円借款の供与に関する日本国政府とインド政府との間の交換公文

New Delhi, October 27, 1992
書簡をもって啓上いたします。本使は、インド政府の経済開発、構造調整及び環境改善のための努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とインド政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to confirm the follow understanding recently reached between the representatives of the Government of Japan and of the Government of India concerning Japanese loans to be extended with a view to contributing to the efforts of the Government of India for economic development and structural adjustment as well as improvement in environment:

1 七百八十八億二千三百万円(七八、八二三、〇〇〇、〇〇〇円)の額までの円貨による事業計画借款(以下「借款」という。)が、この書簡に附属する事業計画表(以下「事業計画表」という。)に掲げる計画の実施のため、各計画につき事業計画表に定める配分に応じ、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、インド政府に供与されることになる。
1. A project loan in Japanese yen up to the amount of seventy-eight billion eight hundred twenty-three million yen (78,823,000,000) (hereinafter referred to as "the Loan I") will be extended to the Government of India by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund" ) in accordance with the relevant laws and regulations of Japan for the implementation of the projects enumerated in the Project List attached hereto (hereinafter referred to as "the Project List" ), according to the allocation for each project as specified in the Project List.
2(1) 借款Iは、インド政府と基金との間で締結される借款契約に基づいて使用に供される。借款Iの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. (1) The Loan I will be made available by loan agreements to be concluded between the Government of India and the Fund. The terms and conditions of the Loan I as well as the procedures for its utilization will be governed by the said loan agreements which will contain, de An, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years.
(b) 利子率は、年二・六パーセントとする。
(b) The rate of interest will be two point six (2.6) per cent per annum.
(c) 支出期間は、事業計画表の―に掲げる計画については、関係借款契約の発効の日から七年とし、事業計画表の2に掲げる計画については、関係借款契約の発効の日から五年とし、事業計画表の3に掲げる計画については、関係借款契約の発効の日から三年とし、事業計画表の4に掲げる計画については、関係借款契約の発効の日から四年とし、事業計画表の5に掲げる計画については、関係借款契約の発効の日から六年とする。
(c) The disbursement period will be seven (7) years with regard to the project mentioned in 1 of the Project List, five (5) years with regard to the project mentioned in 2 of the Project List, three (3) years with regard to the project mentioned in 3 of the Project List, four (4) years with regard to the project mentioned in 4 of the Project List, and six (6) years with regard to the project mentioned in 5 of the Project List from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約の各々は、基金が当該借款契約に係る計画の実行可能性（環境に対する配慮を含む。）を確認した後に締結される。
(2) Each of the loan agreements mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the project to which such loan agreement relates.
3(1) 事業計画表の4及び5に掲げる計画に係る借款Iは、インドの実施機関が調達適格国の供給者、負業者又はコンサルタントに対して行う支払で、当該計画の実施に必要な生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3. (1) The Loan I for the projects mentioned in 4 and 5 of the Project List will be made available to cover payments to be made by Indian executing agencies to suppliers, contractors and/or consultants of eligible source countries under such contracts as have been or may be entered into between them for purchases of products and/or services require for the implementation of the said projects, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) 事業計画表の1、2及び3に掲げる計画に係る借款Iは、インドの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して既に行ったか又は行う支払で、当該計画の実施に必要な生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
(2) The Loan I for the projects mentioned in 1, 2 and 3 of the Project List will be made available to cover payments already made and/or to be made by Indian executing agencies to suppliers, contractors and/or consultants of eligible source countries under such contracts as have been or may be entered into between them for purchases of products and/or services required for the implementation of the said projects, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(3) 借款Iの一部は、事業計画表に掲げる計画の実施のための適桔な現地通貨の需要に充てるために使用することができる。
(3) A part of the Loan I may be used to cover eligible local currency requirements for the implementation of the projects enumerated in the Project List.
4 3(1)及び(2)にいう生産物又は役務の供給に関連してインドにおいてその役務が必要とされる日本国民は、作業の遂行のためインドヘの入国及び同国における滞在に必要な便宜を与えられる。
4. Japanese nationals whose services may be required in India in connection with the supply of products and/or services mentioned in sub-paragraphs (1) and (2) of paragraph 3 shall be accorded such facilities as may be necessary for their entry into India and stay therein for the performance of their work.

