(Japanese Note)

　Cairo, January 14, 1992

　書簡をもって啓上いたします。本使は、開発途上国の債務と開発問題に関する千九百七十八年三月十一日付けの国際連合貿易開発会議第九回特別開発理事会第三会期決議一六五及び日本国とエジプト・アラブ共和国との友好協力関係を強化することを目的としてエジプト・アラブ共和国に対して行われる日本国の経済協力に関して日本国政付の代表者とエジプト・アラブ共和国政府の代表者との間で最近行われた討議に言及するとともに、次の取極を日本国政府に代わって提案する光栄を有します。

　Excellency,
  I have the honour to refer to the resolution 165 dated March 11, 1978 of the Third Part of the Ninth Special Session of the Trade and Development Board of the United Nations Conference on Trade and Development regarding debt and development problems of developing countries and to the recent discussions held between the representatives of the Government of Japan and of the Government of the Arab Republic of Egypt concerning Japanese economic cooperation to be extended to the Arab Republic of Egypt with a view to strengthening friendly and cooperative relations between the two countries, and to propose on behalf of the Government of Japan the following arrangements:

1　日本国政府は、千九百七十三年四月二十九日に実施された日本国政府とエジプト・アラブ共和国政府との間の書簡交換に従い締結された借款契約に基づくエジプト・アラブ共和国政府の債務に留意して、エジプト・アラブ共和国の経済の発展及び国民の福祉向上に寄与するために、日本国の関係法令に従い、エジプト・アラブ共和国政府に対し、五百八十五万円(五、八五○、○○○円)の贈与(以下「贈与」という。)を行う。

1. Nothing the debts of the Government of the Arab Republic of Egypt under the loan agreement concluded in accordance with the Exchange of Notes between the Government of Japan and the Government of the Arab Republic of Egypt effected on April 29, 1973, the Government of Japan will extend to the Government of the Arab Republic of Egypt, in accordance with the relevant laws and regulations of Japan, a grant of five million eight hundred fifty thousand yen (5,850,000) (hereinafter referred to as "the Grant")for the purpose of contributing to the development of the economy of the Arab Republic of Egypt and the enhancement of the welfare of its people.

2(1)　贈与及びその利子は、エジプト・アラブ共和国政府により適正にかつ専ら両政府の関係当局間で合意する表に掲げる生産物及び同生産物に付随する役務を購入するために使用される。ただし、当該生産物は、調達適格国において生産されるものとする。

2.(1) The Grant and its accrued interest will be used by the Government of the Arab Republic of Egypt properly and exclusively for the purchase of products enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments and services incidental to such products, provided that those products are produced in eligible source countries.

(2)　(1)にいう表は、両政府の関係当局間の合意により修正されることがある。

(2) The list mentioned in sub-paragraph (1)above will be subject to modifications which may be agreed upon between the authorities concerned of the two Governments.

(3)　(1)にいう調達適格国については、両政府の関係当局間で合意される。

(3) The scope of the eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.

3(1)　エジプト・アラブ共和国政府は、この取極の効力の生ずる日の後十四日以内に日本国の外国為替公認銀行に同国政府名義の円普通預金勘定(以下「勘定」という。)を開設し、かつ、勘定開設の日の後七日以内に日本国政府に対し勘定を開設するための手続を完了した旨を書面により通告する。

3.(1) The Government of the Arab Republic of Egypt will open a yen ordinary deposit account at an authorized foreign exchange bank of Japan in the name of the Government of the Arab Republic of Egypt (hereinafter referred to as "the Account") within fourteen days after the date of coming into force of the present arrangements and will notify in writing the Government of Japan of the completion of the procedure for opening the Account within seven days after the date of the opening of the Account.

(2)　勘定の目的は、4にいう日本国政府が払い込む日本円を受領すること、2(1)にいう生産物と役務の購入に必要な支払を行うこと及び両政府の関係当局が合意するその他の支払を行うことに限られる。

(2) The sole purpose of the Account is to receive the payment in Japanese yen by the Government of Japan referred to in paragraph 4 as well as to make payments necessary for the purchase of the products and services referred to in sub-paragraph (1) of paragraph 2, and such other payment as may be agreed upon by the authorities concerned of the two Governments.

