円借款の供与に関する日本国政府とフィリピン共和国政府との間の交換公文

書簡をもって啓上いたします。本使は、フィリピン共和国のピナトゥボ火山災害復旧・再建計画に寄与することを目的として資金還流措置の下で供与される日本国の借款に関して日本国政府の代表者とフィリピン共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します
Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of the Philippines concerning a Japanese loan to be extended under the Financial Recycling Scheme with a view to contributing to the Program of the Republic of the Philippines for Mt. Pinatubo Disaster Rehabilitation and Reconstruction:
1 二百五十三億八千万円(二五、三八〇、〇〇〇、〇〇〇円)の額までの円貨による商品借款(以下「商品借款」という。)が、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、フィリピン共和国政府に供与されることになる。
1. A commodity loan in Japanese yen up to the amount of twenty-five billion three hundred and eighty million yen (25,380,000,000) (hereinafter referred to as "the Commodity Loan") will be extended to the Government of the Republic of the Philippines by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan.
2(1) 商品借款は、フィリピン共和国政府と基金との間で締結される借款契約に基づいて使用に供される。商品借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Commodity Loan will be made available by a loan agreement to be concluded between the Government of the Republic of the Philippines and the Fund. The terms and conditions of the Commodity Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、七年の裾置期間の後十八年とする。
(a) The repayment period will be eighteen (18) years after the grace period of seven (7) years.
(b) 利子率は、年三パーセントとする。
(b) The rate of interest will be three (3) per cent per annum.
(c) 支出期間は、借款契約の発効の日から二年とする。
(c) The disbursement period will be two (2) years from the date of coming into force of the loan agreement.
(2) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(2) The disbursement period mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 商品借款は、フィリピン共和国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う支払で、両政府の関係当局間で相互に合意する表に掲げる生産物の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。
3.(1) The Commodity Loan will be made available to cover payments already made and/or to be made to suppliers of eligible source countries by importer s in the Republic of the Philippines under such contracts as have been or may be entered into between them for purchases of such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.
(2) (1)にいう表には、両政府の関係当局間の合意によって修正を加えることができる。
(2) The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.
(3) (1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(3) The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
4(1) フィリピン共和国政府は、フィリピン共和国政府の名義でフィリピン中央銀行に開設される見返資金勘定に同銀行が商品借款の円貨による支出額に等しい額をフィリピン通貨で振り替えるようにするための措置をとる。このようにして振り替えられたフィリピン通貨は、フィリピン共和国政府のピナトゥボ火山災害復旧・再建計画に基づく事業計画の現地通貨の需要に充てるために使用されなければならない。前記のフィリピン通貨が使用される事業計画は、両政府の関係当局が別途合意するものとする。
4.(1) The Government of the Republic of the Philippines will take measures to have the equivalent in Philippine currency of the amount of yen disbursements of the Commodity Loan transferred by the Central Bank of the Philippines to the counterpart fund account opened in the name of the Government of the Republic of the Philippines in the Central Bank of the Philippines. The amount of Philippine currency thus transfer red shall be used to cover local currency requirements of the projects under the Program of the Government of the Republic of the Philippines for Mt. Pinatubo Disaster Rehabilitation and Reconstruction. The said projects for which the amount of Philippine currency mentioned above will be used, will be those separately agreed upon between the authorities concerned of the two Governments.
(2) フィリピン共和国政府は、日本国政府に対し、(1)にいう見返資金の使用についての報告を提出する。
(2) The Government of the Republic of the Philippines will furnish the Government of Japan with reports on the use of the counterpart fund mentioned in sub-paragraph (1) above.
5 フィリピン共和国政府は、3(1)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
5. The Government of the Republic of the Philippines will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
6 フィリピン共和国政府は、基金について、商品借款及びそれから生ずる利子に対して又はそれらに関連してフィリピン共和国において課されるすべての財政課徴金又は租税を免除する。
6. The Government of the Republic of the Philippines will exempt the Fund from all fiscal levies or taxes imposed in the Republic of the Philippines on and/or in connection with the Commodity Loan as well as interest accruing there from.
7(1) 両政府は、商品借款に基づいて購入される生産物の海上輸送に関し、千九百七十九年五月十日にマニラで署名された日本国とフィリピン共和国との間の友好通商航海条約に基づいて海運を発展させるために相互の協力を促進する。
7.(1) With regard to the shipping of products purchased under the Commodity Loan, the two Governments will promote mutual cooperation for the development of shipping, under the Treaty of Amity, Commerce and Navigation between Japan and the Republic of the Philippines signed at Manila on 10 May, 1979.
(2) 両政府は、商品借款に基づいて購入される生産物の海上保険に関し、それぞれの国の関係法令の範囲内で、両国の海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
(2) With regard to the marine insurance of products purchased under the Commodity Loan, the two Governments will refrain, within the scope of the relevant laws and regulations of their respective countries, from imposing any restrictions that may hinder fair and free competition between the marine insurance companies of the two countries.
8 フィリピン共和国政府は、商品借款が適正にかつ専ら3(1)にいう生産物又は役務を購入するために使用されることを確保するために必要な措置をとる。
8. The Government of the Republic of the Philippines will take necessary measures to ensure that the Commodity Loan be used properly and exclusively for purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3.
9 両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
9. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本使は、閣下が前記の了解をフィリピン共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of the Philippines.
