 Tokyo, May 9, l990

 書簡をもつて啓上いたします。本大臣は、千九百八十九年十月二十四日にパリで開催されたエクアドル共和国政府の代表者と関係債権諸国政府の代表者との間の会合において到達した結論に基づき日本国政府の代表者とエクアドル共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本大臣は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
 Excellency,
  I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Ecuador that were held on the bas is of the conclusions reached during the consultations between the representatives of the Government of the Republic of Ecuador and of the Governments of the creditor countries concerned held in Par is on October 24, l989. I have further the honour to confirm the following under standing reached in the course of the said negotiations:

1 債務繰延方式による債務救済措置が、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan.

2(1) 繰り延べられる債務(以下「繰延債務」という。)は、エクアドル共和国政府が基金に対して負う次の債務から成り、その内訳文、この書簡の付表に掲げられる。
2. (1) The debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") consist of the following debts owed by the Government of the Republic of Ecuador to the Fund, the breakdown of which is shown in the List attached he re to:

(a) 過去に繰り延べられなかった債務で、(i)千九百八十元年十月三十一日以前に弁済期限が到来し、かつ、未払のもの
(a) The debts not previously rescheduled, (i) having fallen due on or before October 31, l989 and not paid, and

(ii) 千九百八十九年十一月一日から千九百九十年十二月三十一日までの間(両期日を含む。)に弁済期限が到来したか又は到来するもの
(ii) having fallen or falling due between November 1, 1989 and December 31, 1990, both dates inclusive;

(b) エクアドル共和国政府が基金に対して負う債務についての債務救済措置に関し千九百八十四年三月八日及び千九百八十五年九月十一日に日本国政府とエクアドル共和国政府との間で交換された書簡により行われた取極に従つて繰り延べられた債務で、
(b) The debts rescheduled pursuant to the arrangements made by the Notes exchanged between the Governments of Japan and of the Republic of Ecuador on March 8, 1984, and on September 11, 1985 concerning a debt relief measure with respect to the debts owed by the Government of the Republic of Ecuador to the Fund,

(i) 千九百八十九年十月三十一日以前に弁済期限が到来し、かつ、未払のもの
(i) having fallen due on or before October 31, 1989 and not paid, and

(ii) 千九百八十九年十一月一日から千九百九十年十二月三十一日までの間(両期日を含む。)に弁済期限が到来したか又は到来するもの
(ii) having fallen or falling due between November 11989 and December 31, 1990, both dates inclusive; and

(c) エクアドル共和国政府が基金に対して負う債務についての債務救済措置に関し千九百八十八年十二月二十七日に日本国政府とエクアドル共和国政府との間で交換された書簡により行われた取極に従って繰り延べられた債務で、
(c) The debts rescheduled pursuant to the arrangements made by the Notes exchanged between the Governments of Japan and of the Republic of Eudora on December 27, 198 concerning a debt relief measure with respect to the debts owed by the Government respect to the debts owed by the Government of the Republic of Ecuador to the fund,

(i) 千九百八十九年十二月三十一日以前に弁済期限が到来し、かつ、未払のもの
(i) having fallen due on or before December 31, 1989 and not paid, and

(ii) 千九百九十年一月一日から千九百九十年十二月三十一日までの間(両期日を含む。)に弁済期限が到来したか又は到来するもの
(ii) having fallen or falling due between January 1, 1990 and December 31, 1990, both dates inclusive.

(2) 繰延債務の総額は、十八億六千四百四十一万七千百十一円(一、八六四、四一七、一一一円)になる。
(2) The total amount of the Rescheduled Debts will be one thousand eight hundred sixty-four million four hundred seventeen thousand one hundred and eleven yen (1, 864, 4l7, 111).

(3) (2)にいう総額及びこの書簡の付表は、エクアドル共和国政府の関係当局及び基金が行う最終(ii)照合の後に日本国政府及びエクアドル共和国政府の関係当局の合意により修正されることがある。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above and the List attached hereto by agreement between the authorities concerned of the Governments of Japan and of the Republic of Ecuador, after the final verification to be made by the authorities concerned of the Government of the Republic of Ecuador and the Fund.

