債務救済措置に関する日本国政府とホンデュラス共和国政府との間の三の交換公文

(Japanese Note) Tegucigalpa, M.D.C., December 15, 1993
書簡をもって啓上いたします。本使は、千九百九十二年十月二十六日にパリで開催されたホンデュラス共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とホンデュラス共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Honduras that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Honduras and of the Governments of the creditor countries concerned held in Paris on October 26, 1992. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
1 債務繰延方式による債務救済措置が、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan.
2(1) 繰り延べられる債務(以下「繰延債務」という。)は、ホンデュラス共和国政府が基金に対して負う次の債務から成る。
2.(1) The debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") consist of the following debts owed by the Government of the Republic of Honduras to the Fund:
(a) 過去に繰り延べられなかった債務に関し、
(a) For the debts not previously rescheduled,
(i) 千九百九十二年九月三十日以前に弁済期限の到来した未払の元本及び契約上の利子並びに千九百九十二年十月一日から千九百九十三年七月三十一日までの間(両期日を含む。)に弁済期限の到来した元本及び契約上の利子(それらの内訳は、この書簡の付表一に掲げられる。)
(i) the principal and contractual interest having fallen due on or before September 30, 1992 and not paid, and having fallen due between October 1, 1992 and July 31, 1993, both dates inclusive, the breakdown of which is shown in the List 1 attached hereto;
(ii) 千九百九十三年八月一日から千九百九十四年七月三十一日までの間(両期日を含む。)に弁済期限の到来したか又は到来する元本及び契約上の利子(それらの内訳は、この書簡の付表二に掲げられる。)。ただし、国際通貨基金(以下「IMF」という。)の理事会が、拡大構造調整措置(以下「ESAF」という。)に基づくホンデュラス共和国政府とIMFとの間の第二年次取極を千九百九十三年九月三十日(以下「承認の期限I」という。)までに承認し、かつ、関係債権諸国が千九百九十二年十月二十六日にパリでホンデュラス共和国政府の代表者及び関係債権諸国政府の代表者によって署名された合意議事録(以下「合意議事録」という。)に定める条件をホンデュラス共和国政府が遵守したと認める場合に限る。
(ii) the principal and contractual interest having fallen or falling due between August 1, 1993 and July 31, 1994, both dates inclusive, the breakdown of which is shown in the List 2 attached hereto, provided that the Executive Board of the International Monetary Fund (hereinafter referred to as "the IMF") has approved by September 30, 1993 (hereinafter referred to as "the date of approval I") the second annual arrangement between the Government of the Republic of Honduras and the IMF under the Enhanced Structural Adjustment Facility (hereinafter referred to as "the ESAF"), and that the creditor countries concerned determine that the Government of the Republic of Honduras has complied with the condition set out in the Agreed Minute signed by the representatives of the Government of the Republic of Honduras and of the Governments of the creditor countries concerned in Paris on October 26, 1992 (hereinafter referred to as "the Agreed Minute"); and
(iii) 千九百九十四年八月一日から千九百九十五年七月三十一日までの間(両期日を含む。)に弁済期限の到来する元本及び契約上の利子(それらの内訳は、この書簡の付表三に掲げられる。)。ただし、IMFの理事会が、ESAFに基づくホンデュラス共和国政府とIMFとの間の第三年次取極を千九百九十四年九月三十日(以下「承認の期限II」という。)までに承認し、かつ、関係債権諸国が合意議事録に定める条件をホンデュラス共和国政府が遵守したと認める場合に限る。
(iii) the principal and contractual interest falling due between August 1, 1994 and July 31, 1995, both dates inclusive, the breakdown of which is shown in the List 3 attached hereto, provided that the Executive Board of the IMF has approved by September 30, 1994 (hereafter referred to as "the date of approval II") the third annual arrangement between the Government of the Republic of Honduras and the IMF under the ESAF, and that the creditor countries concerned determine that the Government of the Republic of Honduras has complied with the condition set out in the Agreed Minute.
