スーダン、ソマリア、マラウイ及びチャード国内のアフリカ難民等に対する食糧援助に関する日本国政府と世界食糧計画との間の交換公文

(Japanese Note)

　Rome, March 28, 1989

　書簡をもって啓上いたします。本官は、日本国政府(以下「政府」という。)の代表者と世界食糧計画(以下「計画」という。)の代表者との間で最近行われたスーダン、ソマリア及びマラウイ国内のアフリカ難民並びにチャード国内の被災民に対する緊急食糧援助計画に関する協議に言及するとともに、千九百八十六年の食糧援助規約に関連して政府が計画に供与する意向を有する援助に関する次の取極を提案する光栄を有します。

　Sir,
I have the honour to refer to the recent discussions held between the representatives of the government of Japan (hereinafter referred to as "the Government") and of the World Food Programme (hereinafter referred to as "the Programme") in relation to the emergency food aid programme for the African refugees in Sudan, Somalia and Malawi and the suffering people in Chad and have further the honour to propose the following arrangements concerning the assistance which the Government intends to extend to the Programme in connection with the Food Aid Convention, 1986:

1　政府は、日本国の関係法令に従い、七億八千二百万円(七八二、〇〇〇、〇〇〇円)を贈与の形で計画の使用に供する。

1. The Government shall make available to the Programme, in accordance with the relevant laws and regulations of Japan, the amount of seven hundred and eighty-two million yen (782,000,000) in the form of grant.

2　政府は、日本国の外国為替公認銀行の東京店に開設されている世界食糧計画の勘定に、1に定める額を日本円で払い込む。この額は、政府の関係当局と計画との間の合意によって延長されない限り、この取極が効力を生ずる日から千九百八十九年三月三十一日までの期間中に払い込まれる。

2. The Government shall make a payment of the amount referred to in paragraph 1 in Japanese yen to the World food Programme Account opened in the Tokyo office of an authorized foreign exchange bank of Japan. This amount shall be paid during the period between the date of coming into force of the present arrangements and March 31, 1989, unless the period is extended by mutual agreement between the authorities concerned of the Government and the Programme.

3　政府は、2の規定に従って払込みを行うことにより、その払込みを行った時にその払込みの金額までこの取極に基づく援助を実施したとみなされる。

3. By and upon making the payment under the preceding paragraph, the Government shall be deemed to have made the assistance under the present arrangements to the extent of the amount of such payment.

4(1)　1に定める総額は、スーダン産ソルガム、米国産小麦、ジンバブエ産メイズ及びチャード産ソルガムの購入並びにこの購入に関連する費用(輸送費、保険料及び計画に対する手数料を含む。)に使用される。

4.(1) The total amount referred to in paragraph 1 above shall be used for the purchase of Sudanese sorghum, American wheat, Zimbabwean maize and Chad sorghum, and for the expenditures related to such purchase, including freight, insurance premium and the Programme's agency fees.

(2)　スーダン産ソルガム、米国産小麦、ジンバブエ産メイズ及びチャード産ソルガムの現在の価格、運賃及び保険料を考慮して、最小限九千二百万円(九二、〇〇〇、〇〇〇円)相当のスーダン産ソルガムが購入され、スーダン国内のアフリカ難民に引き渡されること、最小限二億五千万円(二五〇、〇〇〇、〇〇〇円)相当の米国産小麦が購入され、船積みされ、ソマリア国内のアフリカ難民に引き渡されること、最小限七千五百万円(七五、〇〇〇、〇〇〇円)相当のジンバブエ産メイズが購入され、船積みされ、マラウイ国内のアフリカ難民に引き渡されること、また、最小限一億三千万円(一三〇、〇〇〇、〇〇〇円)相当のチャード産ソルガムが購入され、チャード国内の被災民に引き渡されることが期待される。

(2) Taking into account the current price of Sudanese sorghum, American wheat, Zimbabwean maize and Chad sorghum, freight rates and insurance premium, it is expected that a minimum of ninety-two million yen (92,000,000) of Sudanese sorghum will be purchased and delivered to the African refugees in Sudan, a minimum of two hundred and fifty million yen (250,000,000) of American wheat will be purchased, shipped and delivered to the African refugees in Somalia, a minimum of seventy-five million yen (75,000,000) of Zimbabwean maize will be purchased, shipped and delivered to the African refugees in Malawi and a minimum of one hundred and thirty million yen (130,000,000) of Chad sorghum will be purchased and delivered to the suffering people in Chad.