3 債務繰延べの条件は、エクアドル共和国政府と基金との間で締結される債務繰延契約(以下「債務繰延契約」という。)であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in rescheduling agreements to be concluded between the Government of the Republic of Ecuador and the Fund, which will contain, inter alia, the following principles:

(1)(a) 2(1)(a)(i)及び(b)(i)にいう債務の各々は、千九百九十五年十一月三十日に始まる八回の均等半年賦払によつて支払われる。
(1) (a) Each of the debts referred to in (a) (i) and (b) (i) of sub-paragraph (1) of paragraph 2 will be paid in eight (8) equal semi-annual installments beginning on November 30, l995.

(b) 2(1)(a)(ii)及び(b)(i)にいう債務の各々は、千九百九十六年十一月三十日に始まる八回の均等半年賦払によつて支払われる。
(b) Each of the debts referred to in (a) (ii) and (b) (ii) of sub-paragraph (1) of paragraph 2 will be paid in eight (8) equal semi-annual installments beginning on November 30, l996.

(c) (2)(1)(a)(i)にいう債務は、千九百九十年六月三十日に支払われる。
(c) The debts referred to in (c) (i) of sub-paragraph (1) of paragraph 2 will be padre June 30, l990.

(d) 2(1)(c)(ii)にいう債務は、千九百九十一年六月三十日に支払われる。
(d) The debts referred to in (c) (ii) of Sub-paragraph (1) of paragraph 2 will be paid on June 30, l99l.

(2) 繰延債務に対してそれぞれこの書簡の付表に掲げる弁済期日から適用される利子率は、年五・二五パーセントとする。
(2) The rate of interest on the Rescheduled Debts will be five and a quarter per cent (5.25%) per annum beginning respectively from the due dates mentioned in the List attached hereto.

 本大臣は、閣下が、前記の了解をエクアドル共和国政府に代わって確認されれば幸いであります。
 I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Ecuador.

 Excellency,
  I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Ecuador that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Ecuador and of the Governments of the creditor countries concerned held in Par is on October 24, l989. I have further the honour to con firm the following under standing reached in the course of the said negotiations:

1 債務繰延方式による債務救済措置が、日本軸出入銀行及び関係民間銀行(以下「銀行」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken by the Export-import Bank of Japan together with private banks concerned (hereinafter refer red to as "the Banks") in accordance with the relevant laws and regulations of Japan.

2(1) 繰り延べられる債務(以下「繰延債務」という。)は、エクアドル共和国政府及びエクアドル電力庁が銀行に対して負う次の債務から成り、その内訳文はこの書簡の付表に掲げられる。
2. (1) The debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") consist of the following debts owed by the Government of the Republic of Ecuador and the Institute Ecuadorian de Electrification to the Banks, the breakdown of which is shown in the List attached hereto:

(a) 過去に繰り延べられなかった債務で、
(a) The debts not previously rescheduled,

(i) 千九百八十九年十月三十一日以前に弁済期限が到来し、かつ、未払のもの
(i) having fallen due on or before October 3l, l989 and not paid, and

(ii) 千九百八十九年十一月一日から千九百九十年十二月三十一日までの間(両期日を含む。)に弁済期限が到来したか又は到来するもの
(ii) having fallen or falling due between November 1, l989 and December 3l, l990, both dates inclusive;

(b) エクアドル共和国政府及びエクアドル電力庁が銀行に対して負う債務についての債務救済措置に関し千九百八十四年三月八日及び千九百八十五年九月十一日に日本国政府とエクアドル共和国政府との間で交換された書簡により行われた取極に従って繰り延べられた債務で、
(b) The debts rescheduled pursuant to the arrangements made by the Notes exchanged between the Governments of Japan and of the Republic of Ecuador on March 8, l984 and on September 11, l985 concerning a debt relief measure with respect to the debts owed by the Government of the Republic of Ecuador and the Institute Ecuadorian de Electrification to the Banks,