(b) 千九百九十二年六月二十四日に日本国政府とホンデュラス共和国政府との間で交換された書簡により行われた取極に従って過去に繰り延べられた債務に関し、千九百九十二年十月一日から千九百九十三年七月三十一日までの間(両期日を含む。)に弁済期限の到来した繰延利子(その内訳は、この書簡の付表四に掲げられる。)
(b) For the debts previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Honduras on June 24, 1992, the rescheduling interest having fallen due between October 1, 1992 and July 31, 1993, both dates inclusive, and the breakdown of which is shown in the List 4 attached hereto.
(2) 承認の期限I及び承認の期限IIは、関係債権諸国政府の代表者の行う決定に従い日本国政府及びホンデュラス共和国政府の関係当局の同意を得て修正することができる。
(2) The date of approval I and the date of approval II may be modified with the consent of the authorities concerned of the Government of Japan and of the Government of the Republic of Honduras in accordance with the decision to be made by the representatives of the Governments of the creditor countries concerned.
(3) 繰延債務の総額は、四十四億八千八十万百五十八円(四、四八〇、八〇〇、一五八円)になる。
(3) The total amount of the Rescheduled Debts will be four billion four hundred eighty million eight hundred thousand one hundred and fifty-eight yen (4,480,800,158).
(4) (3)にいう総額及びこの書簡の付表一、二、三及び四は、ホンデュラス共和国政府の関係当局及び基金が行う最終的照合の後に日本国政府及びホンデュラス共和国政府の関係当局間の合意により修正されることがある。
(4) Modifications may be made to the total amount referred to in sub-paragraph (3) above and to the List 1, 2, 3 and 4 attached hereto by agreement between the authorities concerned of the Government of Japan and of the Republic of Honduras, after the final verification to be made by the authorities concerned of the Government of the Republic of Honduras and the Fund.
3 債務繰延べの条件は、ホンデュラス共和国政府と基金との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in a rescheduling agreement to be concluded between the Government of the Republic of Honduras and the Fund, which will contain, inter alia, the following principles:
(1) 繰延債務を構成する債務の各々は、この書簡の附属書に掲げる支払計画に従って二千六年九月一日に始まる三十六回の半年賦払によって支払われる。
(1) Each of the debts composing the Rescheduled Debts will be paid in thirty-six (36) semi-annual installments beginning on September 1, 2006 in accordance with the payment schedule shown in Annex attached hereto.
(2) 繰延債務に対してそれぞれこの書簡の付表一、二、三及び四に掲げる弁済期日から適用される利子率は、年三・七パーセントとする。
(2) The rate of interest on the Rescheduled Debts will be three point seven per cent (3.7%) per annum beginning respectively from the due dates mentioned in the List 1, 2, 3 and 4 attached hereto.
4 ホンデュラスの債務(この取極が対象とする債務を含む。)の再編に関してホンデュラス共和国政府の代表者及び関係債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府とホンデュラス共和国政府との間でこの取極の継続又は修正について討議するための協議が行われる。
4. If the representative of the Government of the Republic of Honduras and the representatives of the Governments of the creditor countries concerned come to a new conclusion in connection with reorganization of the Honduran debts including the debts covered by the present arrangements, consultations will be held between the Government of Japan and the Government of the Republic of Honduras in order to discuss the matter of continuation or modification of the present arrangements.

1. A debt relief measure in the form of rescheduling will be taken by the Export-Import Bank of Japan together with the private banks concerned (hereinafter referred to as "the Banks") in accordance with the relevant laws and regulations of Japan.
2(1) 繰り延べられる債務(以下「繰延債務」という。)は、国営電力公社が銀行に対して負う次の債務であってこの書簡の付表に掲げるものから成る。
2.(1) The debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") consist of the following debts owed by Empresa Nacional de Energia Electrica to the Banks, the breakdown of which is shown in the List attached hereto:
(a) 過去に繰り延べられなかった債務に関し、
(a) For the debts not previously rescheduled,
(i) 千九百九十二年九月三十日以前に弁済期限の到来した未払の元本及び契約上の利子並びに千九百九十二年十月一日から千九百九十三年七月三十一日までの間(両期日を含む。)に弁済期限の到来した元本及び契約上の利子

(2) 承認の期限I及び承認の期限IIは、関係債権諸国政府の代表者の行う決定に従い日本国政府及びホンデュラス共和国政府の関係当局の同意を得て修正することができる。
(2) The date of approval I and the date of approval II may be modified with the consent of the authorities concerned of the Government of Japan and of the Government of the Republic of Honduras in accordance with the decision to be made by the representatives of the Governments of the creditor countries concerned.
