債務救済措置に関する日本国政府とコスタ・リカ共和国政府との間の交換公文

San Jose, June 30, 1992
書簡をもって啓上いたします。本使は、千九百九十一年七月十六日にパリで開催されたコスタ・リカ共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とコスタ・リカ共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認するを光栄を有します。
Excellency, I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Costa Rica that were held on the basis of the conclusions reached during the consultations between the representatives of the Republic of Costa Rica and of the Governments of the creditor countries concerned held in Paris on July 16, 1991. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
1 債務繰延方式による債務救済措置が、日本輸出入銀行及び関係民間銀行(以下「銀行」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken by the Export-Import Bank of Japan together with the private banks concerned (hereinafter referred to as "the Banks") in accordance with the relevant laws and regulations of Japan.
2(1) 繰り延べられる債務(以下「繰延債務」という。)は、コスタ･リカ共和国政府が銀行に対して負う次の債務であつて、この書簡の付表に掲げるものから成る。
2.(1) The debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") consist of the following debts owed by the Government of the Republic of Costa Rica to the Banks, the breakdown of which is shown in the List attached hereto:
(a) 過去に繰り延べられなかった債務であって、
(a) The debts not previously rescheduled and:
(i) 千九百九十一年六月三十日以前に弁済期限が到来した未払のもの
(i) having fallen due on or before June 30, 1991 and not paid;
(ii) 千九百九十一年七月一日から千九百九十二年三月三十一日までの間(両期日を含む。)に弁済期限が到来したもの
(ii) having fallen due between July 1, 1991 and March 31, 1992, both dates inclusive.
(b) 千九百八十三年六月二十三日及び千九百八十五年六月十八日に日本国政府とコスタ・リカ共和国政府との間で交換された書簡により行われた取極に従つて繰り延べられた債務であって、千九百九十一年六月三十日以前に弁済期限が到来した未払のもの
(b) The debts previously rescheduled in accordance with the arrangements made by the Notes exchanged between the Governments of Japan and of the Republic of Costa Rica on June 23, 1983 and on June 18, 1985, having fallen due on or before June 30, 1991, and not paid.
(c) 千九百八十九年七月十一日に日本国政府とコスタ・リカ共和国政府との間で交換された書簡により行われた取極に従つて繰り延べられた債務であって、千九百九十一年六月三十日以前に弁済期限が到来した未払のもの
(c) The debts previously rescheduled in accordance with the arrangements made by the Notes exchanged between the Governments of Japan and of the Republic of Costa Rica on July 11, 1989, having fallen due on or before June 30, 1991, and not paid.
(2)(a) (1)(a)にいう債務の総額は、十二億千四百五十七万五千三百四十円(「)二四、五七五、三四〇円)になる。
(2)(a) The total amount of the debts referred to in (a) of sub-paragraph (1) above will be one billion two hundred fourteen million five hundred seventy-five thousand three hundred and forty yen (1,214,575,340).
(b) (1)(b)にいう債務の総額は、七千八十八万三千七十五円(七〇、八八三、〇七五円)になる。
(b) The total amount of the debts referred to in (b) of sub-paragraph (1) above will be seventy million eight hundred eighty-three thousand and seventy-five yen (70,883,075).
(c) (1)(c)にいう債務の総額は、十二億九千九百八十三万百六十三円二、二九九、八三〇、一六三円)になる。
(c) The total amount of the debts referred to in (c) of sub-paragraph (1) above will be one billion two hundred ninety-nine million eight hundred thirty thousand one hundred and sixty-three yen (1,299,830,163).
(3) (2)にいう総額及びこの書簡の付表は、コスタ･リカ共和国政府の関係当局及び銀行が行う最終的照合の後に日本国政府及びコスタ・リカ共和国政府の関係当局間の合意により修正されることがある。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above and the List attached hereto by agreement between the authorities concerned of the Governments of Japan and of the Republic of Costa Rica, after the final verification to be made by the authorities concerned of the Government of the Republic of Costa Rica and the Banks.
3 債務繰延べの条件は、コスタ・リカ共和国政府と銀行との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in rescheduling agreements to be concluded between the Government of the Republic of Costa Rica and the Banks, which will contain, inter alia, the following principles:
(1) 2(1)(a)にいう債務の各々は、千九百九十七年四月十五日に始まる十回の均等半年賦払によって支払われる。
(1) Each of the debts referred to in (a) of sub-paragraph (1) of paragraph 2 will be paid in ten (10) equal semi-annual installments beginning on April 15, 1997.
(2) 2(1)(b)にいう債務の各々は、千九百九十三年四月十五日に始まる四回の均等半年賦払によって支払われる。
(2) Each of the debts referred to in (b) of sub-paragraph (1) of paragraph 2 will be paid in four (4) equal annual installments beginning on April 15, 1993.
(3) 2(1)(c)にいう債務の各々は、千九百九十一年十月十五日に始まる十回の均等半年賦払によつて支払われる。
(3) Each of the debts referred to in (c) of sub-paragraph (1) of paragraph 2 will be paid in ten (10) equal semi-annual installments beginning on October 15, 1991.
(4)(a) 繰延債務に対してこの書簡の付表に掲げる各々の当初の弁済期日から千九百九十一年六月三十日までの間(両期日を含む。)に適用される利子率は、年五・七五パーセントとする。
(4)(a) The rate of interest on the Rescheduled Debts, applied for the period between each original due date mentioned in the List attached hereto and June 30, 1991, both dates inclusive, will be five point seven five Per cent (5.75%) per annum.
(b) 繰延債務に対してこの書簡の付表に掲げる各々の当初の弁済期日又は千九百九十一年七月一日のいずれか遅い時点から適用される利子率は、年四・七五パーセントとする。
(b) The rate of interest on the Rescheduled Debts applied from each original due date mentioned in the List attached hereto or July 1, 1991, whichever is the later, will be four point seven five per cent (4.75%) per annum.
本使は、閣下が前記の了解をコスタ･リカ共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing under standing on behalf of the Government of the Republic of Costa Rica.
