青年海外協力隊の派遣に関する日本国政府とイエメン共和国政府との間の交換公文

(Japanese Note) Sana'a, July 29, 1993
書簡をもって啓上いたします。本使は、日本国とイエメン共和国との間の技術協力を促進するため青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をイエメン共和国に派遣することに関し、日本国政府の代表者とイエメン共和国政府の代表者との間でサナアにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。
Sir, I have the honour to refer to the recent discussions held in Sana'a between the representatives of the Government of Japan and of the Government of the Republic of Yemen concerning the dispatch of volunteers to the Republic of Yemen under the Japan Overseas Cooperation Volunteers Programme (hereinafter referred to as "the Programme") with a view to promoting technical cooperation between the two countries, and to confirm on behalf of the Government of Japan the following understanding reached between them:
1 日本国政府は、イエメン共和国政府の要請に基づき、日本国の現行法令に従い、イエメン共和国の社会的及び経済的開発に寄与するため、両政府の関係当局間で別個に合意される計画に従い協力隊員をイエメン共和国に派遣するために必要な措置をとる。
1. At the request of the Government of the Republic of Yemen, the Government of Japan will, in accordance with the laws and regulations in force in Japan, take necessary measures to dispatch the volunteers to the Republic of Yemen for the purpose of contributing to the social and economic development of the Republic of Yemen, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とイエメン共和国との間の渡航費及びイエメン共和国における生活手当を負担し、また、協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost of international travel between Japan and the Republic of Yemen and living allowances in the Republic of Yemen for the volunteers and to make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their functions.
3 イエメン共和国政府は、協力隊員に対し、次の特権、免除及び便宜を与える。
3. The Government of the Republic of Yemen will grant the volunteers the following privileges, exemptions and benefits:
(1) 2にいう装備、機械、材料及び医薬品の輸入に関して、関税、租税その他の課徴金の免除
(1) Exemption from customs duties, taxes and charges of any kind in respect of the importation of the equipment, machinery, materials and medical supplies mentioned in paragraph 2 above.
(2) 身回品及び家財の輸入であって、協力隊員が任務を遂行する場所に到着してから六箇月以内に行われるものに関して、関税、租税その他の課徴金の免除。当該物品が、その後イエメン共和国において、関税、租税若しくは課徴金の免除又は同様の特権を与えられていない個人又は団体に売却又は譲渡される場合には、関税、租税又は課徴金の支払に従うことを条件とする。
(2) Exemption from customs duties, taxes and charges of any kind in respect of the importation of their personal and household effects, being imported within six months from their arrival at places where they are to perform their functions. The said effects will be subject to payment of customs duties, taxes and charges if they are subsequently sold or transferred within the Republic of Yemen to individuals or organizations not entitled to exemption from such duties, taxes and charges or similar privileges.
(3) 2にいう生活手当等協力隊員に対して海外から送付される手当に関して、所得税その他の課徴金の免除
(3) Exemption from income taxes and charges of any kind in respect of any allowances to be remitted for them from overseas such as the living allowances mentioned in paragraph 2 above.
(4) 協力隊員のイエメン共和国における任期中の無料診療
(4) Free medical care during the term of their assignment in the Republic of Yemen.
(5) 協力隊員がイエメン共和国政府より与えられる任務を遂行する場所における無家賃の家具付住居施設(これらの施設は、協力隊員の受入機関が直接確保する。)
(5) Rent-free housing accommodations with basic furnishings at places where they are to perform their functions to be assigned to them by the Government of the Republic of Yemen, provided that such accommodations are directly secured by the institutions receiving the volunteers.
4 (1) イエメン共和国政府は、イエメン共和国における計画の活動に関連して日本国政府による技術及び経済協力の実施機関である国際協力事業団が与える任務を遂行する駐在員一名及び調整員を受け入れる。
4.(1) The Government of the Republic of Yemen will accept a Representative and Co-ordinators who will discharge the functions to be assigned to them by the Japan International Cooperation Agency, the executing agency for technical and economic cooperation by the Government of Japan, relative to the activities of the Programme in the Republic of Yemen.
(2) イエメン共和国政府は、駐在員及び調整員に対し、次の特権、免除及び便宜を与える。
(2) The Government of the Republic of Yemen will grant the Representative and the Co-ordinators the following privileges, exemptions and benefits:
(i) 駐在員及び調整員の任務の遂行に必要な装備、機械、自動車、材料及び医薬品の輸入に関して、関税、租税その他の課徴金の免除
(i) Exemption from customs duties, taxes and charges of any kind in respect of the importation of the equipment, machinery, motorcars, materials and medical supplies, necessary for the performance of their functions.
