円借款の供与に関する日本国政府とスリ・ランカ民主社会主義共和国政府との間の交換公文

Colombo, January 8, 1991
書簡をもって啓上いたします。本使は、スリ・ランカ民主社会主義共和国の経済の安定及び開発に寄与することを目的として供与される日本国の借款に関して日本国政府の代表者とスリ・ランカ民主社会主義共和国政府の代表者との間で最近到達した、次の了解を確認する光栄を有します。
Sir, I have the honour to confirm the following under standing recently reached between the representatives of the Government of Japan and of the Government of the Democratic Socialist Republic of Sri Lanka concerning Japanese loans to be extended with a view to contributing to the economic stabilization and development of the Democratic Socialist Republic of Sri Lanka:

1 二百五十二億五千三百万円(二五、二五三、○○○、○○◯円)の額までの円貨による事業計画借款(以下「借款I」という。)が、この書簡に附属する事業計画表(以下「事業計画表」という。)に掲げる計画の実施のため、各計画につき事業計画表に定める配分に応じ、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、スリ・ランカ民主社会主義共和国政府に供与されることになる。
1. A project loan in Japanese yen up to the amount of twenty-five billion two hundred and fifty-three million yen (25,253,000,000) (hereinafter referred to as "the Loan I") will be extended to the Government of the Democratic Socialist Republic of Sri Lanka by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan for the implementation of the projects enumerated in the Project List attached hereto (hereinafter referred to as "the Project List"), according to the allocation for each project as specified in the Project List.
2(1) 借款Iは、スリ・ランカ民主社会主義共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款Iの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan I will be made available by loan agreements to be concluded between the Government of the Democratic Socialist Republic of Sri Lanka and the Fund. The terms and conditions of the Loan I as well as the procedures for its utilization will be governed by the said loan agreements which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years.
(b) 利子率は、年二・五パーセントとする。
(b) The rate of interest will be two and a half (2.5) per cent per annum.
(c) 支出期間は、事業計画表の2及び3に掲げる計画については、関係借款契約の発効の日から五年とし、事業計画表の1に掲げる計画については、関係借款契約の発効の日から六年とする。
(c) The disbursement period will be five (5) years with regard to the project mentioned in 2 and 3 of the Project List, and six (6) years with regard to the project mentioned in 1 of the Project List from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約の各々は、基金が当該借款契約に係る計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) Each of the loan agreements mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the project to which such loan agreement relates.
3(1) 借款Iは、スリ・ランカの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して既に行ったか又は行う支払で、事業計画表に掲げる計画の実施に必要な生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3.(1) The Loan I will be made available to cover payments already made and/or to be made by Sri Lankan executing agencies to suppliers, contractor s and/or consultants of eligible source countries under such contracts as have been or may be entered into between them for purchases of products and/or services required for the implementation of the projects enumerated in the Project List, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) 借款Iの一部は、事業計画表の1及び2に掲げる計画の実施のための適格な現地通貨の需要に充てるために使用することができる。
(2) A part of the Loan I may be used to cover eligible local currency requirements for the implementation of the projects mentioned in 1 and 2 of the Project List.
4 3(1)にいう生産物又は役務の供給に関連してスリ・ランカ民主社会主義共和国においてその役務が必要とされる日本国民は、作業の遂行のためスリ・ランカ民主社会主義共和国ヘの入国及び同国における滞在に必要な便宜を与えられる。
4. Japanese nationals whose services may be required in the Democratic Socialist Republic of Sri Lanka in connection with the supply of Products and/or services mentioned in sub-Paragraph (1) of paragraph 3 shall be accorded such facilities as may be necessary for their entry into the Democratic Socialist Republic of Sri Lanka and stay therein for the performance of their work.