(i) 千九百八十九年十月三十一日以前に弁済期限が到来し、かつ、未払のもの
(i) having fallen due on or before October 31, 1989 and not paid, and

(c) エクアドル共和国政府及びエクアドル電力庁が銀行に対して負う債務についての債務救済措置に関し千九百八十八年十二月二十七日に日本国政府とエクアドル共和国政府との間で交換された書簡により行なわれた取極に従って繰り延べられた債務で、
(c) The debts rescheduled pursuant to the arrangements made by the Notes exchanged between the Governments of Japan and of the Republic of Ecuador on December 27, 1988 concerning a debt relief measure with respect to the debts owed by the Government of the Republic of Ecuador and the Institute Ecuadorian de Electrification to the Banks,

(i) 千九百八十九年十二月三十一日以前に弁済期限が到来し、かつ、未払いのもの
(i) having fallen due on or before December 31, 1989 and not paid, and

(ii) 千九百九十年一月一日から千九百九十年十二月三十一日までの間(両期日を含む。)
(ii) having fallen or falling due between January 1, 1990 and December 31, 1990, both dates inclusive.

(2) 繰延債務の総額は、十七億三千八百五十二万五千五十四円(一、七三八、五二五、○五四円)になる。
(2) The total amount of the Rescheduled Debts will be one thousand seven hundred thirty eight million five hundred twenty-five thousand and fifty-four yen (1, 738, 525, 054).

(3) (2)にいう総額及びこの書簡の付表は、エクアドル共和国政府の関係当局、エクアドル電力庁及び銀行が行う最終的照合の後に日本国政府及びエクアドル共和国政府の関係当局間の合意により修正されることがある。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above and the List attached hereto by agreement between the authorities concerned of the Governments of Japan and of the Republic of Ecuador, after the final verification to be made by the authorities concerned of the Government of the Republic of Ecuador, the lnstituto Ecuatoriano de Electrificacion and the Banks.

3 債務繰延べの条件は、一方においてエクアドル共和国政府及びエクアドル電力庁と他方において銀行との間で締結される債務繰延契約であつて、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in rescheduling agreements to be concluded between the Government of the Republic of Ecuador and the Instituto Ecuatoriano de Electrificacion on the one hand and the Banks on the other, which will contain, inter alia, the following principles:

(b) 2(1)(a)(ii)及び(b)(ii)にいう債務の各々は、千九百九十六年十一月三十日に始まる八回の均等半年賦払によって支払われる。
(b) Each of the debts referred to in (a) (ii) and (b) (ii) of sub-paragraph (1) of paragraph 2 will be paid in eight (8) equal semi-annual installments beginning on November 30, l996.

(c) 2(1)(c)(i)にいう債務は、千九百九十年六月三十日に支払われる。
(c) The debts referred to in (c) (i) of sub-paragraph (1) of paragraph 2 will be paid on June 30, l990.

(d) 2(1)(c)(ii)にいう債務は、千九百九十一年六月三十日に支払われる。
(d) The debts referred to in (c) (ii) of sub-paragraph (1) of paragraph 2 will be paid on June 30, l99l.

(2)(a) 付表の1、3、4及び5の債務についてそれぞれこの書簡の付表に掲げる弁済期日から適用される繰延利子率は、年五・七五パーセントとする。
(2) (a) The rate of interest on the Rescheduled Debts will be five and three quarters per cent (5.75%) per annum for the debts mentioned in 1, 3, 4 and 5 of the List beginning respectively from the due dates mentioned in the List attached hereto.