(3)(a)(i) (1)(a)(i)にいう繰延債務の総額は、四億六百二十二万二千七百三十五円(四〇六、二二二、七三五円)である。
(3)(a)(i) The total amount of the Rescheduled Debts referred to in (a) (i) of sub-paragraph (1) above is four hundred six million two hundred twenty-two thousand seven hundred and thirty-five yen (406,222,735).
(ii) (1)(a)(ii)にいう繰延債務の総額は、二億五千二百七十七万七百九十七円(二五二、七七〇、七九七円)である。
(ii) The total amount of the Rescheduled Debts referred to in (a) (ii) of sub-paragraph (1) above is two hundred fifty-two million seven hundred seventy thousand seven hundred and ninety-seven yen (252,770,797).
(iii) (1)(a)(iii)にいう繰延債務の総額は、二億三千八百三十九万五千六百九十七円(二三八、三九五、六九七円)である。
(iii) The total amount of the Rescheduled Debts referred to in (a) (iii) of sub-paragraph (1) above is two hundred thirty-eight million three hundred ninety-five thousand six hundred and ninety-seven yen (238,395,697).
(b) (1)(b)にいう繰延債務の総額は、九千二百九十六万三千五百七十一円(九二、九六三、五七一円)である。
(b) The total amount of the Rescheduled Debts referred to in (b) of sub-paragraph (1) above is ninety-two million nine hundred sixty-three thousand five hundred and seventy-one yen (92,963,571).
(4) (3)にいう総額及びこの書簡の付表は、国営電力公社及び銀行が行う最終的照合の後に日本国政府及びホンデュラス共和国政府の関係当局間の合意により修正されることがある。
(4) Modifications may be made to the total amount referred to in sub-paragraph (3) above and to the List attached hereto by agreement between the authorities concerned of the Governments of Japan and of the Republic of Honduras, after the final verification to be made by Empresa Nacional be Energia Electrica and the Banks.
3 債務繰延べの条件は、国営電力公社と銀行との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in a rescheduling agreement to be concluded between Empresa Nacional de Energia Electrica and the Banks, which will contain, inter alia, the following principles:
(1) 繰延債務を構成する債務の各々は、この書簡の附属書に掲げる支払計画に従って千九百九十九年九月一日に始まる三十六回の半年賦払によって支払われる。
(1) Each of the debts composing the Rescheduled Debts will be paid in thirty-six (36) semi-annual installments beginning on September 1, 1999 in accordance with the payment schedule shown in Annex attached hereto.
(2)(a) 繰延債務に対してこの書簡の付表に掲げる各々の当初の弁済期日から千九百九十二年九月三十日までの間(両期日を含む。)に適用される利子率は、年九・五パーセントとする。
(2)(a) The rate of interest on the Rescheduled Debts applied for the period between each original due date mentioned in the List attached hereto and September 30, 1992, both dates inclusive, will be nine point five per cent (9.5%) per annum.
(b) 繰延債務に対してそれぞれこの書簡の付表に掲げる弁済期日又は千九百九十二年十月一日のいずれか遅い時点から適用される利子率は、年二・三四二一パーセントとする。
(b) The rate of interest on the Rescheduled Debts applied from each original due date mentioned in the List attached hereto or October 1, 1992, whichever is the later, will be two point three four two one per cent (2.3421%) per annum.