4　日本国政府は、両政府の関係当局間の合意により延長されない限り3(1)にいう書面による通告の受領の日から、千九百九十二年三月三十一日までの期間に、1にいう金額を勘定に日本円で払い込むことにより、贈与を実施する。

4. The Government of Japan will execute the Grant by making payment in Japanese yen of the amount referred to in paragraph 1 to the Account during the period between the date of receipt of the written notification referred to in sub-paragraph (1) of paragraph 3 and March 31, 1991, unless the period is extended by mutual agreement between the authorities concerned of the two Governments.

5(1)　エジプト・アラブ共和国政府は、次のことのために必要な措置をとる。

5.(1) The Government of the Arab Republic of Egypt will take necessary measures:

(a)　贈与及びその利子を、贈与が実施された時から合理的な期間内に使用すること。

(a) to use the Grant and its accrued interest within a reasonable period after the Grant is executed;

(b)　2(1)にいう生産物及び役務の供与に関してエジプト・アラブ共和国において課される関税、内国税その他の財政課徴金が贈与によって負担されないことを確保すること。

(b) to ensure that customs duties, internal taxes and other fiscal levies which may be imposed in the Arab Republic of Egypt with respect to the purchase of the products and services referred to in sub-paragraph (1) of paragraph 2 shall not be borne by the Grant;

(c)　贈与に基づいて購入される生産物がエジプト・アラブ共和国の経済の発展及び国民の福祉向上のために適正にかつ効果的に維持され及び使用されることを確保すること。

(c) to ensure that the products purchased under the Grant be maintained and used properly and effectively for the development of the economy of the Arab Republic of Egypt and the enhancement of the welfare of its people; and

(d)　贈与及びその利子が3(2)の規定に従ってすべて引き出された場合又は日本国政府から要請があった場合には、遅滞なく、日本国政府に対し、勘定に関する取引についての契約書、証憑類その他の文書類の写しを添付のうえ、当該取引につき、日本国政府が受け入れることができる形式の書面による報告を行うこと。

(d) to present to the Government of Japan a report prepared in a written form acceptable to the Government of Japan on the transactions on the Account together with copies of contracts, vouchers and other documents concerning the relevant transactions without delay when the Grant and its accrued interest are completely drawn in accordance with the provisions of sub-paragraph (2) of paragraph 3 or upon request by the Government of Japan.

(2)　贈与に基づいて購入される生産物は、エジプト・アラブ共和国から再輸出されてはならない。

(2) The products purchased under the Grant shall not be re-exported from the Arab Republic of Egypt.

6　両政府は、この取極から又はこれに関連して生ずるいかなる問題についても相互に協議する。

6. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the present arrangements.

　本使は、更に、この書簡及びエジプト・アラブ共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意がその効力発生のために必要なエジプト・アラブ共和国の国内手続を完了した旨の同国政府からの書面による通告を日本国政府が受領した日、又は千九百九十二年三月一日のいずれか早く到達する日に効力を生ずることを提案する光栄を有します。

　I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Arab Republic of Egypt the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which will become effective on the date of the receipt by the Government of Japan of the written notification from the Government of the Arab Republic of Egypt of the completion of necessary domestic procedures for the entry into force of such agreement, or on March 1, 1992, whichever is earlier.

　この書簡は、ひとしく正文である日本語、アラビア語及び英語により作成され、解釈に相違がある場合には、英語の本文によるものとします。

　This Note is written in the Japanese, Arabic and English languages, each text being equally authentic, and in case of any divergences in interpretation, the English text shall prevail.

　本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

　書簡をもって啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

  I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

　本官は、更に、エジプト・アラブ共和国政府に代わって前記の取極を確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がその効力発生のために必要なエジプト・アラブ共和国の国内手続を完了した旨の同国政府からの書面による通告を日本国政府が受領した日、又は千九百九十二年三月一日のいずれか早く到達する日に効力を生ずることに同意する光栄を有します。

　I have further the honour to confirm on behalf of the Government of the Arab Republic of Egypt the foregoing arrangements and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will become effective on the date of the receipt by the Government of Japan of the written notification from the Government of the Arab Republic of Egypt of the completion of necessary domestic procedures for the entry into force of such agreement, or on March 1, 1992, whichever is earlier.