1 百三十一億円(一三、一○○、○○○、○○○円)の額までの円貨による借款(以下「借款II」という。)が、スリ・ランカ民主社会主義共和国政府の経済構造改善計画(以下「経済構造改善計画」という。)を支援するため、資金還流措置の下で、基金により、日本国の関係法令に従って、スリ・ランカ民主社会主義共和国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of thirteen billion one hundred mill ion yen (13,100,000,000) (hereinafter referred to as "the Loan II") will be extended under the Financial Recycling Scheme to the Government of the Democratic Socialist Republic of Sri Lanka by the Fund in accordance with the relevant laws and regulations of Japan to support the Economic Restructuring Program of the Government of the Democratic Socialist Republic of Sri Lanka (hereinafter referred to as "the Economic Restructuring Program").
2 借款IIは、スリ・ランカ民主社会主義共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款IIの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. The Loan II will be made available by a loan agreement to be concluded between the Government of the Democratic Socialist Republic of Sri Lanka and the Fund. The terms and conditions of the Loan II as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、七年の据置期間の後十八年とする。
(a) The repayment period will be eighteen (18) years after the grace period of seven (7) years.
(b) 利子率は、年二・五パーセントとする。
(b) The rate of interest will be two and a half (2.5) per cent per annum.
(c) 支出期間は、前記の借款契約の発効の日から二年とする。
(c) The disbursement period will be two (2) years from the date of coming into force of the said loan agreement.
3 借款IIは、スリ・ランカ民主社会主義共和国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う支払で、経済構造改善計画の実施中に必要な生産物の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。
3. The Loan II will be made available to cove suppliers of eligible source countries by importers in the Democratic Socialist Republic of Sri Lanka under such contracts as have been or may be entered into between them for purchases of products required during the implementation of the Economic Restructuring Program and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
4(1) スリ・ランカ民主社会主義共和国政府は、スリ・ランカ民主社会主義共和国政府の名義でスリ・ランカ中央銀行に開設される見返資金勘定に同銀行が借款Ⅱの円貨による支出額に等しい額をスリ・ランカ通貨で振り替えるようにするための措置をとる。このようにして振り替えられたスリ・ランカ通貨は、基金が供与する円貨による借款に基づいて実施されるスリ・ランカ民主社会主義共和国政府の開発事業計画及びスリ・ランカ民主社会主義共和国政府の他の開発事業計画の現地通貨の需要に充てるために使用されなければならない。
4.(1) The Government of the Democratic Socialist Republic of Sri Lanka will take measures to have the equivalent in Sri Lankan currency of the amount of yen disbursements of the Loan II transferred by the Central Bank of Sri Lanka to the counterpart fund account opened in the name of the Government of the Democratic Socialist Republic of Sri Lanka in the Central Bank of Sri Lanka. The amount of Sri Lankan currency thus transferred shall be used to cover local currency requirements of the development projects of the Government of the Democratic Socialist Republic of Sri Lanka implemented under loans in Japanese yen by the Fund and other development projects of the Government of the Democratic Socialist Republic of Sri Lanka.
(2) スリ・ランカ民主社会主義共和国政府は、要請に応じ、日本国政府に対し、(1)にいう見返資金の使用についての報告を提出する。
(2) The Government of the Democratic Socialist Republic of Sri Lanka will, upon request, furnish the Government of Japan with reports on the use of the counterpart fund mentioned in sub-paragraph (1) above.

III
1 I2(1)(c)及びII2(c)にいうそれぞれの支出期間は、両政府の関係当局の同意を得て延長することができる。
1. The respective disbursement periods mentioned in sub-Paragraph (1) (c), paragraph 2 of part I and sub-paragraph (c), paragraph 2 of part II may be extended with the consent of the authorities concerned of the two Governments.
2 I3(1)及びII3にいう調達適格国のそれぞれの範囲は、両政府の関係当局間で合意される。
2. The respective scopes of eligible source countries mentioned in sub-paragraph (1), paragraph 3 of part I and paragraph 3 of part II will be agreed upon between the authorities concerned of the two Governments.
3 スリ・ランカ民主社会主義共和国政府は、I3(1)及びII3にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
3. The Government of the Democratic Socialist Republic of Sri Lanka will ensure that products and/or services mentioned in sub-paragraph (1), paragraph 3 of Part I and paragraph 3 of part II are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
4 スリ・ランカ民主社会主義共和国政府は、借款I及び借びIIに基づいて購入される生産物の海上輸送及び海上保険に関し、両国の海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
4. with regard to the shipping and marine insurance of products purchased under the Loan I and the Loan II, the Government of the Democratic Socialist Republic of Sri Lanka will refrain from imposing any restrictions that may hinder fair and free competition between the shipping and marine insurance companies of the two countries.
5 スリ・ランカ民主社会主義共和国政府は、基金について、借款I及び借款II並びにそれらから生ずる利子に対して又はそれらに関連してスリ・ランカ民主社会主義共和国において課されるすべての財政課徴金又は租税を免除する。
5. The Government of the Democratic Socialist Republic of Sri Lanka will exempt the Fund from all fiscal levies or taxes imposed in the Democratic Socialist Republic of Sri Lanka on and/or in connection with the Loan I and the Loan II as well as interest accruing therefrom
6 スリ・ランカ民主社会主義共和国政府は、次のことを確保するために必要な措置をとる。
6. The Government of the Democratic Socialist Republic of Sri Lanka will take necessary measures to ensure that:
(a) 借款I及び借款IIが適正にかつ専らI3(1)及びII3のそれぞれにいう生産物又は役務を購入するために使用されること。
(a) the Loan I and the Loan II be used properly and exclusively for purchases of products and/or services mentioned respectively in sub-paragraph (1), paragraph 3 of part 1 and paragraph 3 of part II; and
(b) 借款Iに基づいて建設される施設がこの了解に定められた目的のために適正にかつ効果的に維持され及び使用されること。
(b) the facilities constructed under the Loan I be maintained and used properly and effectively for the purposes prescribed in this under standing.
7 スリ・ランカ民主社会主義共和国政府は、要請に応じ、日本国政府及び基金に対し、事業計画表に掲げる計画及び経済構造改善計画の実施の進捗状況に関する情報及び資料を提供する。
7. The Government of the Democratic Socialist Republic of Sri Lanka will, upon request, furnish the Government of Japan and the Fund with information and data concerning the progress of the implementation of the projects enumerated in the Project List and the Economic Restructuring Program.
8 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
8. The two Governments will consult with each other in respect of any matter that may arise from or in connection with this understanding.
本使は、貴官が前記の了解をスリ・ランカ民主社会主義共和国政府に代わって確認されれば幸いであります。
I should be grateful if you would confirm the foregoing understanding on behalf of the Government of the Democratic Socialist Republic of Sri Lanka.
