円借款の供与に関する日本国政府とインド政府との間の交換公文

New Delhi, June 11, 1991
書簡をもって啓上いたします。本使は、インドの経済開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とインド政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of India concerning a Japanese loan to be extended with a view to promoting the economic development efforts of India:
1 二百二億五千六百万円(二○、二五六、○○○、○○○円)の額までの円貨による借款(以下「借款」という。)が、小企業育成計画(第三期)(以下「計画」という。)の実施のため、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、インド政府に供与されることになる。
1. A loan in Japanese yen up to the amount of twenty billion two hundred and fifty-six million yen (20,256,000,000) (hereinafter referred to as "the Loan") will be extended to the Government of India by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan for the implementation of the Small Scale Industries Development Program (III) (hereinafter referred to as "the Program").
2(1) 借款は、インド政府と基金との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan will be made available by a loan agreement to be concluded between the Government of India and the Fund. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years.
(b) 利子率は、年二・六パーセントとする。
(b) The rate of interest will be two point six (2.6) per cent per annum.
(c) 支出期間は、前記の借款契約の発効の日から二年とする。
(c) The disbursement period will be two (2) years from the date of coming into force of the said loan agreement.
(2) (1)にいう借款契約は、基金が計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) The loan agreement mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including environmental consideration, of the Program.
(3) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The disbursement period mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3 借款は、計画に基づきインド小企業開発銀行が借入人に対して既に行ったか又は行う融資に充てるために使用に供される。
3. The Loan will be made available to cover credits already extended or to be extended by the Small Industries Development Bank of India to the sub-borrower s under the Program.
4 インド政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連してインドにおいて課されるすべての財政課徴金又は租税を免除する。
4. The Government of India will exempt the Fund from all fiscal levies or taxes imposed in India on and/or in connection with the Loan as well as interest accruing therefrom.
5 インド政府は、借款が適正にかつ専ら計画のために使用されることを確保するために必要な措置をとる。
5. The Government of India will take necessary measures to ensure that the Loan be used properly and exclusively for the Program.
6 インド政府は、要請に応じ、日本国政府及び基金に対し、計画の実施の進捗状況に関する情報及び資料を提供する。
6. The Government of India will, upon request, furnish the Government of Japan and the Fund with information and data concerning the progress of the implementation of the Program.
7 両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
7. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本使は、閣下が前記の了解をインド政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of India.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
