書簡をもって啓上いたします。本官は、インドネシア共和国の経済の安定及び開発努力を促進することを目的として供与される千九百九十二年の日本国の借款に関する千九百九十二年九月十四日付けの交換公文に言及する光栄を有します。
Excellency,I have the honour to refer to the Exchange of Notes dated September 14, l99 2 concerning Japanese loans for 1992 to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Indonesia.
本官は、更に、千九百九十二年の日本国の追加の借款に関して日本国政府の代表者とインドネシア共和国政府の代表者との間で最近行われた討議に言及するとともに、両政府の間で到達した次の了解を確認する光栄を有します。
I have further the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Republic of Indonesia regarding an additional Japanese loan for 1992, and to confirm the following understanding reached between the two Governments:
1 十七億六千五百万円(一、七六五、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款」という。)が、この書簡に附属する表(以下「付表」という。)に掲げる計画を実施するため、各計画につき付表に定める配分に応じ、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of one billion seven hundred and sixty-five million yen (1,765,000,000 ) (hereinafter referred to as "the Loan" ) will be extended in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund" ) to implement the projects enumerated in the List attached hereto (hereinafter referred to as ii the List" ) according to the allocation for each project as specified in the List.
2(1) 借款は、インドネシア共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によつて規制される。
2.(1) The Loan will be made available by loan agreements to be concluded between the Government of the Republic of Indonesia and the Fund. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreements which will contain, inter alia , the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (l0 ) years.
(b) 利子率は、年二･六パーセントとする。
(b) The rate of interest will be two and six-tenths per cent (2.6% ) per annum.
(c) 支出期間は、付表の1に掲げる計画については、関係借款契約の発効の日から三年とし、付表の2及び3に掲げる計画については、関係借款契約の発効の日から四年とする。
(c) The disbursement period will be three (3) years with regard to the project mentioned in 1, four (4) years with regard to the projects mentioned in 2 and 3 of the List from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約の各々は、基金が当該借款契約に係る計画の実行可能性(環境に対する配慮を合む。)を確認した後に締結される。
(2) Each of the loan agreements mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the project to which such loan agreement relates.
(3) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The disbursement periods mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 借款は、インドネシアの実施機関が調達適格国のコンサルタントに対して行う支払で、付表に掲げる計画の実施に必要な役務の購入のために両者の間で締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国から供給される役務について行われる。
3.(1) The Loan will be made available to cover payments to be made by Indonesian executing agencies to consultants of eligible source countries under such contracts to be entered into between them for purchases of services required for the implementation of the projects enumerated in the List , provided that such purchases are made in eligible source countries for services supplied from those countries.
(2) (1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(2) The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
(3) 借款の一部は、付表に掲げる計画の実施のための適格な現地通貨の需要に充てるために使用することができる。
(3) A part of the Loan may be used to cover eligible local currency requirements for the implementation of the projects enumerated in the List.
4 インドネシア共和国政府は、3(1)にいう役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
4. The Government of the Republic of Indonesia will ensure that services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth , inter alia, the procedures of inter national to be followed except where such procedures are inapplicable or inappropriate.
5 インドネシア共和国政府は、要請に応じ、日本国政府に対し、付表に掲げる計画の進捗状況についての報告を提出する。
5. The Government of the Republic of Indonesia will, upon request, furnish the Government of Japan with reports on the progress of the projects enumerated in the List.
6(1) インドネシア共和国政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連して課されるインドネシアの財政課徴金又は租税を免除する。
6.(1) The Government of the Republic of Indonesia will exempt the Fund from Indonesian fiscal levies or taxes on and/or in connection with the Loan as well as interest accruing therefrom.
(2) インドネシア共和国政府は、コンサルタントとして活動する日本国の会社が借款に基づいて提供する役務の供給から取得する所得に関するインドネシアのすべての財政課徴金又は租税を負担する。
(2) The Government of the Republic of Indonesia shall assume all Indonesian fiscal levies or taxes with respect to the income of Japanese companies operating as consultants accruing from the supply of services to be provided under the Loan.
(3) インドネシア共和国政府は、コンサルタントとして活動する日本国の会社の資材及び設備で付表に掲げる計画の実施のために必要なものの輸入及び再輸出に関するインドネシアのすべての関税及び関連する公課を負担する。
(3) The Government of the Republic of Indonesia shall assume all Indonesian duties and related fiscal charges with respect to the import and re-export of own materials and equipment of Japanese companies operating as consultants needed for the implementation of the projects enumerated in the List.
7 インドネシア共和国政府は、借款が適正にかつ専ら3(1)にいう役務を購入するために使用されることを確保するために必要な措置をとる。
7. The Government of the Republic of Indonesia will take necessary measures to ensure that the Loan be used properly and exclusively for purchases of services mentioned in sub- paragraph (1) of paragraph 3.
8 両政府は、共同して借款の実施の進捗状況を随時検討し、借款の円滑かつ効果的な使用を確保するために必要な措置をとり、また、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
8. The two Governments will jointly review from time to time the progress of the implementation of the Loan and take necessary measures to secure smooth and effective utilization of the Loan and otherwise consult with each other in respect of any matter that may arise from or in connection with this understanding.
