書簡をもって啓上いたします。本官は、近東におけるパレスチナ難民のための国際連合救済事業機関(以下「機関」という。)事務局長から日本国政府(以下「政府」という。)に対して行われたパレスチナ難民の深刻な困窮に対する援助の要請に応じて政府の代表者と機関の代表者との間で最近行われた協議に言及するとともに、千九百八十六年の食糧援助規約に関連して日本国が機関に対し行う援助の内容及び方式に関する次の取極を政府に代わって提案する光栄を有します。
Excellency, I have the honour to refer to the recent discuss ions held between the representative of the Government of Japan (hereinafter referred to as "the Government") and the United Nations Relief and Works Agency for the Palestine Refugees in the Near East (herein-after referred to as "the UNRWA") in response to the request by the Commissioner-General of the UNRWA to the Government to help meet the serious need of the Palestine refugees and have further the honour to propose on behalf of the Government the following arrangements concerning the contents and modality of the Japanese assistance to be extended to the UNRWA in connection with the Food Aid Convention, 1986:
1 政府は、日本国の関係法令に従い、機関に対し、七億六千六百万円(七六六、〇〇〇、〇〇〇円)を限度とする額の贈与(以下「贈与」という。)を行う。
1. The Government will extend to the UNRWA, in accordance with the relevant laws and regulations of Japan, a grant up to seven hundred and sixty--six million yen (766,000,000) (hereinafter referred to as "the Grant").
2 贈与は、政府の関係当局と機関との間の合意によって延長されない限り、この取極の効力発生の日から千九百九十年三月三十一日までの期間に使用に供される。
2. The Grant will be made available during the period between the date of coming into force of the present arrangements and March 31, 1990, unless the period is extended by mutual agreement between the authorities concerned of the Government and the UNRWA.
3 贈与は、機関により米国産小麦粉及びその海上輸送に必要な役務(保険を含む。以下「役務」という。)を購入するために使用される。
3. The Grant will be used by the UNRWA for the purchase of American flour and services, including insurance, necessary for the shipping of the flour (hereinafter referred to as "services").
4 米国産小麦粉及び役務の現在の価格を考慮して、FOB価格で最小限五億百万円(五〇一、〇〇〇、〇〇〇円)相当の米国産小麦粉が購入され、船積みされ、パレスチナ難民に引き渡されることが期待される。
4. Taking into account the current price of American flour and services, it is expected that a minimum of five hundred and one million yen (501,000,000) F. O. B. of American flour will be purchased, shipped and delivered to the Palestine refugees.
5 機関又はその指定する代理人は、3にいう小麦粉及び役務を購入するため、日本国民と円貨建ての契約を締結する。この契約は、贈与の対象として適格であることが政府により認証されなければならない。(日本国民という語は、この取極の中で用いるときはいつでも、日本国の自然人又はその支配する日本国の法人を意味する。)
5. The UNRWA or its designated agent will enter into contracts in Japanese yen with Japanese nationals for the purchase of the flour and the services referred to in paragraph 3 above. Such contracts shall be verified by the Government to be eligible for the Grant. (The term Japanese nationals whenever used in the present arrangements means Japanese physical persons or Japanese juridical persons controlled by Japanese physical persons.)
6(1) 政府は、5の規定に従って認証された契約(以下「認証された契約」という。)に基づいて機関又はその指定する代理人が負う債務の弁済に充てるための資金を、機関又はその指定する代理人によって指定される日本国の外国為替公認銀行(以下「銀行」という。)に開設される機関名義の勘定に日本円で払い込むことにより、贈与を実施する。
6. (1) The Government will execute the Grant by making payments in Japanese yen to cover the obligations incurred by the UNRWA or its designated agent under the contracts verified in accordance with the Provisions of paragraph 5 (hereinafter referred to as "the Verified Contracts") to an account to be opened in the name of the UNRWA in an authorized foreign exchange bank of Japan designated by the UNRWA or its designated agent (hereinafter referred to as "the Bank").
(2) (1)にいう払込みは、機関又はその指定する代理人が発行する支払授権書に基づいて銀行が支払請求書を政府に提出した時に行われる。
(2) The payments referred to in sub-paragraph (1) above will be made when payment requests are presented by the Bank to the Government under an authorization to Pay issued by the UNRWA or its designated agent.
(3) (1)にいう勘定の目的は、政府が払い込む日本円を受領すること及び認証された契約の当事者たる日本国民に対する支払を行うことに限られる。勘定の貸記及び借記に関する手続細目は、銀行と機関又はその指定する代理人との間の協議により合意される。
(3) The sole purpose of the account referred to in sub-paragraph (1) above is to receive the payments in Japanese yen by the Government and to pay to the Japanese nationals who are parties to the Verified Contracts. The procedural details concerning the credit to and debit from the account will be agreed upon through Consultation between the Bank and the UNRWA or its designated agent.
7 機関は、4にいう小麦粉の輸送のために必要なすべての経費(この贈与によって負担されるものを除く。)を負担する。
7. The UNRWA will bear all the expenses, other than those to be borne by the Grant, necessary for the transportation of the flour refer red to in paragraph 4.
8 この取極の実施のための手続細目は、政府の関係当局と機関との間で協議により合意するものとする。
8. Further procedural details for the implementation of the present arrangements will be agreed upon through consultation between the authorities concerned of the Government and the UNRWA.
9 政府及び機関は、この取極から又はこれに関連して生ずるいかなる事項についても、相互に協議する。
9. The Government and the UNRWA will consult with each other in respect of any matter that may arise from or in connection with the present arrangements.
本官は、更に、この書簡及び機関に代わって前記の取極を確認される閣下の返簡が政府と機関との間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency Is Note in reply confirming on behalf of the UNRWA the foregoing arrangements shall be regarded as constituting an agreement between the Government and the UNRWA, which will enter into force on the date of Your Excellency's rep1y.

本官は、更に、近東におけるパレスチナ難民のための国際連合救済事業機関に代わって前記の取極を確認するとともに、貴官の書簡及びこの返簡が日本国政府と機関との間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。
I have further the honour to confirm the foregoing arrangements on behalf of the United Nations Relief and Works Agency for the Palestine Refugees in the Near East and to agree that your Note and this Note shall be regarded as constituting an agreement between the Government of Japan and the UNRWA, which will enter into force on the date of this reply.
