Warsaw, March 28,1990
書簡をもって啓上いたします。本官は、ポーランド共和国の経済再建及び日本国とポーランド共和国との間の友好協力関係を強化することを目的)として行われる日本国の経済協力に関して日本国政府の代表者とポーランド共和国政府の代表者との間で最近行われた協議に言及するとともに、日本国政府が世界食糧計画(以下「計画」という。)を通じてポーランド共和国政府に対して供与する意向を有する無償援助に関する次の取極を提案する光栄を有します。
Sir, I have the honour to refer to the recent discuss ions held between the representatives of the Government of Japan and of the Government of the Republic of Poland in relation to the Japanese economic cooperation to be extended with a view to revitalization of the economy of the Republic of Poland as well as to strengthening friendly and cooperative relations between the two countries, and have further the honour to propose the following arrangements concerning the grant assistance which the Government of Japan intends to extend to Government of the Republic of Poland through the World Food Programme (hereinafter referred to as "the Programme").
1 日本国政府は、日本国の関係法令に従い、贈与の形の二十億八千万円(二、〇八〇、〇〇〇、〇〇〇円)の額(以下「贈与」という。)をハンガリー産又は米国産小麦の購入のため計画の使用に供することによって、ポーランド共和国政府に対して経済協力を行う。贈与の詳細は、日本国政府と計画との間の取極により規定される。
1. The Government of Japan will extend the economic cooperation to the Government of the Republic of Poland by making available to the Programme, in accordance with the relevant laws and regulations of Japan, the amount of two billion eighty million yen (2,080,000,000) in the form of grant for the purchase of Hungarian and/or American wheat (hereinafter referred to as "the Grant"). Details on the Grant will be stipulated by the agreement between the Government of Japan and the Programme.
2(1) ポーランド共和国政府は、次のことのために必要な措置をとる。
2. (1) The Government of the Republic of Poland will take necessary measures:
(a)贈与に基づいて購入されるハンガリー産又は米国産小麦のポーランド共和国内での荷揚げ及び通関並びに国内輸送が速やかに行われることを確保すること。
(a) to ensure prompt unloading and customs clearance in the Republic of Poland and prompt internal transportation therein of the Hungarian and/or American wheat purchased under the Grant;
(b)贈与に基づいて購入される小麦がポーランド共和国の経済再建に対し効果的に貢献することを確保すること。
(b) to ensure that the wheat purchased under the Grant will make effective contribution to the economic revitalization of the Republic of Poland; and
(c)贈与の実施のために必要なすべての経費(贈与によって負担されるものを除く。)を負担すること。
(c) to bear all the expenses, other than those covered by the Grant, necessary for the execution of the Grant.
(2) 贈与に基づいて購入された小麦は、ポーランド共和国から再輸出されてはならない。
(2) The wheat purchased under the Grant shall not be re-exported from the Republic of Poland.
3(1) ポーランド共和国政府は、少なくとも、贈与に基づき購入されたハンガリー産又は米国産小麦の価額に相当する額を同国政府の名義で食糧経済銀行に開設される勘定にポーランド共和国の通貨で積み立てる。積立ては、小麦が世界食糧計画によりポーランド共和国政府に引き渡された後二箇月以内に行われる。
3. (1) The Government of the Republic of Poland will deposit in Polish currency at least an amount equivalent to the value of the Hungarian and/or American wheat purchased under the Grant in an account to be opened in its name in the Bank of Food Economy. The deposit shall be made within the period of two months after the delivery of the wheat by the Programme to the Government of the Republic of Poland.
(2) このようにして積み立てられた通貨は、ポーランド共和国における経済再建の目的のために利用される。
(2) The currency thus deposited shall be utilized for economic revitalization purposes in the Republic of Poland.
(3) 両政府の関係当局は、積み立てられた通貨の利用について相互に協議する。
(3) The authorities concerned of the two Governments will consult with each other about the utilization of the currency deposited.
4 ポーランド共和国政府は、贈与に基づき購入された小麦の配布が完了した後、配布に関する報告書を日本国政府に提出する。
4. Upon the completion of the distribution of the wheat purchased under the Grant, the Government of the Republic of Poland will submit to the Government of Japan a report on the distribution.
5 この取極の実施に関する手続細目は、両政府の関係当局間の協議により合意される。
5. Further procedural details for the implementation of the present arrangements will be agreed upon through consultation between the authorities concerned of the two Governments.
6 両政府は、この取極から又はこれに関連して生ずるいかなる問題についても相互に協議する。
6. The two Governments will consult with other in respect of any matter that may from or in connection with the present arrangements.
本官は、更に、この書簡及びポーランド共和国政府に代わって前記の取極を確認される貴官の返簡が両政府間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that this Note and your Note in reply confirming on behalf of the Government of the Republic of Poland the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of your reply.

I have further the honour to confirm on behalf of the Government of the Republic of Poland the foregoing arrangements and to agree that your Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.