(b) 付表の2、6、7、8、9、10及びの債務についてそれぞれこの書簡の付表に掲げる弁済期日又は千九百八十九年十月二十四日のいずれか遅い方の期日から適用される繰延利子率は、年七・三パーセントとする。千九百八十九年十月二十三日以前に弁済期日が到来した債務に対してこの書簡の付表に掲げる弁済期日から千九百八十九年十月二十三日までの間(両期日を含む。)に適用される利子率は、当初の関係借款契約又は関係債務繰延契約の中にそれぞれ規定された利子率と同等とする。
(b) The rate of interest on the Rescheduled Debts will be seven point three per cent (7.3%) per annum for the debts mentioned in 2, 6, 7, 8, 9, 10 and 11 of the List beg inning respectively from the due dates mentioned in the List attached hereto or October 24, l989, whichever is the later, provided, however, the rate of interest on the debts having fallen due on or before October 23, 1989 applied during the period between the due dates Intentioned in the List attached hereto and October 23, l989, both dates inclusive, will be equal to the rate of interest respectively stipulated in the original loan agreements or rescheduling agreements concerned.

 Excellency,
  I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of th6 Republic of Ecuador that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Ecuador and of the Governments of the creditor countries concerned held in Par is on October 24, 1989. I have further the honour to confirm the following understanding reached in the course of the said negotiations:

1(1) この取極は、一方においてエクアドル共和国政府及び政府企業並びにエクアドルの民間企業及び個人(以下「債務者」という。)と他方において日本国の居住者である関係債権者(以下「債権者」という。)との間で契約され、かつ、日本国政府が保険を引き受けた次の商業上の債務の元本及び利子(以下「繰延商業債務」という。)の総額に適用される。
1 (1) The present arrangements will apply to the total amount of the following principal of and interest on the commercial debts, contracted between the Government and governmental corporations of the Republic of Ecuador and Ecuadorian private enterprises and persons (hereinafter referred to as "the Debtors") on the one hand and the creditors concerned resident in Japan (hereinafter referred to as "the Creditors") on the other and insured by the Government of Japan (hereinafter referred to as "the Rescheduled Commercial Debts"):

(a) 過去に繰り延べられなかった商業上の債務にざし、債務者と債権者との間で千九百八十三年一月一日より前に契約され、かつ、弁済期間が一年を超える債務で、
(a) For the commercial debts not previously rescheduled and contracted before January l, l983 between the Debtors and the Creditors with a repayment period of more than one year,

(i) 千九百八十九年十月三十一日以前に弁済期限が到来し、かつ、未払の元本及び利子
(i) the principal and interest having fallen due on or before October 31, 1989 and not paid, and

(ii) 千九百八十九年十一月一日から千九百九十年十二月三十一日までの間(両期日を含む。)に弁済期限が到来したか又は到来する元本及び利子
(ii) the principal and interest having fallen or falling due between November 1, 1989 and December 31, 1990, both dates inclusive;

(b) 日本国政府が保険を引き受けたエクアドルの商業債務についての債務救済措置に関し千九百八十四年三月八日及び千九百八十五年九月十一日に日本国政府とエクアドル共和国政府との間で交換された書簡(以下「書簡I及びII」という。)により行われた取極に従って繰り延べられた債務で、
(b) For the commercial debts rescheduled pursuant to the arrangements made by the Notes exchanged between the Governments of Japan and of the Republic of Ecuador on March 8, 1984 and on September 11, 1985 concerning a debt relief measure with respect to the Ecuadorian commercial debts insured by the Government of Japan (hereinafter referred to as "the Notes and II"),

(i) 千九百八十九年十月三十一日以前に弁済期限が到来し、かつ、未払の元本及び利子
(i) the principal and interest having fallen due on or before October 31, 1989 and not paid, and

(ii) 千九百八十九年十一月一日から千九百九十年十二月三十一日までの間(両期日を含む。)に弁済期限が到来したか又は到来する元本及び利子
(ii) the principal and interest having fallen or falling due between November 1, 1989 and December 3, 1990, both dates inclusive; and

