rate fixation period.
(iii) 各最優遇金利は、関係債務が決済されていない限り、対応する金利特定期間においてのみ適用可能である。
(iii) Each prime rate is applicable only during the corresponding rate fixation period, insofar as the debt concerned remains unsettled.
(c) 金利特定期間の一について支払われる利子の額は、未決済の債務の額に当該金利特定期間において当該債務が決済されないままに経過した日数及ぴ一日当たりの適用可能な利子率を乗じて算定される。一日当たりの適用可能な利子率は、(2)(a)の規定に従って適用される利子率を三百六十五で除して算定される。
(c) The amount of interest to be paid with respect to a particular rate fixation period will be calculated by multiplying the amount of the debts unsettled by the product of the number of the days the debt has not been settled in the said rate fixation period and the applicable daily interest rate. The applicable daily interest rate is calculated by dividing the rate of interest (per annum) applied in accordance with the provisions of (a) of sub-paragraph (2) above by three hundred and sixty-five (365).
(d) 関係債務が一の金利特定期間を超えて未決済である場合には、支払われる利子の額は、関係する金利特定期間の各々について算定された利子の額を合計したものとなる。
(d) In case where the debt concerned has remained unsettled beyond one rate fixation period, the amount of interest to be paid will be the total of the amount of interest calculated with respect to each of the rate fixation periods concerned.
(3)(a) アルジェリア民主人民共和国政府は、支払計画((1)に定める利子の支払計画を含む。)上の支払が十日を超えない期間遅延した場合には、未払額から生ずる遅延利子を(2)(a)(ii)にいう利子率によって支払う。
(3)(a) In case where any payment under the Payment Scheme, including the payment schedule of interest set out in sub-paragraph (1) above, is delayed for not more than ten (10) days, the Government of the Democratic People's Republic of Algeria will pay the late interest accruing on the overdue amount at the rate of interest referred to in (a)(ii) of sub-paragraph (2) above.
(b) アルジェリア民主人民共和国政府は、支払計画((1)に定める利子の支払計画を含む。)上の支払が十日を超えて遅延した場合には、未払額から生ずる遅延利子を弁済期日後の最初の十日間については、(2)(a)(ii)にいう利子率によって、弁済期日後の十一日目の日以後については、(2)(a)(ii)にいう利子率に年〇・五パーセントを加えた率によって支払う。
(b) In case where any payment under the Payment Scheme, including the payment schedule of interest set out in sub-paragraph (1) above, is delayed for more than ten (10) days, the Government of the Democratic People's Republic of Algeria will pay the late interest accruing on the overdue amount at the rate of interest referred to in (a) (ii) of sub-paragraph (2) above in the first ten (10) days following the due date, and at the rate of nought point five per cent (0.5%) per annum above the rate of interest referred to in (a) (ii) of sub-paragraph (2) above on or after the eleventh (11th) day following the due date.
(4) 支払われる利子については、アルジェリア民主人民共和国のすべての租税及び課徴金が免除される。
(4) The interest paid will be exempted from all taxes and duties of the Democratic People's Republic of Algeria.
4 アルジェリア民主人民共和国政府は、商業上の関係債務の決済に伴って日本国外で生ずる銀行手数料を支払う。
4. The Government of the Democratic People's Republic of Algeria will pay bank charges incurred outside Japan incidental to the settlement of the commercial debts concerned.
5 関係契約の条件のうちこの書簡において特に言及されていないものは、関係契約の当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。
5. It is confirmed that terms and conditions of the contracts concerned not specifically referred to in this Note will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.
6 アルジェリア民主人民共和国政府は、いずれかの第三国の居住者であって債権を有するものに対し債務救済措置についてに定める条件より有利な条件を与えた場合には、当該第三国の居住者に与えられる条件より不利でない条件を債権者に直ちに与える。
6. If the Government of the Democratic People's Republic of Algeria accords to creditors resident in any third country terms and conditions more favourable than those referred to in sub-paragraph (4) of paragraph 2 with regard to debt relief measures, the Government of the Democratic People's Republic of Algeria will forthwith accord to the Creditors the terms and conditions not less favourable than those accorded to creditors resident in such third country.
7 アルジェリアの債務(この取極が対象とする債務を含む。)の再編に関してアルジェリア民主人民共和国政府の代表者及び関係債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府とアルジェリア民主人民共和国政府との間でこの取極の継続又は修正について討議するための協議が行われる。
7. If the representative of the Government of the Democratic People's Republic of Algeria and the representatives of the Governments of the creditor countries concerned come to a new conclusion in connection with reorganization of the Algerian debts including the debts covered by the present arrangements, consultations will be held between the Government of Japan and the Government of the Democratic People's Republic of Algeria, in order to discuss the matter of continuation or modification of the present arrangements.