(3) 繰延債務を構成する債務の各々に対して千九百九十二年十月一日から千九百九十九年八月三十一日までの間(両期日を含む。)に生ずる利子の五十パーセントは、千九百九十九年九月一日に始まる三十六回の均等半年賦払によって支払われる。その額に対しては、利子は、課されない。
(3) Fifty per cent (50%) of the amount of the interest on each of the debts composing the Rescheduled Debts, accruing during the period between October 1, 1992 and August 31, 1999, both dates inclusive, will be paid in thirty-six (36) equal semi-anuual installments beginning on September 1, 1999. No interest will be charged on this amount.
4 ホンデュラスの債務(この取極が対象とする債務を含む。)の再編に関してホンデュラス共和国政府の代表者及び関係債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府とホンデュラス共和国政府との間でこの取極の継続又は修正について討議するための協議が行われる。
4. If the representative of the Government of the Republic of Honduras and the representatives of the Governments of the creditor countries concerned come to a new conclusion in connection with reorganization of the Honduran debts including the debts covered by the present arrangements, consultations will be held between the Government of Japan and the Government of the Republic of Honduras in order to discuss the matter of continuation or modification of the present arrangements.

Excellency,
書簡をもって啓上いたします。本使は、千九百九十二年十月二十六日にパリで開催されたホンデュラス共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とホンデュラス共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Honduras that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Honduras and of the Government of the creditor countries concerned held in Paris on October 26, 1992. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
1(1) この取極は、一方においてホンデュラス共和国の政府及び政府企業並びにホンデュラスの民間団体と他方において日本国の居住者である関係債権者(以下「債権者」という。)との間で千九百九十年六月一日より前に契約され、日本国政府が保険を引き受けた弁済期間が一年を超える商業上の債務の元本、契約上の利子及び繰延利子であって、次に掲げるもの(以下「繰延商業債務」という。)の総額に適用される。
1.(1) The present arrangements will apply to the total amount of the following principal of, contractual interest on and rescheduling interest on the commercial debts with a repayment period of more than one year, contracted before June 1, 1990 between the Government and governmental corporations of the Republic of Honduras and Honduran private entities on the one hand and the creditors concerned resident in Japan (hereinafter referred to as "the Creditors") on the other and insured by the Government of Japan (hereinafter referred to as "the Rescheduled Commercial Debts"):
(a) 過去に繰り延べられなかった商業上の債務に関し、
(a) For the commercial debts not previously rescheduled,
(i) 千九百九十二年九月三十日以前に弁済期限の到来した未払の元本及び契約上の利子
(i) the principal and contractual interest having fallen due on or before September 30, 1992 and not paid,
(ii) 千九百九十二年十月一日から千九百九十三年七月三十一日までの間(両期日を含む。)に弁済期限の到来した元本及び契約上の利子
(ii) the principal and contractual interest having fallen due between October 1, 1992 and July 31, 1993, both dates inclusive,
(iii) 千九百九十三年八月一日から千九百九十四年七月三十一日までの間(両期日を含む。)に弁済期限の到来したか又は到来する元本及び契約上の利子。ただし、国際通貨基金(以下「IMF」という。)の理事会が、拡大構造調整措置(以下「ESAF」という。)に基づくホンデュラス共和国政府とIMFとの間の第二年次取極を千九百九十三年九月三十日(以下「承認の期限I」という。)までに承認し、かつ、関係債権諸国が千九百九十二年十月二十六日にパリでホンデュラス共和国政府の代表者及び関係債権諸国政府の代表者によって署名された合意議事録(以下「合意議事録」という。)に定める条件をホンデュラス共和国政府が遵守したと認める場合に限る。
(iii) the principal and contractual interest having fallen or falling due between August 1, 1993 and July 31, 1994, both dates inclusive, provided that the Executive Board of the International Monetary Fund (hereinafter referred to as "the IMF") has approved by September 30, 1993 (hereinafter referred to as "the date of approval I") the second annual arrangement between the Government of the Republic of Honduras and the IMF under the Enhanced Structural Adjustment Facility (hereinafter referred to as "the ESAF"), and that the creditor countries concerned determine that the Government of the Republic of Honduras has complied with the condition set out in the Agreed Minute signed by the representatives of the Government of the Republic of Honduras and of the Governments of the creditor countries concerned in Paris on October 26, 1992 (hereinafter referred to as "the Agreed Minute"); and
(iv) 千九百九十四年八月一日から千九百九十五年七月三十一日までの間(両期日を含む。)に弁済期限の到来する元本及び契約上の利子。ただし、IMFの理事会が、ESAFに基づくホンデュラス共和国政府とIMFとの間の第三年次取極を千九百九十四年九月三十日(以下「承認の期限II」という。)までに承認し、かつ、関係債権諸国が合意議事録に定める条件をホンデュラス共和国政府が遵守したと認める場合に限る。
(iv) the principal and contractual interest falling due between August 1, 1994 and July 31, 1995, both dates inclusive, provided that the Executive Board of the IMF has approved by September 30, 1994 (hereinafter referred to as "the date of approval II") the third annualarrangement between the Government of the Republic of Honduras and the IMF under the ESAF, and that the creditor countries concerned determine that the Government of the Republic of Honduras has complied with the condition set out in the Agreed Minute.
