ブルガリア共和国に対する食糧援助に関する日本国政府と世界食糧計画との間の交換公文

(Japanese Note)

　Rome, February 22, 1991

　書簡をもって啓上いたします。本使は、ブルガリア共和国の経済再建及び日本国とブルガリア共和国との間の友好協力関係を強化することを目的として行われる日本国の経済協力に関して日本国政府(以下「政府」という。)の代表者と世界食糧計画(以下「計画」という。)の代表者との間で最近行われた協議に言及するとともに、政府が計画を通じてブルガリア共和国政府に対して供与する意向を有する無償援肋に関する次の取極を提案する光栄を有します。

　Sir,
　I have the honour to refer to the recent discuss ions held between the representatives of the Government of Japan (hereinafter referred to as "the Government") and of the World Food Programme (hereinafter referred to as "the Programme") in relation to the Japanese economic cooperation to be extended with a view to revitalization of the economy of Romania as well as to strengthening friendly and cooperative relations between the two countries, and have further the honour to propose the following arrangements concerning the grant assistance which the Government intends to extend to the Government of Romania through the Programme.

1　政府は、日本国の関係法令に従い、贈与の形で二億円(二○○、○○○、○○○円)の額(以下「贈与」という。)を計画の使用に供する。

1. The Government shall make available to the Programme, in accordance with the relevant laws and regulations of Japan, the amount of two hundred million yen (200,000,000) in the form of grant (hereinafter referred to as "the Grant").

2　政府は、贈与を、日本国の外国為替公認銀行の東京店に開設されている世界食糧計画の勘定に払い込む。贈与は、政府の関係当局と計画との間の合意によって延長されない限り、この取極が効力を生ずる日から千九百九十一年三月三十一日までの期間中に払い込まれる。

2. The Government shall make a payment of the Grant to the World Food Programme Account opened in the Tokyo office of an authorized foreign exchange bank of Japan. The Grant shall be paid during the period between the date of coming into force of the present arrangements and March 31, 1991, unless the period is extended by mutual agreement between the authority concerned of the Government and the Programme.

3　政府は、2の規定に従って払込みを行うことにより、その払込みを行った時にその払込みの金額までこの取極に基づく援助を実施したとみなされる。

3. By and upon making the payment under the preceding paragraph, the Government shall be deemed to have made the assistance under the present arrangements to the extent of the amount of such payment.

4(1)　贈与は、粉乳の購入及びこの購入に関連する費用(輸送費、保険料及び計画に対する手数料を含む。)に使用される。

4.(1) The Grant shall be used for the purchase of milk powder and for the expenditures related to such purchase, including freight, insurance and the Programme's agent fees.

(2)　粉乳の現在の価格、運貨及び保険料を考慮して、最小限一億七千九百万円(一七九、○○○、○○○円)相当の粉乳が購入され、船積みされ、ブルガリア共和国政府に引き渡されることが期待される。

(2) Taking into account the current price levels of milk powder, freight rates and insurance premium, it is anticipated that a minimum of one hundred eighty-four million yen (184.000,000) of milk powder will be purchased, shipped and delivered to the Government of Romania.

(3)　計画は、(1)にいう粉乳の購入、輸送及び保険のため、計画の財務規則に従い供給者と契約を締結する。

(3) The Programme shall enter into contracts with suppliers for the purchase of the milk powder referred to in sub-paragraph (1) above and for the shipping and insurance in accordance with the Programme's financial rules.

5　計画は、4の規定に従って購入した粉乳をできる限り速やかにブルガリア共和国政府に引き渡すために必要なすべての措置をとる。

5. The Programme shall take all the necessary measures to deliver as soon as possible the milk powder purchased under the preceding paragraph to the Government of Romania.

6　政府及び計画は、いずれか一方の要請により、この取極から又はこれに関連して生ずるいかなる事項についても相互に協議する。

6. The Government and the Programme shall consult with each other, at the request of either of them, on any matter that may arise from or in connection with the present arrangements.

7(1)　計画は、供給者と契約を締結した後、遅滞なく次の事項を政府に通報する。

7.(1) When the Programme has entered into contracts with suppliers, it shall inform the Government, without delay, of the following:

(a)　計画が契約に従って支払う総額

(a) Total amount of payments to be made by the Programme under the contract;

(b)　購入した粉乳の総額

(b) Total value of the milk powder purchased;

(c)　粉乳の数量及び品質

(c) Quantity and quality of the milk powder;

(d)　粉乳のFOB単価

(d) Unit F. O. B. price of the milk powder;

(e)　輸送費

(e) Freight costs;

(f)　保険料

(f) Insurance premium;

(g)　供給者の名称

(g) Names of the suppliers; and

(h)　船積みの予定日及び引渡地への到着の予定日

(h) Expected dates of shipment to and arrival at delivery sites.

(2)　船積み、荷揚げ及び引渡地への到着のたびに、計画は、これらの日付並びに粉乳の数量及び品質を政府に通報する。

(2) Each time a shipment is loaded or unloaded or arrives at the delivery sites, the Programme shall inform the Government of the date and the quantity and condition of the milk powder.

(3)　計画は、この取極に従って購入した粉乳の引渡しが完了した後、引渡しに関する最終報告書を、できる限り引渡地における写真を付して、政府に提出する。

(3) Upon the completion of the delivery of the milk powder purchased under the present arrangements, the Programme shall provide for the Government a final report on the delivery, if possible together with photographs taken at the delivery sites.

(4)　計画は、粉乳が日本国により贈与された旨の標示を粉乳の箱に付すことを確保する。

(4) The Programme shall ensure that markings the milk powder boxes bear indicate the milk powder has been donated by Japan.

　本使は、更に、この書簡及び前記の取極を確認される貴官の返簡が政府と計画との間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　I have further the honour to propose that the present Note and your reply confirming the foregoing arrangements shall be regarded as constituting an agreement between the Government and the Programme, which shall enter into force on the date of your reply

　書簡をもって啓上いたします。本官は、本日付けの閣下の次の者簡を受領したことを確認する光栄を有します。

　Excellency,
　I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

　本官は、更に、世界食糧計画に代わって前記の取極を確認するとともに、閣下の書簡及びこの返簡が計画と日本国政府との間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。

　I have further the honour to confirm the foregoing arrangements on behalf of the World Food Programme, and to agree that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the Programme and the Government of Japan, which shall enter into force on the date of this reply.

　本官は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