1 三百三十億八千五百万円（三三、〇八五、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款II」という。）が、基金により、石油天然ガス・セクターに関するインド政府の構造調整政策（以下「構造調整政策」という。）を支援するため、日本国の関係法令に従って、インド政府に供与されることになる。
1. A loan in Japanese yen up to the amount of thirty-three billion eighty-five million yen (33,085,000,000) (hereinafter referred to as "the Loan II" ) will be extended to the Government of India by the Fund in accordance with the relevant laws and regulations of Japan to support the structural adjustment policy of the Government of India for the hydrocarbon sector (hereinafter referred to as "the Structural Adjustment Policy").
2 借款IIは、インド政府と基金との間で締結される借款契約に基づいて使用に供される。借款IIの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. The Loan II will be made available by a loan agreement to be concluded between the Government of India and the Fund. The terms and conditions of the Loan II as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、七年の据置期間の後十八年とする。
(a) The repayment period will be eighteen (18) years after the grace period of seven (7) years.
(b) 利子率は、年二・六パーセントとする。
(b) The rate of interest will be two point six (2.6) per cent per annum.
(c) 支出期間は、前記の借款契約の発効の日から二年とする。
(c) The disbursement period will be two (2) years from the date of coming into force of the said loan agreement.
3 借款IIは、インド国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う支払で、構造調整政策の実施中に必要な生産物（両政府の関係当局間で合意する表に掲げる生産物を除く。）の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。
3. The Loan II will be made available to cover payments already made and/or to be made to suppliers of eligible source countries by importers in India under such contracts as have been or may be entered into between them for purchases of products, except such mutually agreed upon between the authorities concerned of the two Governments, required during the implementation of the Structural Adjustment Policy and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.
4(1) インド政府は、借款・の円貨による支出額に等しい額をインド通貨で使用に供し得るよう見返資金勘定を設定するための措置をとる。このようにして見返資金勘定に計上されたインド通貨は、基金が供与する円貨による借款に基づいて実施されるインド政府の開発事業計画及び両政府の関係当局が別途合意するインド政府の他の社会経済開発事業計画の現地通貨の需要に充てるために使用されなければならない。
4. (1) The Government of India will take measures to maintain a counterpart fund account for utilization of the equivalent in Indian currency of the amount of yen disbursements of the Loan II. The amount of Indian currency, thus accounted for, shall be used to cover local currency requirements of the development projects of the Government of India implemented under loans in Japanese yen by the Fund, and other economic and social development projects of the Government of India which will be separately agreed upon between the authorities concerned of the two Governments.
(2) インド政府は、要請に応じ、日本国政府に対し、(1)の規定に従つて計上された資金の額及びその使用についての報告を提出する。
(2) The Government of India will, upon request, furnish the Government of Japan with reports on the amount accounted in accordance with sub-paragraph (1) above and the utilization of the amount.

III
1 I2(1)(c)及びII2(c)にいうそれぞれの支出期間は、両政府の関係当局の同意を得て延長することができる。
1. The respective disbursement periods mentioned in sub-paragraph (1) (c), paragraph 2 of part I and sub-paragraph (c), paragraph 2 of part II may be extended with the consent of the authorities concerned of the two Governments.
2 I3(1)及び2並びにII3にいう調達適格国のそれぞれの範囲は、両政府の関係当局間で合意される。
2. The respective scopes of eligible source countries mentioned in sub-paragraphs (1) and (2), paragraph 3 of part I and paragraph 3 of part II will be agreed upon between the authorities concerned of the two Governments.
3 インド政府は、I3(1)及び(2)並びにII3にいう生産物又は役務が基金の調達のためのガイドライン（国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。）に従って調達されることを確保する。
3. The Government of India will ensure that products and/or services mentioned in sub-paragraphs (1) and (2), paragraph 3 of part I and paragraph 3 of part II are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
4 両政府は、借款I及び借款IIに基づいて購入される生産物の海上輸送及び海上保険に関し、それぞれの国の関係法令の範囲内で、両国の海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる直接又は間接の制眼も課さない。
4. With regard to the shipping and marine insurance of products purchased under the Loan I and the Loan III, the two Governments will refrain, within the scope of the relevant laws and regulations of the respective countries, from imposing, directly or indirectly, any restrictions that may hinder fair and free competition between the shipping and marine insurance companies of the two countries.
5 インド政府は、基金について、借款I及び借款II並びにそれから生ずる利子に対して又はそれらに詞連してインドにおいて課されるすべての財政課徴金又は租税を免除する。
5. The Government of India will exempt the Fund from all fiscal levies or taxes imposed in India on and/or in connection with the Loan I and the Loan II as well as interest accruing therefrom.
6 インド政府は、次のことを確保するために必要な措置をとる。
6. The Government of India will take necessary measures to ensure that:
(a) 借款Iが適正にかつ専ら事業計画表に掲げる計画のために使用されること。
(a) the Loan I be used properly and exclusively for the projects enumerated in the Project List;
(b) 借款Iに基づいて建設される施設がこの了解に定める目的のために適正にかつ効果的に維持され及び使用されること。
(b) the facilities constructed under the Loan I be maintained and used properly and effectively for the purposes prescribed in this under standing; and
(c) 借款IIが適正にかつ専らII3にいう生産物又は役務を購入するために使用されること。
(c) the Loan II be used properly and exclusively for purchases of products and/or services mentioned in paragraph 3 of part II.
7 インド政府は、要請に応じ、日本国政府及び基金に対し、事業計画表に掲げる計画及び構造調整政策の実施の進捗状況に関する情報及び資料を提供する。
7. The Government of India will, upon request, furnish the Government of Japan and the Fund with information and data concerning the progress of the implementation of the projects enumerated in the Project List and the Structural Adjustment Policy.
8 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
8. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本使は、閣下が前記の了解をインド政府に代わつて確認されれぱ幸いであります。
I should be grateful if Your Excellency would confirm the foregoing under standing on behalf of the Government of India.