(b) 千九百九十二年六月二十四日に日本国政府とホンデュラス共和国政府との間で交換された書簡(以下「従前の書簡」という。)により行われた取極に従って過去に繰り延べられた商業上の債務に関し、千九百九十二年十月一日から千九百九十三年七月三十一日までの間(両期日を含む。)に弁済期限の到来した繰延利子
(b) For the commercial debts previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Governments of Japan and of the Republic of Honduras on June 24, 1992 (hereinafter referred to as "the Previous Notes"), the rescheduling interest having fallen due between October1, 1992 and July 31, 1993, both dates inclusive.
(2) 承認の期限I及び承認の期限IIは、関係債権諸国政府の代表者の行う決定に従い日本国政府及びホンデュラス共和国政府の関係当局の同意を得て修正することができる。
(2) The date of approval I and the date of approval II may be modified with the consent of the authorities concerned of the Government of Japan and of the Government of the Republic of Honduras in accordance with the decision to be made by the representatives of the Governments of the creditor countries concerned.
(3)(a) (1)(a)(i)にいう債務の総額は、日本円によって契約された債務については、三億七千二百四十九万七千四百三十五円(三七二、四九七、四三五円)、また、合衆国ドルによって契約された債務については、二百二十三万千百合衆国ドル(二、二三一、一〇〇合衆国ドル)と見積もられる。
(3)(a) The total amount of the debts referred to in (a)(i) of sub-paragraph (1) above is estimated at three hundred seventy-two million four hundred ninety-seven thousand four hundred and thirty-five yen (372,497,435) for the debts contracted in Japanese yen, and two million two hundred thirty-one thousand and one hundred United States dollars ($2,231,100) for the debts contracted in United States dollars.
(b) (1)(a)(ii)にいう債務の総額は、日本円によって契約された債務については、四億九千五百九十三万四千九百六十九円(四九五、九三四、九六九円)、また、合衆国ドルによって契約された債務については、二百十六万四千九十五合衆国ドル(二、一六四、〇九五合衆国ドル)と見積もられる。
(b) The total amount of the debts referred to in (a)(ii) of sub-paragraph (1) above is estimated at four hundred ninety-five million nine hundred thirty-four thousand nine hundred and sixty-nine yen (495,934,969) for the debts contracted in Japanese yen, and two million one hundred sixty-four thousand and ninety-five United States dollars ($2,164,095) for the debts contracted in United States dollars.
(c) (1)(a)(iii)にいう債務の総額は、日本円によって契約された債務については、二億五千九百八十三万三千九百三十九円(二五九、八三三、九三九円)、また、合衆国ドルによって契約された債務については、四百十二万七千百七十七合衆国ドル(四、一二七、一七七合衆国ドル)と見積もられる。
(c) The total amount of the debts referred to in (a)(iii) of sub-paragraph (1) above is estimated at two hundred fifty-nine million eight hundred thirty-three thousand nine hundred and thirty-nine yen (259,833,839) for the debts contracted in Japanese yen, and four million one hundred twenty-seven thousand one hundred and seventy-seven United States dollars (4,127,177) for the debts contracted in United States dollars.