(3)　計画は、(2)にいうソルガム、小麦及びメイズの購入、輸送及び保険のため、供給者と計画の財務規則に従い契約を締結する。

(3) The Programme shall enter into contracts with suppliers for the purchase of the sorghum, the wheat and the maize referred to in sub-paragraph (2) and for the shipping and insurance in accordance with the Programme's financial rules.

5　計画は、4の規定に従って購入したソルガム、小麦及びメイズをできる限り速やかにスーダン、ソマリア及びマラウイ国内のアフリカ難民並びにチャード国内の被災民に引き渡するために必要なすべての措置をとる。

5. The Programme shall take all the necessary measures to deliver as soon as possible the sorghum, the wheat and the maize purchased under the preceding paragraph to the African refugees in Sudan, Somalia and Malawi and the suffering people in Chad.

6　政府及び計画は、いずれか一方の要請により、この取極から又はこれに関連して生ずるいかなる事項についても、相互に協議する。

6. The Government and the Programme shall consult with each other, at the request of either of them, on any matter that may arise from or in connection with the present arrangements.

7(1)　計画は、供給者と各々の契約を締結した後、遅滞なく次の事項を政府に通報する。

7.(1) When the Programme has entered into each contract with suppliers, it shall inform the Government, without delay, of the following:

(a)　計画が契約に従って支払う総額

(a) Total amount of payments to be made by the Programme under the contract;

(b)　購入したソルガム、小麦又はメイズの総額

(b) Total value of the sorghum, the wheat or the maize purchased;

(c)　ソルガム、小麦又はメイズの数量及び品質

(c) Quantity and quality of the sorghum, the wheat or the maize;

(d)　ソルガム、小麦又はメイズのFOB単価

(d) Unit F.O.B. price of the sorghum, the wheat or the maize;

(e)　輸送費

(e) Freight costs;

(f)　保険料

(f) Insurance premium;

(g)　供給者の名称

(g) Names of the suppliers; and

(h)　船積みの予定日及び配布地への到着の予定日

(h) Expected dates of shipment to and arrival at distribution sites.

(2)　船積み、荷揚げ及び配布地への到着のたびに、計画は、これらの日付並びにソルガム、小麦及びメイズの数量及び品質を政府に通報する。

(2) Each time a shipment is loaded aboard a ship or unloaded therefrom or arrives at the distribution sites, the Programme shall inform the Government of the date and the quantity and condition of the sorghum, the wheat and the maize.

(3)　計画は、最初の積荷が配布地に到着した後、三箇月ごとに、ソルガム、小麦及びメイズの配布に関する報告書を政府に提出する。

(3) After the arrival of the first shipment at the distribution sites, the Programme shall submit to the Government a report on the distribution of the sorghum, the wheat and the maize every three months.

(4)　計画は、この取極に従って購入したソルガム、小麦及びメイズの配布が完了した後、配布に関する最終報告書を、できる限り配布地における写真を付して、政府に提出する。

(4) Upon the completion of the distribution of the sorghum, the wheat and the maize purchased under the present arrangements, the Programme shall provide for the Government a final report on the distribution, if possible together with photographs taken at the distribution sites.

(5)　計画は、ソルガム及びメイズが日本より贈与された旨の標示をソルガム及びメイズの袋に付することを確保する。

(5) The Programme shall ensure that markings the sorghum and the maize bags bear indicate the sorghum and the maize have been donated by Japan.

　本官は、更に、この書簡及び前記の取極を確認される貴官の返簡が政府と計画との間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　I have further the honour to propose that the present Note and your reply confirming the foregoing arrangements shall be regarded as constituting an agreement between the Government and the Programme, which shall enter into force on the date of your reply.

　本官は、以上を申し進めるに際し、ここに貴官に向かって敬意を表します。

　書簡をもって啓上いたします。本官は、本日付けの貴官の次の書簡を受領したことを確認する光栄を有します。

I have the honour to acknowledge the receipt of your Note of today's date which reads as follows:

　本官は、更に、世界食糧計画に代わって前記の取極を確認するとともに、貴官の書簡及びこの返簡が計画と日本国政府との間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。

　I have further the honour to confirm the foregoing arrangement on behalf of the World Food Programme, and to agree that your Note and this reply shall be regarded as constituting an agreement between the Programme and the Government of Japan, which shall enter into force on the date of this reply.