本官は、閣下が前記の了解をインドネシア共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Indonesia.

書簡をもって啓上いたします。本官は、東南アジア諸国連合の構成国の民間部門の発展と同諸国間の域内経済協力の推進を奨励することを目的として、また、資金還流措置の下で利用される「ASEAN･日本開発ファンド」のカテゴリー資金協力の下でインドネシア共和国に供与される日本国の借款に関し、日本国政府の代表者とインドネシア共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency,I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Indonesia concerning a Japanese loan to be extended under category B financial cooperation of the "ASEAN-Japan Development Fund" designed to encourage the development of the private sector of the Member Countries of the Association of South East Asian Nations and the promotion of intra-regional economic cooperation of those countries and made available under the Financial Recycling Scheme:
1 百六十二億四千四百万円(一六、二四四、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款」という。)が、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of sixteen billion two hundred and forty-four million yen ( 16,244, 000, 000) (hereinafter referred to as "the Loan" ) will be extended to the Government of the Republic of Indonesia by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan.
2(1) 借款は、この書簡に附属する事業計画表に掲げる計画(以下「計画」という。)の下でインドネシア共和国政府がこの書簡に附属する取扱銀行表に掲げる十三の指定された銀行を通じて借入人に対して行う融資に充てるために、基金とインドネシア共和国政府との間に締結される借款契約に基づいて使用に供される。借款の条伴及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan will be made available to cover credits to be extended by the Government of the Republic of Indonesia to sub-borrowers through the designated 13 banks enumerated in the List of Handling Banks attached hereto under the projects enumerated in the List of Projects attached hereto (hereinafter referred to as the "Projects" ), by a loan agreement to be concluded between the Fund and the Government of the Republic of Indonesia. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia , the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (l0 ) years.
(b) 利子率は、年二･五パーセントとする。
(b) The rate of interest will be two and a half (2.5) per cent per annum.
(c) 支出期間は、関係借款契約の発効の日から五年とする。
(c) The disbursement period will be five (5) years from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約は、基金が計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) The loan agreement mentioned in sub- paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the Projects.
(3) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The disbursement period mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 借款の一部は、インドネシア共和国政府が調達適格国のコンサルタントに対して行う支払で、計画の実施に必要な役務の購入のために両者の間で締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国から供給される役務について行われる。
3. (1) A part of the Loan will be made available to cover payments to be made by the Government of the Republic of Indonesia to consultants of eligible source countries under such contracts as may be entered into between them for purchases of services required for the implementation of the Projects , provided that such purchases are made in such eligible source countries for services supplied from those countries.
(2) (1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(2) The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
4 インドネシア共和国政府は、3(1)にいう役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
4. The Government of the Republic of Indonesia will ensure that services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for Procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
5(1) インドネシア共和国政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連してインドネシア共和国において課されるすべての財政課徴金又は租税を免除する。
5. (1) The Government of the Republic of Indonesia will exempt the Fund from all fiscal levies or taxes imposed in the Republic of Indonesia on and/or in connection with the Loan as well as interest accruing therefrom.
(2) インドネシア共和国政府は、コンサルタントとして活動する日本国の会社が借款に基づいて提供する役務の供給から取得する所得に対して又はそれに関連してインドネシア共和国において課されるすべての財政課徴金又は租税を負担する。
(2) The Government of the Republic of Indonesia will assume all fiscal levies or taxes imposed in the Republic of Indonesia on Japanese companies operating as consultants on and/or in connection with any income that may accrue from the supply of services to be provided under the Loan.
(3) インドネシア共和国政府は、コンサルタントとして活動する日本国の会社の資材及び設備で計画の実施のために必要なものの輸入及び再輸出に関するインドネシアのすべての関税及び関連する公課を負担する。
(3) The Government of the Republic of Indonesia will assume all Indonesian duties and related fiscal charges with respect to the import and re-export of own materials and equipment of Japanese companies operating as consultants needed for the implementation of the projects.
6 インドネシア共和国政府は、借款が適正にかつ専ら計画のために使用されることを確保するために必要な措置をとる。
6. The Government of the Republic of Indonesia will take necessary measures to ensure that the Loan be used properly and exclusively for the Projects.
7(1) インドネシア共和国政府は、要請に応じ、日本国政府に対し、計画の進捗状況に関する報告を提出する。
7. (1) The Government of the Republic of Indonesia will, upon request, furnish the Government of Japan with reports on the progress of the Projects.
(2) 両政府は、(1)にいう報告に基づいて、共同して借款の実施の進捗状況を随時検討し、必要に応じ、借款の円滑かつ効果的な使用を確保するために適当な措置をとる。
(2) The two Governments will jointly review from time to time, on the basis of the reports mentioned in sub-paragraph (1) above, the progress of the implementation of the Loan and take, if necessary, appropriate measures to secure smooth and effective utilization of the Loan.
8 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
8. The two Governments will consult with each other with respect to any matter that may arise from or in connection with this understanding.
本官は、閣下が前記の了解をインドネシア共和国政府に代わって確認されれば幸いであります。