(d) (1)(a)(iv)にいう債務の総額は、日本円によって契約された債務については、一億二千二百三十五万八千九円(一二二、三五八、〇〇九円)、また、合衆国ドルによって契約された債務については、三百八十五万九千百五十七合衆国ドル(三、八五九、一五七合衆国ドル)と見積もられる。
(d) The total amount of the debts referred to in (a)(iv) of sub-paragraph (1) above is estimated at one hundred twenty-two million three hundred fifty-eight thousand and nine yen (122,358,009) for the debts contracted in Japanese yen, and three million eight hundred fifty-nine thousand one hundred and fifty-seven United States dollars (3,859,157) for the debts contracted in United States dollars.
(e) (1)(b)にいう債務の総額は、日本円によって契約された債務については、一億三千二百六十三万七千六百五十三円(一三二、六三七、六五三円)、また、合衆国ドルによって契約された債務については、百十四万九千八百五十六合衆国ドル六十七セント(一、一四九、八五六・六七合衆国ドル)と見積もられる。
(e) The total amount of the debts referred to in (b) of sub-paragraph (1) above is estimated at one hundred thirty-two million six hundred thirty-seven thousand six hundred and fifty-three yen (132,637,653) for the debts contracted in Japanese yen, and one million one hundred forty-nine thousand eight hundred and fifty-six United States dollars and sixty-seven cents ($1,149,856.67) for the debts contracted in United States dollars.
(4) (3)にいう総額は、日本国政府及びホンデュラス共和国政府の関係当局が行う最終的照合の後に両政府の関係当局間の合意により修正されることがある。
(4) Modifications may be made to the total amount referred to in sub-paragraph (3) above by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Honduras, after the final verification to be made by the authorities concerned of the two Governments.
2(1) ホンデュラス共和国政府は、ホンデュラス共和国財務公債省を通じて、繰延商業債務を決済するため(4)に定める支払計画(以下「支払計画」という。)に従って行われる支払の額及び日付について日本国政府に通告する。
2.(1) The Government of the Republic of Honduras will notify the Government of Japan, through the Ministry of Finance and Public Credit of the Republic of Honduras, of the amount and dates of payments which will be made in order to settle the Rescheduled Commercial Debts in accordance with the payment scheme as set out in sub-paragraph (4) below (hereinafter referred to as "the Payment Scheme").
(2) ホンデュラス共和国政府は、繰延商業債務の総額を支払計画に従いホンデュラス共和国中央銀行を通じ関係契約によって指定された通貨により債権者に支払う。
(2) The Government of the Republic of Honduras will pay the total amount of the Rescheduled Commercial Debts to the Creditors in the currency or currencies designated in the contracts concerned through the Central Bank of the Republic of Honduras in accordance with the Payment Scheme.
(3) 日本国政府は、商業上の関係債務が支払計画に従って行われる支払により決済されることを容易にするため、日本国において施行されている関係法令の範囲内で可能な措置をとる。
(3) The Government of Japan will take possible measures, within the scope of the relevant laws and regulations in force in Japan, to facilitate the settlement of the commercial debts concerned by the payment to be made in accordance with the Payment Scheme.
(4)(a) 1(1)にいう商業上の債務の各々は、この書簡の附属書一に掲げる支払計画に従って千九百九十四年九月一日に始まる四十六回の半年賦払によって支払われる。
(4)(a) Each of the commercial debts referred to in sub-paragraph (1) of paragraph 1 will be paid in forty-six (46) semi-annual installments beginning on September 1, 1994 in accordance with the payment schedule shown in Annex I attached hereto.
(b) (a)の規定にかかわらず、(a)の規定に従って当初の弁済期日より前に弁済期日が到来するものの実際の支払は、附属書一に掲げる支払期日であって当初の弁済期日の直後に到来するものまで延期される。
(b) Notwithstanding the provisions of (a) above, the actual payment of the debts, which should have fallen due, in accordance with (a) above, before the original due date, shall be postponed until the date of the installment shown in Annex I on or immediately after the original due date.