(ii) 身回品及び家財の輸入であって、駐在員及び調整員が任務を遂行する場所に到着してから六箇月以内に行われるものに関して、関税、租税その他の課徴金の免除。当該物品が、その後イエメン共和国において、関税、租税若しくは課徴金の免除又は同様の特権を与えられていない個人又は団体に売却又は譲渡される場合には、関税、租税又は課徴金の支払に従うことを条件とする。
(ii) Exemption from customs duties, taxes and charges of any kind in respect of the importation of their personal and household effects, being imported within six months from their arrival at places where they are to perform their functions. The said effects will be subject to payment of customs duties, taxes and charges if they are subsequently sold or transferred within the Republic of Yemen to individuals or organizations not entitled to exemption from such duties, taxes and charges or similar privileges.
(iii) 駐在員及び調整員に対して海外から送付される報酬又は手当に関して、所得税その他の課徴金の免除
(iii) Exemption from income taxes and charges of any kind in respect of any emoluments or allowances to be remitted for them from overseas.
(iv) 駐在員及び調整員各一名につき一台の自動車の、駐在員及び調整員が任務を遂行する場所に到着してから六箇月以内の無税輸入又はイエメン共和国における保税倉庫からの購入。当該自動車が、その後イエメン共和国において、関税、租税若しくは課徴金の免除又は同様の特権を与えられていない個人又は団体に売却又は譲渡される場合には、関税、租税又は課徴金の支払に従うことを条件とする。
(iv) Importation free of duties (or purchase from bond in the Republic of Yemen) of one motorcar for each of the Representative and the Co-ordinators, being imported within six months from their arrival at places where they are to perform their functions. The said motorcar will be subject to payment of customs duties, taxes and charges if they are subsequently sold or transferred within the Republic of Yemen to individuals of organizations not entitled to exemption from such duties, taxes and charges or similar privileges.
5 イエメン共和国政府は、請求が、イエメン共和国における協力隊員の公務に起因して生じ、その遂行の過程で生じ、又はその遂行中における作為若しくは不作為に関連して生じた場合には、その請求に関する責任を負う。ただし、それらの請求が協力隊員の重大な過失又は故意から生じた場合には、この限りでない。
5. The Government of the Republic of Yemen will bear claims, if any arises, resulting from, occurring in the course of, or otherwise connected with any action performed or omission made in the course of the official functions by the volunteers in the Republic of Yemen except when such claims arise from gross negligence or wilful misconduct on th part of the volunteers.
6 駐在員、調整員及び協力隊員は、イエメン共和国の法令を尊重する。
6. The Representative, Co-ordinators and volunteers shall respect the laws and regulation of the Republic of Yemen.
7 イエメン共和国政府は、同国において同様の任務を遂行する第三国の者がこの了解に定める待遇より有利な待遇を与えられる場合には、当該第三国の者に与えられる待遇より不利でない待遇を、駐在員、調整員又は協力隊員に直ちに与える。
7. In cases where treatment more favourable than that provided for herein is accorded to persons of any third country performing similar functions in the Republic of Yemen, the Government of the Republic of Yemen will forthwith accord to the Representative, Co-ordinators or volunteers treatment no less favourable than that accorded to the persons of such third country.
8 両政府は、イエメン共和国における計画の実施の成功及び必要な調整のため随時協議する。当該調整を行うため、イエメン共和国側の指定された当局である計画開発省は、必要な措置をとる。
8. The two Governments will hold consultations from time to time, for the successful implementation of and necessary coordination for the Programme in the Republic of Yemen. To ensure the said coordination, necessary measures will be taken by the Ministry of Planning and Development, the designated authorities on the side of the Republic of Yemen.
9 この了解は、両政府間の書簡の交換によって修正することができ、かつ、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によって通告することにより終了させることができる。
9. The understanding set out above may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months' prior written notice of its intention to terminate it.
10 千九百八十九年九月九日付の日本国政府とイエメン・アラブ共和国政府の間の交換公文に述べられた了解はこの了解によって代替される。
10. The understanding contained in the Notes exchanged between the Government of Japan and the Government of the Yemen Arab Republic on September 9, 1989 is superseded by the present understanding.
本使は、更に、この書簡及び前記の了解をイエメン共和国政府に代わって確認される貴官の返簡が両政府間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and your Note in reply confirming on behalf of the Government of the Republic of Yemen the foregoing understanding shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of your reply.

書簡をもって啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

本官は、更に、前記の了解をイエメン共和国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Republic of Yemen the foregoing understanding and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.
