円借款の供与に関する日本国政府とタイ王国政府との間の交換公文

Bangkok, August 17, 1992
書簡をもって啓上いたします。本使は、東南アジア諸国連合の構成国の民間部門の発展及び同諸国間の域内経済協力の推進を奨励することを目的として、また、資金還流措置の下で利用される「ASEAN・日本開発ファンド」(以下「AJDF」という。)のカテゴリーB資金協力の下で供与される日本国の借款に関し、日本国政府の代表者とタイ王国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to con firm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Kingdom of Thailand concerning a Japanese loan to be extended under category B financial cooperation of the "ASEAN-Japan Development Fund" (hereinafter referred to as "the AJDF") designed to encourage the development of the private sector of the Member Countries of the Association of South East Asian Nations and the promotion of intra-regional economic cooperation of those countries and made available under the Financial Recycling Scheme:
1 三百四十三億七千五百万円(三四、三七五、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款」という。)が、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、タイ王国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of thirty-four bill ion three hundred and seventy-five million yen (34,375,000,000) (hereinafter referred to as "the Loan") will be extended to the Government of the Kingdom of Thailand by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan.
2(1) 借款は、タイ王国政府がAJDFのために策定した計画(以下「計画」という。)の下でタイ王国政府がタイ産業金融公社及びクルンタイ銀行を通じて借入人に対して行う融資に充てるために、基金とタイ王国政府との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によつて規制される。
2.(1) The Loan will be made available to cover credits to be extended by the Government of the Kingdom of Thailand to sub-borrowers through the Industrial Finance Corporation of Thailand and the Krung Thai Bank Limited under the project formed by the Government of the Kingdom of Thailand for the AJDF (hereinafter referred to as "the Project"), by loan agreements to be concluded between the Fund and the Government of the Kingdom of Thailand. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreements which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years.
(b) 利子率は、年二･五パーセントとする。
(b) The rate of interest will be two and a half (2.5) per cent per annum.
(c) 支出期間は、関係借款契約の発効の日から三年とする。
(c) The disbursement period will be three (3) years from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約は、基金が計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) The loan agreements mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the Project.
(3) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The disbursement period mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3 タイ王国政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連してタイ王国において課されるすべての財政課徴金又は租税を免除する。
3. The Government of the Kingdom of Thai land will exempt the Fund from all fiscal levies or taxes imposed in the Kingdom of Thailand on and/or in connection with the Loan as well as interest accruing therefrom.
4 タイ王国政府は、借款が適正にかつ専ら計画のために使用されることを確保するために必要な措置をとる。
4. The Government of the Kingdom of Thailand will take necessary measures to ensure that the Loan be used properly and exclusively for the Project.
5(1) タイ王国政府は、要請に応じ、日本国政府に対し、計画の進捗状況についての報告を提出する。
5.(1) The Government of the Kingdom of Thailand will, upon request, furnish the Government of Japan with reports on the progress of the Project.
(2) 両政府は、(1)にいう報告に基づいて、共同して借款の実施状況を随時検討し、必要に応じ、借款の円滑かつ効果的な使用を確保するために適当な措置をとる。
(2) The two Governments will jointly review from time to time, on the basis of the reports mentioned in sub-paragraph (1) above, the progress of the implementation of the Loan and take, if necessary, appropriate measures to secure smooth and effective utilization of the Loan.
6 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
6. The two Governments will consult with each other with respect to any matter that may arise from or in connection with this under standing.
本使は、閣下が前記の了解をタイ王国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would con firm the foregoing understanding on behalf of the Government of the Kingdom of Thailand.
本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