3(1) ホンデュラス共和国政府は、商業上の関係債務の各々について、当該債務が決済されていない限り、(2)に定めるところにより算定される利子を次の計画に従って債権者に支払う。
3.(1) The Government of the Republic of Honduras will pay to the Creditors, interest to be calculated as described in sub-paragraph (2) below on each of the commercial debts concerned to the extent that they have not been settled, in accordance with the following schedule.
(a) 最初の利子の支払は、千九百九十四年三月一日に行われる。
(a) The first payment of the interest will be made on March 1, 1994; and
(b) 最初の支払の後に引き続き行われる利子の支払は、毎年三月一日及び九月一日に行われる。
(b) The consecutive payments of interest after the first payment will be made on March 1 and September 1 each year.
(2)(a)(i) 1(1)(a)にいう債務に対して各々の当初の弁済期日から千九百九十二年九月三十日までの間(両期日を含む。)に適用される利子率は、日本円によって契約された債務については、年八パーセントとし、また、合衆国ドルによって契約された債務については、年八・二パーセントとする。
(2)(a)(i) The rate of interest on the debts referred to in (a) of sub-paragraph (1) of paragraph 1 applied for the period between each original due date and September 30, 1992, both dates inclusive, will be eight per cent (8%) per annum for the debts contracted in Japanese yen, and eight point two per cent (8.2%) per annum for the debts contracted in United States dollars.
(ii) 1(1)(a)にいう債務に対して各々の当初の弁済期日又は千九百九十二年十月一日のいずれか遅い時点から適用される利子率は、日本円によって契約された債務については、年一・七二五二パーセントとし、また、合衆国ドルによって契約された債務については、年一・八三八一パーセントとする。
(ii) The rate of interest on the debts referred to in (a) of sub-paragraph (1) of paragraph 1 applied from each original due date or October 1, 1992, whichever is the later, will be one point seven two five two per cent (1.7252%) per annum for the debts contracted in Japanese yen, and one point eight three eight one per cent (1.8381%) per annum for the debts contracted in United States dollars.
(b)(i) 1(1)(b)にいう債務に対して各々の当初の弁済期日からこの書簡の交換の日の前日までの間(両期日を含む。)に適用される利子率は、日本円によって契約された債務については、年九・一パーセントとし、また、合衆国ドルによって契約された債務については、年十・七パーセントとする。
(b)(i) The rate of interest on the debts referred to in (b) of sub-paragraph (1) of paragraph 1 applied for the period between each original due date and the previous day of the date of exchange of the present Notes, both dates inclusive, will be nine point one per cent (9.1%) per annum for the debts contracted in Japanese yen, and ten pint seven per cent (10.7%) per annum for the debts contracted in United States dollars.
(ii) 1(1)(b)にいう債務に対してこの書簡の交換の日から適用される利子率は、日本円によって契約された債務については、年一・七二五二パーセントとし、また、合衆国ドルによって契約された債務については、年一・八三八一パーセントとする。
(ii) The rate of interest on the debts referred to in (b) of sub-paragraph (1) of paragraph 1 applied from the date of exchange of the present Notes, will be one point seven two five two per cent (1.7252%) per annum for the debts contracted in Japanese yen, and one point eight three eight one per cent (1.8381%) per annum for the debts contracted in United States dollars.
(3) 支払われる利子の額は、未決済の債務の額に当該債務が決済されないままに経過した日数及び一日当たりの利子率を乗じて算定される。一日当たりの利子率は、(2)にいう利子率を三百六十五で除して算定される。前記の算定方法を算式で表したものが、この書簡の附属書二に掲げられる。
(3) The amount of interest to be paid will be calculated by multiplying the amount of the debt unsettled by the product of the number of the days the debts has not been settled and the daily interest rate. The daily interest rate is calculated by dividing the rate of interest referred to in sub-paragraph (2) above by three hundred and sixty-five (365). The illustration in the form of numerical formula of the method of calculation mentioned above is shown in the Annex II attached to this Note.
