書簡を持って啓上いたします。本官は、ニカラグァ共和国における食糧生産の増大及び日本国とニカラグァ共和国との間の有効協力関係を強化することを目的として行われる日本国の経済協力に関して日本国政府(以下｢政府」という。)の代表者と世界食糧計画(以下｢計画」という。)の代表者との間で最近行われた協議に言及するとともに、政府が計画を通じてニカラグア共和国政府に対して供与する意向を有する無償援助に関する次の取極を提案する光栄を有します。
Sir, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan (hereinafter referred to as "the Government") and of the world Food Programme (hereinafter referred to as "the Programme") in relation to the Japanese economic cooperation to be extended with a view to the increase of food production in the Republic of Nicaragua as well as to strengthening friendly and cooperative relations between the two countries, and have further the honour to propose the following arrangements concerning the grant assistance which the Government intends to extend to the Government of the Republic of Nicaragua through the Programme.
1 政府は、日本国の関係法令に従い、三億円(三〇〇、〇〇〇、〇〇〇円)を贈与の形で計画の使用に供する。
1. The Government shall make available to the Programme, in accordance with the relevant laws and regulations of Japan, the amount of three hundred million yen (300,000,000) in the form of grant.
2 政府は、日本国の外国為替公認銀行の東京店に開設されている計画の勘定に、1に定める額を日本円で払い込む。この額は、政府の関係当局と計画との間の合意によって延長されない限り、この取極が効力を生ずる日から千九百九十年三月三十一日までの期間中に払い込まれる。
2. The Government shall make a payment of the amount referred to in paragraph 1 in Japanese yen to the Programme's account opened in the Tokyo office of an authorized foreign exchange bank of Japan. This amount shall be paid during the period between the date of coming into force of the presents arrangements and March 31, 1990, unless the period is extended by mutual agreement between the authorities concerned of the Government and the Programme.
3 政府は、2の規定に従って払込みを行うことにより、その払込みを行った時にその払込みの金額までこの取極に基づく援助を実施したとみなされる。
3. By and upon making the payment under the preceding paragraph, the Government shall be deemed to have made the assistance under the present arrangements to the extent of the amount of such payment.
4(1) 1に定める総額は、調達適格国の肥料の購入及びこの購入に関連する費用(輸送費、保険料及び計画に対する手数料を含む。)に使用される。
4.(1) The total amount referred to in paragraph 1 above shall be used for the purchase of fertilizer of the eligible source countries and for the expenditures related to such purchase, including freight, insurance and the Programme's agency fees.
(2) (1)にいう調達適格国の範囲は、政府の関係当局と計画との間で合意される。
(2) The scope of the eligible source countries referred to in sub-paragraph (1) above will be agreed upon between the authorities concerned of the Government and the Programme.
(3) 計画は、(1)にいう肥料の購入、輸送及び保険のため、計画の財務規則に従い供給者と契約を締結する。
(3) The Programme shall enter into contracts with suppliers for the purchase of the fertilizer referred to in sub-paragraph (1) above and for the shipping and insurance in accordance with the Programme's financial and procurement rules.
5 計画は、4の規定に従って購入した肥料をできる限り速やかにニカラグァ共和国政府に引き渡すために必要なすべての措置をとる。
5. The Programme shall take all necessary measures to deliver as soon as possible the fertilizer purchased under the preceding paragraph to the Government of the Republic of Nicaragua.
6 政府及び計画は、いずれか一方の要請により、この取極から又はこれに関連して生ずるいかなる事項についても、相互に協議する。
6. The Government and the Programme shall consult with each other, at the request of either of them, on any matter that may arise from or in connection with the present arrangements.
7(1) 計画は、供給者と契約を締結した後、停滞なく次の事項を政府に通報する。
7.(1) When the Programme has entered into a contract with suppliers, it shall inform the Government, without delay, of the following:
(a) 計画が契約に従って支払う総額
(a) Total amount of payments to be made by the Programme under the contract;
(b) 購入した肥料の総額
(b) Total value of the fertilizer purchased;
(c) 肥料の数量及び品質
(c) Quantify and quality of the fertilizer;
(d) 肥料のFOB単価
(b) Unit F.O.B. price of the fertilizer;
(e) 輸送費
(e) Freight costs;
(f) 保険料
(f) Insurance premium;
(g) 供給者の名称
(g) Names of the suppliers; and
(h) 船積みの予定日及び引渡地への到着の予定日
(h) Expected dates of loading to and arrival at delivery sites.
(2) 船積み、荷揚げ及び引渡地への到着のたびに、計画は、これらの日付並びに肥料の数量及び品質を政府に通報する。
(2) Each time a shipment is loaded aboard or unloaded or arrives at the delivery sites, the Programme shall inform the Government of the date and the quantity and condition of the fertilizer.
(3) 計画は、この取極に従って購入した肥料の引渡が完了した後、引渡しに関する最終報告書を政府に提出する。
(3) Upon the completion of the delivery of the fertilizer purchased under the present arrangements, the Programme shall submit to the Government a final report on the delivery.
本官は、更に、この書簡及び前記の取極を確認される貴官の返簡が政府と計画との間の合意を構成するものとみなし、その合意が貴官の返還の日付の日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that the present Note and your reply confirming the foregoing arrangements shall be regarded as constituting an agreement between the Government and the Programme, which shall enter into force on the date of your reply.
本官は、以上を申し進めるに際し、ここに貴官に向かって敬意を表します。

本官は、更に、世界食糧計画に代わって前記の取極を確認するとともに、期間の書簡及びこの返還が計画と日本国政府との間の合意を構成するものとみなし、その合意がこの返還の日付の日に効力を生ずることに同意する光栄を有します。
I have further the honour to confirm the foregoing arrangements on behalf of the World Food programme, and to agree that your Note and this reply shall be regarded as constituting an agreement between the World Food Programme and the Government of Japan, which shall enter into force on the date of this reply.
