食糧増産援助に関する日本国政府とニカラグァ共和国政府との間の交換公文

(Japanese Note)

　Managua, March 27, 1990

　書簡をもって啓上いたします。本使は、ニカラグァ共和国における食糧生産の増大及び日本国とニカラグァ共和国との間の友好協力関係を強化することを目的として行われる日本国の経済協力に関して日本国政府の代表者とニカラグァ共和国政府の代表者との間で最近行われた協議に言及するとともに、日本国政府が世界食糧計画(以下「計画」という。)を通じてニカラグァ共和国政府に対して供与する意向を有する無償援助に関する次の取極を提案する光栄を有します。

　 Excellency
  I have the honour to refer to the recent discuss ions held between the representative of the Government of Japan and of the Government of the Republic of Nicaragua in relation to the Japanese economic cooperation to be extended with a view to the increase of food production in the Republic of Nicaragua as well as to strengthening friendly and cooperative relations between the two countries, and have further the honour to propose the following arrangements concerning the grant assistance which the Government of Japan intends to extend to the Government of the Republic of Nicaragua through the World Food Programme (hereinafter referred to as "the Programme").

1　日本国政府は、日本国の関係法令に従い、贈与の形の三億円(三〇〇、〇〇〇、〇〇〇円)の額(以下「贈与」という。)を肥料の購入のため計画の使用に供することによって、ニカラグァ共和国政府に対して経済協力を行う。贈与の詳細は、日本国政府と計画との間の取極により規定される。

1. The Government of Japan will extend the economic cooperation to the Government of the Republic of Nicaragua by making available to the Programme, in accordance with the relevant laws and regulations of Japan, the amount of three hundred million yen (300,000,000) in the form of grant for the purchase of fertilizer(hereinafter referred to as "the Grant"). Details on the Grant will be stipulated by the arrangements between the Government of Japan and the Programme.

2(1)　ニカラグァ共和国政府は、次のことのために必要な措置をとる。

2. (1) The Government of the Republic of Nicaragua will take necessary measures:

(a)　贈与に基づいて購入される肥料の二カラグァ共和国内での荷揚げ及び通関並びに国内輸送が速やかに行われることを確保すること。

(a) to ensure prompt unloading and customs clearance in the Republic of Nicaragua and prompt internal transportation therein of the fertilizer purchased under the Grant;

(b)　贈与に基づいて購入される肥料が二カラグァ共和国における食糧生産の増大に効果的に貢献することを確保すること。

(b) to ensure that the fertilizer purchased under the Grant will make effective contribution to the increase of food production in the Republic of Nicaragua; and

(c)　贈与の実施のために必要なすべての経費(贈与によって負担されるものを除く。)を負担すること。

(c) to bear all the expenses, other than those covered by the Grant, necessary for the execution of the Grant.

(2)　贈与に基づいて購入された肥料は、ニカラグァ共和国から再輸出されてはならない。

(2) The fertilizer purchased under the Grant shall not be re-exported from the Republic of Nicaragua.

3(1)　ニカラグァ共和国政府は、贈与に基づき購入された肥料の価額に相当する額を同国政府の名義でニカラグァ中央銀行に開設される勘定に二カラグァ通貨で積み立てる。積立ては、この取極が効力を生ずる日から四年以内に行われる。

3. (1) The Government of the Republic of Nicaragua will deposit in Nicaraguan currency an amount equivalent to the value of the fertilizer purchased under the Grant in an account to be opened in it name in the Central Bank of Nicaragua. The deposit shall be made within the period of four years from the date of coming into force of the present arrangements.

(2)　このようにして積み立てられた通貨は、二カラグァ共和国における食糧生産の増大を含む農業開発、林業開発又は水産業開発の目的のために利用される。

(2) The currency thus deposited shall be utilized for agricultural, forestry and/or fisheries development purpose, including the increase of food production in the Republic of Nicaragua.

(3)　両政府の関係当局は、積み立てられた通貨の利用について相互に協議する。

(3) The authorities concerned of the two Governments will consult with each other about the utilization of the currency deposited.

4　この取極の実施に関する手続細目は、両政府の関係当局間で協議により合意される。

4. Further procedural details for the implementation of the present arrangements will be agreed upon through consultation between the authorities concerned of the two Governments.

5　両政府は、この取極から又はこれに関連して生ずるいかなる問題についても相互に協議する。

5. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the present arrangements.

　本使は、更に、この書簡及びニカラグァ共和国政府に代わって前記の取極を確認される貴官の返簡が両政府間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生することを提案する光栄を有します。

　I have further the honour to propose that this Note and your Note in reply confirming on behalf of the Government of the Republic of Nicaragua the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of your reply.

　書簡をもって啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency,
  I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

　本官は、更に、ニカラグァ共和国政府に代わって前記の取極を確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。

　I have further the honour to confirm on behalf of the Government of the Republic of Nicaragua the foregoing arrangements and to agree that Your Excellency's Note and this Note shall be re9arded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.

　本官は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

　I avail myself of this opportunity to extend to Your Excellency the assurance of highest consideration.