(c) 日本国政府が保険を引き受けたエクアドルの商業債務についての債務救済措置に関し千九百八十八年十二月二十七日に日本国政府とエクアドル共和国政府との間で交換された書簡(以下「書簡・III」という。)により行われた取極に従って繰り延べられた債務で、
(c) For the commercial debts rescheduled pursuant to the arrangements made by the Notes exchanged between the Governments of Japan and of the Republic of Ecuador on December 27, 1988 concerning a debt relief measure with respect to the Ecuadorian commercial debts insured by the Government of Japan (hereinafter referred to as "the Notes III"),

(i) 千九百八十九年十二月三十一日以前に弁済期限が到来し、かつ、未払の利子
(i) the interest having fallen due on or before December 31, 1989 and not paid; and

(ii) 千九百九十年一月一日から千九百九十年十二月三十一日までの間(両期日を含む。)に弁済期限が到来したか又は到来する利子
(ii) the interest having fallen or falling due between January 1, 1990 and December 31, 1990, both dates inclusive.

(2) 繰延商業債務は、合衆国ドルによって契約されたもの及び日本円によって契約されたものから成る。
(2) The Rescheduled Commercial Debts consist of commercial debts contracted in United States dollars and in Japanese yen.

(a) (1)(a)にいう元本及び利子の総額は、合衆国ドルによって契約されたものについては四百八十七万五千八百二十七合衆国ドル三十二セント(四、八七五、八二七・三二合衆国ドル)と見積もられる。
(a) The total amount of the principal and interest referred to in (a) of sub-paragraph (1) is estimated at four million eight hundred seventy-five thousand eight hundred and twenty-seven United Stated dollars and thirty-two cents (US$4, 875, 827.32) for the debts contracted in United States dollars.

(b) (1)(b)にいう元本及び利子の総額は、合衆国ドルによって契約された債務については七百九万四千七百四十六合衆国ドル八十六セント(七、○九四、七四六。八六合衆国ドル)及び日本円によって契約された債務については十二億六千八十三万二千五百四十四円(一、二六○、八三二、五四四円)と見積もられる。
(b) The total amount of the principal and interest referred to in (b) of sub-paragraph (1) is estimated at seven million ninety-four thousand seven hundred and forty-six United States dollars and eighty-six cents (US$7,094,746.86) for the debts contracted in United States dollars, and one thousand two hundred sixty million eight hundred thirty-two thousand five hundred and forty-four yen (1,260,832,544) for the debts contracted in Japanese yen.

(c) (1)(c)(i)にいう利子の総額は、合衆国ドルによって契約された債務については七十万千三百九十三合衆国ドル四十六セント(七○一、三九三・四六合衆国ドル)及び日本円によって契約された債務については一億二十五万九千百七十円(一○○、二五九、一七○円)と見積もられる。
(c) The total amount of the interest referred to in (c) (i) of sub-paragraph (1) is estimated at seven hundred one thousand three hundred ninety-three United States dollars and forty-six cents (US$70l,393.46) for the debts contracted in United States dollars, and one hundred million two hundred fifty-nine thousand one hundred and seventy yen (100,259,l70) for the debts contracted in Japanese yen.

(d) (1)(c)(ii)にいう利子の総額は、合衆国ドルによって契約された債務については百四十一万四千四百十二合衆国ドル二十三セント(一、四一四、四一二、二三合衆国ドル)及び日本円によって契約された債務については二億二百十八万九十三円(二○二、一八○、○九三円)と見積もられる。
(d) The total amount of the interest referred to in (c) (ii) of sub-paragraph (1) is estimated at one thousand four hundred four teen thousand four hundred and twelve United States dollars and twenty-three cents (US$1,414,412.23) for the debts contracted in United States dollars and two hundred two million one hundred eighty thousand ninety-three yen (202,l80,093) for the debts contracted in Japane5e yen.

(3) (2)にいう総額は、日本国政府及びエクアドル共和国政府の関係当局が行う最終照合の後に両政府の関係当局間の合意により修正されることがある。
(3) Modifications may be made to the total amount referred to in sub--paragraph (2) above by agreement between the authorities concerned of the Governments of Japan and of the Republic of Ecuador, after the final verification to be made by the authorities concerned of the two Governments.