(4) ホンデュラス共和国政府は、支払計画((1)に定める利子の支払計画を含む。)上の支払が遅延した場合には、未払額から生ずる遅延利子を日本円によって契約された債務については、年九パーセントの利子率によって、また、合衆国ドルによって契約された債務については、年九・二パーセントの利子率によって支払う。
(4) In case where any payment under the Payment Scheme, including the payment schedule of interest set out in sub-paragraph (1) above, is retarded, the Government of the Republic of Honduras will pay the late interest accruing from the overdue amount at the rate of nine per cent (9%) per annum for the debts contracted in Japanese yen, and nine point two per cent (9.2%) per annum for the debts contracted in United States dollars.
(5) 支払われる利子については、ホンデュラス共和国のすべての租税及び課徴金が免除される。
(5) The interest paid will be exempted form all taxes and duties of the Republic of Honduras.
4 ホンデュラス共和国政府は、商業上の関係債務の決済のための送金に伴って生ずる銀行手数料を支払う。
4. The Government of the Republic of Honduras will pay bank charges which occur in connection with the transfer of the money for the settlement of the commercial debts concerned.
5 関係契約の条件のうちこの書簡において特に言及されていないものは、関係契約の当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。
5. It is confirmed that the terms and conditions of the contracts concerned not specifically referred to in the present Notes will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.
6 ホンデュラス共和国政府は、いずれかの第三国の居住者であって債権を有するものに対し債務救済措置について2(4)に定める条件より有利な条件を与えた場合には、当該第三国の居住者に与えられる条件より不利でない条件を債権者に直ちに与える。
6. If the Government of the Republic of Honduras accords to creditors resident in any third country terms and conditions more favourable than those referred to in sub-paragraph (4) of paragraph 2 with regard to debt relief measures, the Government of the Republic of Honduras will forthwith accord to the Creditors the terms and conditions not less favourable than those accorded to creditors resident in such third country.
7 ホンデュラスの債務(この取極が対象とする債務を含む。)の再編に関してホンデュラス共和国政府の代表者及び関係債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府とホンデュラス共和国政府との間でこの取極の継続又は修正について討議するための協議が行われる。
7. If the representative of the Government of the Republic of Honduras and the representatives of the Governments of the creditor countries concerned come to a new conclusion in connection with reorganization of the Honduran debts including the debts covered by the present arrangements, consultations will be held between the Government of Japan and the Government of the Republic of Honduras in order to discuss the matter of continuation or modification of the present arrangements.
本使は、閣下が前記の了解をホンデュラス共和国政府に代わって確認されれば幸いであります。

繰延商業債務の利子の額の算定方法の算式
Numerical formula of the method of calculation of the amount of interest on the Rescheduled Commercial Debts
I ＝ A × D × R × 1／365
I = A X D X R X 1/365
I: 利子の額
I: The amount of interest
A: 未決済の債務の額
A: The amount of the debt unsettled
D: 債務が決済されないまま経過した日数
D: The number of the days the debt has not been settled
R: 年間の利子率
R: The rate of interest (per annum)

(NOTE)
(1) 千九百九十四年三月一日における最初の利子の支払に関しては、Dは、1(1)(a)にいう債務については、各々の当初の弁済期日から、1(1)(b)にいう債務については、従前の書簡に定める弁済期日から千九百九十四年二月二十八日までの間(両期日を含む。)の日数に等しい。
(1) With respect to the first payment of the interest on March 1, 1994, D is equal to the number of the days from each original due date for the debts referred to in (a) of sub-paragraph (1) of paragraph 1, and from the due date stipulated in the Previous Notes for the debts referred to in (b) of sub-paragraph (1) of paragraph 1 to February 28, 1994, both dates inclusive.
(2) 最初の支払の後に引き続き行われる利子の支払については、Dは、当該支払に先立つ支払の日から当該支払の前日までの間(両期日を含む。)の日数に等しい。
(2) With respect to the consecutive payments of the interest after the first payment, D is equal to the number of the days from the day of the previous payment to the previous day of the payment, both dates inclusive.
