円借款の供与に関する取極の修正に関する日本国政府とブラジル連邦共和国政府との間の交換公文

Brasilia, December 6, 1991
書簡をもって啓上いたします。本大臣は、ブラジル連邦共如国と日本国との間の友好関係及び経済協力を強化することを目的として供与される日本国の借款に関する千九百八十一年十一月五日付けの交換公文(以下「従前の書簡」という。)に関し、ブラジル連邦共和国政府の代表者と日本国政府の代表者との間で最近到達した次の了解をブラジル連邦共和国政府に代わって確認する光栄を有します。
Excellency, With reference to the Exchange of Notes dated November 5, 1981, concerning a Japanese loan to be extended with a view to strengthening the friendly relations and the economic cooperation between the Federative Republic of Brazil and Japan (hereinafter referred to as lithe Notes"). I have the honour to confirm, on behalf of the Government of the Federative Republic of Brazil, the following under standing recently reached between the representatives of the Government of the Federative Republic of Brazil and of the Government of Japan:
1 従前の書簡1を次のように改める。
1. Paragraph 1 of the Notes shall be amended as follows:
「ブラジル港湾公社ポルトブラス(以下「ポルトブラス」という。)」及び「港湾整備計画(以下「計画」という。)」を「ブラジル連邦共和国の国営企業(以下「ブラジル側の借入人」という。)」及び「プライア・モーレ港建設計画、ヴィラ・ド・コンデ港建設計画及び浚渫船購入計画(以下「諸計画」という。)」にそれぞれ改める。
The terms "the Empresa de Portos do Brazil S/A--Portobras (hereinafter referred to as "PORTOBRAS")" and "the Port Improvement Project (hereinafter referred to as "the Project")" are deleted and replaced respectively by the terms "the state enterprises of the Federative Republic of Brazil (hereinafter referred to as "the Brazilian Borrowers")" and "the Praia Mole Port Construction Project, the Vila Do Conde Port Construction Project and the Dredgers Procurement Project (hereinafter refer red to as "the Projects")".
2 従前の書簡2を次のように改める。
2. Paragraph 2 of the Notes shall be deleted and replaced by the following:
2(1) 借款は、ブラジル側の借入人と基金との間で締結される関係する借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によつて規制される。
"2.(1) The Loan will be made available by loan agreements to be concluded between the Brazilian Borrowers and the Fund. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreements which will contain, inter alia, the following principles:
(a) 償還期間は、五年の据置期間の後十二年とする。
(a) The repayment period will be twelve (12) years after the grace period of five (5) years.
(b) 利子率は、年五・七五パーセントとする。
(b) The rate of interest will be five and three quarters (5. 75) per cent per annum.
(c) 支出期間は、関係する借款契約の署名の日から五年とする。
(c) The disbursement period will be five (5) years from the date of the signing of the loan agreements.
(2) (1)にいう借款契約は、基金が諸計画の実行可能性を確認した後に締結される。
(2) The loan agreements mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility of the Projects.
(3) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The disbursement period mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments."
3 従前の書簡4(1)及び(3)の「計画」を「諸計画」にそれぞれ改める。
3. Sub-paragraphs (1) and (3) of paragraph 4 of the Notes shall be amended respectively by deleting the term "the Project" and replacing it by the term "the Projects".
4 従前の書簡5の「ポルトブラス」を「ブラジル側の借入人」に改める。
4. Paragraph 5 of the Notes shall be amended by deleting the term "PORTOBRAS" and replacing it by the term "the Brazilian Borrowers".
5 従前の書簡9の「計画」を「諸計画」に改める。
5. Paragraph 9 of the Notes shall be amended by deleting the term "the Project" and replacing it by the term "the Projects".
本大臣は、閣下が前記の了解を日本国政府に代わつて確認されれば幸いであります。
I should be grateful if Your Excellency would be good enough to confirm, on behalf of the Government of Japan, the understanding set out above.
本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