2(1) エクアドル共和国政府は、エクアドル中央銀行を通じて、繰延商業債務を決済するため(4)に掲げる支払計画(以下「支払計画」という。)に従って行われる支払の額及び日付について日本国政府に通告する。
2. (1) The Government of the Republic of Ecuador will notify through the Central Bank of Ecuador the Government of Japan of the amount and dates of payments which will be made in order to settle the Rescheduled Commercial Debts in accordance with the payment scheme as set out in sub-paragraph (4) below (hereinafter referred to as "the Payment Scheme").

(2) エクアドル共和国政府は、繰延商業債務の総額を支払計画に従いエクアドル共和国中央銀行を通じ関係契約によって指定された通貨により債権者に支払い、また、同政府以外の関係債務者が支払うことを確保する。
(2) The Government of the Republic of Ecuador will pay, or will ensure that other debtors concerned pay, the total amount of the Rescheduled Commercial Debts to the Creditors in the currency order regencies designated in the contracts concerned through the Central Bank of Ecuador in accordance with the Payment Scheme.

(3) 日本国政府は、商業上の関係債務が支払計画に従って行われる支払により決済されることを容易にするため、日本国において施行されている関係法令の範囲内で可能な措置をとる。
(3) The Government of Japan will take possible measures, within the scope of the relevant laws and regulations in force in Japan, to facilitate the settlement of the commercial debts concerned by the payment to be made in accordance with the Payment Scheme.

(4)(a) 1(1)(a)(i)及び(b)(i)にいう元本及び利子の総額は、千九百九十五年十一月三十日に始まる八回の均等半年賦払によって支払われる。
(4) (a) The total amount referred to in (a) (i) and (b) (i) of sub-paragraph (2) of paragraph 1 will be paid in eight (8) equal semi-annual installments beginning on November 30, 1995.

(b) 1(1)(a)(ii)及び(b)(ii)にいう元本及び利子の総額は、千九百九十六年十一月三十日に始まる八回の均等半年賦払によって支払われる。
(b) The total amount referred to in (a) (ii) and (b) (ii) of sub-paragraph (2) of paragraph 1 will be paid in eight (8) equal semi-annual installments beginning on November 30, 1996.

(c) 1(1)(c)(i)にいう利子の総額は、千九百九十年六月三十日に支払われる。
(c) The total amount referred to in (c) (i) of sub-paragraph (2) of para9raph 1 will be paid on June 30, 1990.

(d) 1(1)(c)(ii)にいう利子の総額は、千九百九十一年六月三十日に支払われる。
(d) The total amount referred to in (c) (ii) of sub-paragraph (2) of paragraph 1 will be paid on June 30, 1991.

3(1) エクアドル共和国政府は、商業上の関係債務の各々について、当該債務が決済されていない限り、(2)に定めるところにより算定される利子を次の計画に従つて債権者に支払う。
3. (1) The Government of the Republic of Ecuador will pay to the Creditors, in accordance with the following schedule, interest to be calculated as described in sub-paragraph (2) below on each of the commercial debts concerned to the extent that they have not been settled:

(a) 1(1)(a)及び(b)にいう元本及び利子に対する利子は、毎年五月三十一日及び十一月三十日に支払われる。最初の利子の支払は、千九百九十年五月三十一日に行われる。
(a) The interest on the principal and interest referred to in (a) and (b) of sub-paragraph (1) of paragraph 1 will be paid on November 30 and May 31 each year. The first payment will be made on May 31, l990.

(b) 1(1)(c)(i)にいう利子に対する利子は、千九百九十年六月三十日に支払われる。
(b) The interest on the interest referred to in (c) (i) of sub-paragraph (1) of paragraph l will be paid on June 30, 1990.

(c) 1(1)(c)(ii)にいう利子に対する利子は、千九百九十一年六月三十日に支払われる。
(c) The interest on the interest refer red to in (c) (ii) of sub-paragraph (1) of paragraph 1 will be paid on June 30, 1991.

