円借款の供与に関する日本国政府と大韓民国政府との間の交換公文

書簡をもって啓上いたします。本使は、大韓民国の国民の福祉及び経済開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者と大韓民国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Korea concerning a Japanese loan to be extended with a view to promoting the welfare of the people and economic development efforts of the Republic of Korea.
1 九百九十五億九千万円(九九、五九〇、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款」という。)が、この書簡に附属する事業計画表(以下「事業計画表」という。)に掲げる計画を実施するため、各計画につき事業計画表に定める配分に応じ、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、大韓民国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of ninety-nine billion five hundred ninety million yen (99,590,000,000) (hereinafter referred to as "the Loan") will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Korea by the Overseas Economic Cooperation Fund (hereinafter refer red to as "the Fund"), for the implementation of the projects listed in the Project List attached hereto (hereinafter referred to as "the Project List") according to the allocation for each project as specified in the Project List.
2(1) 借款は、大韓民国政府と基金との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. (1) The Loan will be made available by loan agreements to be concluded between the Government of the Republic of Korea and the Fund. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreements which will contain, inter alia, the following principles:
(a) 償還期間は、事業計画表の1から6までに掲げる計画については、七年の据置期間の後十八年とし、事業計画表の7に掲げる計画については、七年の据置期間の後十三年とする。
(a) The repayment period will be eighteen (18) years after the grace period of seven (7) years with regard to the projects mentioned in 1, 2, 3, 4, 5 and 6 of the Project List and thirteen (13) years after the grace period of seven (7) years with regard to the project mentioned in 7 of the Project List.
(b) 利子率は、年四･〇パーセントとする。
(b) The rate of interest will be four (4.0) per cent per annum.
(c) 支出期間は、事業計画表の1から6までに掲げる計画については、関係借款契約の発効の日から五年とし、事業計画表の7に掲げる計画については、関係借款契約の発効の日から四年とする。
(c) The disbursement period will be five (5) years with regard to the projects mentioned in 1, 2, 3, 4, 5, and 6 of the Project List and four (4) years with regard to the project mentioned in 7 of the Project List from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約の各々は、基金がその実行可能性を確認した後に締結される。
(2) Each of the loan agreements mentioned in sub-paragraph (1) will be concluded after the Fund is satisfied of its feasibility.
(3) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The disbursement period mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 事業計画表の1から6までに掲げる計画に対する借款は、韓国の実施機関が調達適格国の供給者又は請負業者に対して行う支払で、1にいう計画の実施に必要な生産物又は役務の購入のために両者の間で締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3. (1) The Loan for the projects mentioned in 1, 2, 3, 4, 5 and 6 of the Project List will be made available to cover payments to be made by Korean executing agencies to suppliers and/or contractors of eligible source countries under such contracts as may be entered into between them for purchases of products and/or services required for the implementation of the projects mentioned in paragraph 1 above, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) 事業計画表の7に掲げる計画に対する借款は、韓国中小企業銀行及び韓国国民銀行が中小製造企業の近代化のために借入人に対して行う融資に充てるために使用に供される。
(2) The Loan for the project mentioned in 7 of the Project List will be made available to cover credits to be extended by the Industrial Bank of Korea and the Citizens National Bank of the Republic of Korea to the sub-borrowers for modernization of small and medium scale manufacturing industries.
(3) 借款の一部は、事業計画表の5及び6に掲げる計画の実施のための適格な現地通貨の需要に充てるために使用することができる。
(3) A part of the Loan may be used to cover eligible local currency requirements for the implementation of the projects mentioned in 5 and 6 of the Project List.
(4) (1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(4) The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
4 大韓民国政府は、3(1)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
4. The Government of the Republic of Korea will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
5 大韓民国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、両国の海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
5. With regard to the shipping and marine insurance of products purchased under the Loan, the Government of the Republic of Korea will refrain from imposing any restrictions that may hinder fair and free competition between the shipping and marine insurance companies of the two countries.
6 借款に基づいて行われる生産物又わ役務の供給に関連して大韓民国においてその役務が必要とされる日本国民は、大韓民国の関係法令に従って、作業の遂行のための大韓民国への入国及び同国における滞在に必要な便宜を与えられる。
6. Japanese nationals whose services may be required in the Republic of Korea in connection with the supply of products and/or services under the Loan will be accorded, in accordance with the relevant laws and regulations of the Republic of Korea, such facilities as may be necessary for their entry into the Republic of Korea and stay therein for the performance of this work.
7 大韓民国政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連して大韓民国において課されるすべての財政課徴金又は租税を免除する。
7. The Government of the Republic of Korea will exempt the Fund from any fiscal levy or tax imposed in the Republic of Korea on and/or in connection with the Loan and interest accruing therefrom.
8 大韓民国政府は、次のことを確保するために必要な措置をとる。
8. The Government of the Republic of Korea will take necessary measures to ensure that:
(1) 借款が適正にかつ専ら事業計画表に掲げる計画のために使用されること。
(1) The Loan be used properly and exclusively for the projects listed in the Project List, and
(2) 借款に基づいて建設される施設がこの了解に定められた目的のために適正にかつ効果的に維持され及び使用されること。
(2) The facilities constructed under the Loan be maintained and used properly and effectively for the purposes prescribed in this understanding.
9 両政府は、共同して借款の実施状況を随時検討し、必要に応じ、借款の円滑かつ効果的な使用を確保するための措置をとる。
9. The two Governments will hold joint review on the progress of the implementation of the Loan from time to time and take measures, whenever necessary, to ensure smooth and effective utilization of the Loan.
10 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
10. The two Governments will consult with each other with respect to any matter that may arise from or in connection with this understanding.
本使は、閣下が前記の了解を大韓民国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing under standing on behalf of the Government of the Republic of Korea.
