円借款の供与に関する日本国政府とネパール王国政府との間の交換公文

書簡をもって啓上いたします。本使は、ネパール王国の経済開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とネパール王国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Sir, I have the honour to confirm the following under standing recently reached between the representatives of the Government of Japan and of His Majesty l s Government of Nepal concerning a Japanese loan to be extended with a view to promoting the economic development efforts of the Kingdom of Nepal:
1 二十七億千万円(二、七一〇、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款」という。)が、クリカニ防災計画(以下「計画」という。)の実施のため、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、ネパール王国政府に供与されることになる。
1. A loan in Japanese Yen up to the amount of two billion seven hundred and ten million yen (2,7l0,000,000) (hereinafter referred to as "the Loan") will be extended to His Majesty's Government of Nepal by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan for the implementation of the Kulekhani Disaster Prevention Project (hereinafter referred to as "the Project").
2(1) 借款は、ネパール王国政府と基金との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. (1) The Loan will be made available by a loan agreement to be concluded between His Majesty's Government of Nepal and the Fund. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years.
(b) 利子率は、年一パーセントとする。
(b) The rate of interest will be one (1) per cent per annum.
(c) 支出期間は、借款契約の発効の日から五年とする。
(c) The disbursement period will be five (5) years from the date of coming into force of the loan agreement.
(2) (1)にいう借款契約は、基金が計画の実行可能性を確認した後に締結される。
(2) The loan agreement mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility of the Project.
(3) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The disbursement period mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 借款は、ネパールの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して既に行ったか又は行う支払で、計画の実施に必要に生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3. (1) The Loan will be made available to cover payments already made and/or to be made by Nepalese executing agencies to suppliers, contractor s and/or consultants of eligible source countries under such contracts as have been or may be entered into between them for purchases of products and/or services to be required for the implementation of the Project, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) 借款の一部は、計画の実施のための適格な現地通貨の需要に充てるために使用することができる。
(2) A part of the Loan may be used to cover eligible local currency requirements for the implementation of the Project.
(3) (1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(3) The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
4 ネパール王国政府は、3(1)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
4. His Majesty's Government of Nepal will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
5 ネパール王国政府は、次のものを免除する。
5. His Majesty l s Government of Nepal will exempt:
(a) 基金について、借款及びそれから生ずる利子に対して又はそれらに関連して課されるネパールの財政課徴金又は租税
(a) the Fund from Nepalese fiscal levies of taxes on and/or in connection with the Loan as well as interest accruing Therefrom;
(b) 供給者、請負業者又はコンサルタントとして活動する日本国の会社について、借款に基づいて行われる生産物又は役務の供給から取得する所得に関するネパールの財政課徴金又は租税
(b) Japanese companies operating as suppliers, contractor s and/or consultants from Nepalese fiscal levies or taxes with respect to their income accruing from the supply of products and/or services to be provided under the Loan; and
(c) 請負業者又はコンサルタントとして活動する日本国の会社について、借款の対象として取り上げられる計画又は設備の供給の実施に必要な白己の資材及び設備の輸入及び再輸出に関するネパールの関税及び関連の公課
(c) Japanese companies operating as contractor s and/or consultants from Nepalese duties and related fiscal charges with respect to the import and re-export of their own materials and equipment needed for the implementation of the Project or the equipment supply taken up for the Loan.
(d) 計画の実施に従事する日本国民である被用者について、日本国の会社(ただし、それらの会社が計画の実施のための供給者、請負業者又はコンサルタントとして活動する場合に限る。)から取得する個人所得に対してネパール王国において課されるすべての財政課徴金又は租税
(d) Japanese employees engaged in the implementation of the Project from all fiscal levies or taxes imposed in the Kingdom of Nepal on their personal income derived from Japanese companies, provided that those companies operate as supplier s, contractors and/or consultants for the implementation of the Project.
6(1) ネパール王国政府は、要請に応じ、日本国政府に対し、計画の実施の進捗状況に関する情報及び資料を提出する。
6. (1) His Majesty's government of Nepal will, upon request, furnish the Government of Japan with information and data concerning the progress of the implementation of the Project.
(2) 両政府は、(1)にいう情報及び資料に基づいて共同して借款の実施の進捗状況を随時検討し、必要に応じ、借款の円滑かつ効果的な使用を確保するために適当な措置をとる。基金は、この検討に参加するよう招かれる。
(2) The two Governments will jointly review from time to time, on the basis of the information and data mentioned in sub-paragraph (1) above, the progress of the implementation of the Loan and take, if necessary, appropriate measures to secure smooth and effective utilization of the Loan. The Fund will be invited to participate in such review.
7 3(1)にいう生産物又は役務の供給に関連してネパール王国においてその役務が必要とされる日本国民は、作業の遂行のためネパール王国への入国及び同国における滞在に必要な便宜を与えられる。
7. Japanese nationals whose services may be required in the Kingdom of Nepal in connection 1 the supply of products and/or services mentioned in sub-paragraph (1) of paragraph 3 will be accorded such facilities as may be as may as necessary for their entry into the Kingdom of Nepal and stay therein for the performance of their work.
8 両政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、それぞれの国の関係法令の範囲内で、両国の海運会社及び海上保険会社の公正かつ自由な競争を妨げることのあるいかなる直接又は間接の制限も課さない。
8. With regard to the shipping and marine insurance of products purchased under the Loan, the two Governments will refrain, within the scope of relevant laws and regulations of the respective countries, from imposing, directly or indirectly, any restrictions that may hinder fair and free competition of the shipping and marine insurance companies of the two countries.
9 ネパール王国政府は、次のことを確保するために必要な措置をとる。
9. His Majesty' s Government of Nepal will take necessary measures to ensure that:
(a) 借款が適正にかつ専ら計画のために使用されること。
(a) the Loan be used properly and exclusively for the Project; and
(b) 借款に基づいて建設される施設がこの了解に定められた目的のために適正にかつ効果的に維持され及び使用されること。
(b) the facilities constructed under the Loan be maintained and used properly and effectively for the purposes prescribed in this understanding.
10 両政府は、前記の了解から又はそれに関連して生することのあるいかなる事項についても相互に協議する。
10. The two Governments will consult with each other with respect to any matter that may arise from or in connection with the foregoing understanding.
本使は、貴官が前記の了解をネパール王国政府に代わって確認されれば幸いであります。
I shou1d be grateful if you would confirm the foregoing understanding on behalf of His Majesty 1 s Government of Nepal.
