(Japanese Note)Phnom Penh, September 12, 1993Excellencies,

　書簡をもって啓上いたします。本使は、日本国とカンボディアとの間の友好関係及び経済協力を強化することを目的として行われる日本国の資機材の贈与に関して日本国政府の代表者とカンボディア暫定国民政府の代表者との間で最近到達した次の了解を確認する光栄を有します。

　I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Provisional National Government of Cambodia concerning Japanese grant of materials and equipment made with a view to strengthening the friendly relations and economic cooperation between the two countries:

1　日本国政府は、カンボディアの経済社会開発及びカンボディア国民の福祉に寄与するため、日本国の関係法令に従い、カンボディア暫定国民政府に対し、カンボディアにおける国際連合平和維持活動に携わってきた日本国の施設部隊の資機材であって、この書簡の付表に掲げるもの(以下「資機材」という。)を贈与する。

1. For the purpose of contributing to the economic and social development of Cambodia, and to the well-being of the people of Cambodia, the Government of Japan will grant to the Provisional National Government of Cambodia, in accordance with the relevant laws and regulations of Japan, the materials and equipment of the Japanese Construction Unit having been engaged in the United Nations Peace Keeping Operation in Cambodia, which are shown in the List attached hereto (hereinafter referred to as "the Materials and Equipment").

2　資機材は、適正に、かつ、専ら、カンボディアの経済社会開発及びカンボディア国民の福祉を増進するために使用される。

2. The Materials and Equipment will be used properly and exclusively for the purpose of promoting the economic and social development of Cambodia, and the well-being of the people of Cambodia.

3　カンボディア暫定国民政府は、次のことのために必要な措置をとる。

3. The Provisional National Government of Cambodia will take necessary measures:

(1)　資機材の使用のために又はそれに関連して必要なすべての経費を負担すること。

(1) to bear all the expenses necessary for or in connection with the use of the Materials and Equipment, and;

(2)　要請に応じ、日本国政府に対し、資機材の使用についての情報を提供すること。

(2) to furnish the Government of Japan, upon request, with information concerning the use of the Materials and Equipment.

4　資機材は、カンボディアから再輸出されてはならない。

4. The Materials and Equipment shall not be re-exported from Cambodia.

5　両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

5. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.

　本使は、閣下が前記の了解をカンボディア暫定国民政府に代わって確認されれば幸いであります。

　I should be grateful if Your Excellencies would confirm the foregoing understanding on behalf of the Provisional National Government of Cambodia.