(2)(a) 繰延商業債務に対する支払計画上の利子率は、合衆国ドルによって契約された債務については年九パーセント、日本円によって契釣された債務については年七・三パーセントとする。
(2) (a) The rate of interest on the Rescheduled Commercial Debts applied for the payment Scheme will be nine per cent (9%) per annum for the debts contracted in United States dollars and seven point three per cent (7.3%) per annum for the debts contracted in Japanese yen.

(b) 支払われる利子の額は、本決済の債務の額に当該債務が決済されないまま経過した日数及び一日当たりの利子率を乗じて算定される。一日当たりの利子率は、(a)にいう利子率を三百六十五で除して算定される。前記の算定方法を算式で表したものが、この書簡の付表に掲げられる。
(b) The amount of interest to be paid will be calculated by multiplying the amount of the debt unsettled by the product of the number of the days the debt has not been settled and the daily interest rate. The daily interest rate is calculated by dividing the rate of interest referred to in (a) above by three hundred and sixty-five (365). The illustration in the form of numerical formula of the method of calculation mentioned above is shown in the Annex I, II and III attached to this Note.

(3) エクアドル共和国政府は、支払計画(3(1)に掲げる利子の支払計画を含む。)上の支払が遅延した場合には、未払額から生ずる利子を、(2)(a)にいう利子率に年一パーセントを加えた利子率によって支払う。
(3) In case where any payment under the Payment Scheme, including the payment schedule of interest set out in sub-paragraph (1) of paragraph 3, is retarded, the Government of the Republic of Ecuador will pay the late interest accruing from the overdue amount at the rate of one per cent (1.0%) Per annum above the rate of interest mentioned in sub-paragraph (2) (a) above.

(4) 支払われる利子については、エクアドル共和国のすべての租税及び課徴金が免除される。
(4) The interest paid will be exempted from all taxes and duties of the Republic of Ecuador.

4 エクアドル共和国政府は、商業上の関係債務の決済のための送金に伴って生ずる銀行手数料を支払う。
4. The Government of the Republic of Ecuador will pay bank charges which occur in connection with the transfer of the money for the settlement of the commercial debts concerned.

5 債務者が支払計画に従って商業上の関係債務を決済するためエクアドル共和国において必要とされる措置をとらなかった場合には、エクアドル共和国政府は、当該債務が関係契約に従って債務者と債権者との間で決済されることを、エクアドル共和国において施行されている関係法令の範囲内で容易にする。エクアドル共和国政府は、また、関係契約によって指定された通貨による商業上の債務の支払金の自由な移転を保証する。
5. If the Debtors fail to take such measures as are required in the Republic of Ecuador for the settlement of the commercial debts concerned in accordance with the Payment Scheme, the Government of the Republic of Ecuador will facilitate, within the scope of the relevant laws and regulations in force in the Republic of Ecuador, the settlement between the Debtors and the Creditors of Such commercial debts in accordance with the contracts concerned. The Government of the Republic of Ecuador will also guarantee the free transfer of payments of the commercial debts concerned in the currency or currencies designated in the contracts concerned.

6 関係契約の条件のうちこの書簡において特に言及されていないものは、関係契約の当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。
6. It is confirmed that the terms and conditions of the contracts concerned not specifically referred to in this Note will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.

7 エクアドル共和国政府は、いずれかの第三国の居住者である債権者に対し債務救済措置について2(4)にいう条件より有利な条件を与えた場合には、当該第三国の居住者である債権者に与えられる条件より不利でない条件を、債権者に直ちに与える。
7. If the Government of the Republic of Ecuador accords to creditors resident in any third country terms and conditions more favorable than those referred to in sub-paragraph (4) of paragraph 2 with regard to debt relief measures, the Government of the Republic of Ecuador will forthwith accord to the Creditor s the terms and conditions not less favorable than those accorded to creditors resident in such third country.
